0114) RESOLUTION AUTHORIZING THE COMMISSIONER'S COURT OF
TARRANT COUNTY, TEXAS TO PURCHASE RIGHTS-OF-WAY AND/
OR EASEMENTS FOR COUNTY, STATE AND FEDERAL ROADS AND
HIGHWAYS WITHIN THE TOWN OF RICHLAND HILLS, TEXAS.
WHEREAS, there appears to be some question as to whether the Commissioner's
Court of Tarrant County, Texas has authority to purchase rights-of-way and/or ease-
ments for the construction of County, State and Federal roads and highways within
the corporate limits of municipalities; and
WHEREAS, it is the desire of the Town of Richland Hills, that the Tarrant
County Commissioner's Court have authority and be authorized to purchase such rights
of way and/or easements as they deem advisable and appropriate.
NOW, THEREFORE, BE IT RESOLVED BY THE BOARD OF ALDERMEN OF THE TOWN OF RICHLAND
HILLS, TEXAS THAT:
Section 1. That the Commissioner's Court of Tarrant County, Texas be, and they are
hereby, authorized to purchase any and all rights of way and/or easements that they
might deem necessary and appropriate for the construction of County, State and Fed-
eral roads and highways.
Section 2. That the said Tarrant County Commissioner's Court is hereby authorized
to purchase the said rights of way and/or easements in the name of such governmental
authorities as they may desire but nothing contained in this Resolution shall ever
011111 be construed as authorizing the said Commissioner's Court to obligate the Town of
Richland Hills, Texas to pay for said rights of way and/or easements without the
prior approval and consent of the Town of Richland Hills, Texas.
Section 3. This Resolution shall become effective from and after its passage.
