M., who 2. led the Pledge of Allegiance to the Flag. 3. INVOCATION: Invocation was given by Rev. Lyman Ellis of St. Paul Methodist Church, E1 Monte at Freer St., Temple City. 4, ROLL CALL: PRESENT: Councilmen- Buchan, Fitzjohn, Merritt, Tyrell, Dickason ABSENT: Councilmen -None ALSO PRESENT: City Attorney Shatford, City Manager ':iloollett. 5. APPROVAL OF MINUTES: Item 3 of Section 15, page 3, was corrected to read "Councilman Buchan moved to approve ". Councilman Merritt moved to approve as corrected, Councilman Tyrell seconded, roll call vote as fol lows: AYES: Councilmen- Buchan, Fitzjohn, Merritt, Tyrell, Dickason NOES: Councilmen -None ABSENT: Councilmen -None 6. ORDINANCE NO. 61 -63, 2nd. read. City Attorney Shatford read title to Ordinance No. 61 -63 AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF TEMPLE CITY, CALIFORNIA, AMENDING THE MUNICIPAL CODE TO CORRECT DUPLICATIONS OF CODE NUMBERS. Councilman Tyrell moved to waive further read- ing of Ordinance No. 61 -63, Councilman Buchan seconded, roll call vote as follows: AYES: Councilmen- Buchan, Fitzjohn, Merritt, Tyrell, Dickason NOES: Councilmen -None ABSENT: Councilmen -None Councilman Tyrell moved to adopt Ordinance No. 61 -63, Council- man Merritt seconded, roll call vote as follows: AYES: Councilmen- Buchan, Fitzjohn, Merritt, Tyrell, Dickason NOES: Councilmen -None ABSENT: Councilmen- I'done 7. TITLE REPORT: East -west alley north of Lower Azusa between Pal Mal and El Monte Ave. City Attorney Shatford advised closing off of this alley presented a very substantial problem. The dedication indicates for use and benefit of tract which is com- posed of 113 lots & all have the right to use the alleyway. Fur- ther since ci5% have some incumbrances everyone sd concerned is involved, and to quiet title would involve all of them. Also these incumbrances might involve the state of Calif. through Veteran loans. This procedure would be a very expensive matter. Following considerable discussion Councilman Fitzjohn moved to refer this matter back to the Traffic Commission together with a legal opinion from the City Attorney, Councilman Buchan se- conded, and carried. 8. The Public Hearing was set for 8 P. M. so the Council continued on with Item 9 until time of the Hearing. 9. CORRESPONDENCE POLICY: City Manager lloollett stated per the request of the Council at their last meeting a research had been made which showed that at the November 13, 1961, Council meeting, a discussion had taken place with Councilman Tyrell requesting a circulating file for all correspondence incoming to the Council and copies of all correspondence to the Mayor be kept in the file also. The purpose of this procedure was to keep the Council aware of 233 Council Minutes, January 22, 1962, page 2 contents and only those requiring action coming before the Coun- cil meetings. Following discussion it was agreed that City Manager ':'!oollett will be responsible for bringing to the Council whatever needs to be acted upon, that the file will be set up with the Councilmen to initial correspondence indicating he has read it so that the file may be cleared and kept up to date. 10. CIVIL DEFENSE REPORT. Mr. Dick Sale, Deputy Director of Civil Defense, reported that the necessary preliminary work was completed and will be given to the Council for approval of the operation plan before being forwarded to the State Disaster OfFice for approval by the State. When this is approved an ordinance and four resolutions will be presented to the Council for adoption which when adopted will provide necessary legal status for Civil Defense. 8 P. M. PUBLIC HEARING. - Re -A 1 to R 3 between Welland & 8. Mayor Dickason declared the Public Hearing opened. Mr. Ed Holden, Planning advisor explained the location, request and recommendation of the Planning Commission approving the zone change and so recommendinc to the Council. Mr. Robt. Michel, Pres. of Arcadia Investment Co., 40 N. 1st Ave., Arcadia, owner of the above property, explained the de- velopment planned if zone change is approved. Mr. Homer Shirley, 11728 Lambert, El Monte, owner of several pieces of property adjoining, spoke in favor of the zone change. No one appeared to speak against the zone change. Councilman Tyrell moved the Hearing be closed, Councilman Buchan seconded, roll call vote as follows: AYES: Councilmen- Buchan, Fitzjohn, Merritt, Tyrell, Dickason NOES: Councilmen -None ABSENT: Councilmen -None City Attorney Shatford stated the Council can instruct him to draw an ordinance and withhold second reading until such time as all requirements were put in and completed, or they could post a bond with a time limit for completion of requirements, which were curbs, gutters and sidewalks on Welland Ave, in ac- cordance with standards of the City of Temple City. As Double Drive needs to be widened it might create a problem to require these installed there at this time. The City already has the deed for the widening of the road. Councilman Tyrell moved that the City Attorney prepare an ordinance to change the zone as requested by the applicant, Councilman Merritt seconded, roll call vote as follows: AYES: Councilmen- Buchan, Fitzjohn, Merritt, Tyrell, Dickason NOES: Councilmen -None ABSENT: Councilmen -None 11. RESOLUTION NO. 62 -185. Calling and giving Notice of the holding of a general municipal election. Councilman Tyrell moved to adopt Resolution No. 62 -185 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF TEMPLE CITY, CALIFORNIA, CALLING AND GIVING NOTICE OF THE HOLDING OF A GENERAL MUNICIPAL ELECTION TO BE HELD IN SAID CITY ON TUESDAY, THE 10th OF APRIL, 1962, FOR THE ELECTION OF CERTAIN OFFICERS OF SAID CITY AS REQUIRED BY THE PROVISIONS OF THE LA`'!S OF THE STATE OF CALIFORNIA RELATING TO GENERAL LAW CITIES. Councilman Fitzjohn seconded, roll call as follows: AYES: Councilmen- Buchan, Fitzjohh, Merritt, Tyrell, Dickason NOES: Councilmen -None ABSENT: Councilmen -None 12. RESOLUTION NO. 62 -184; Warrants & Demands in the sum of 16,289.45 Nos. 1077 through 1106. Councilman Fitzjohn moved that the City Attorney be allowed $50.00 meeting expense money for the League of Calif. Cities meeting Febr. 1 and 2, and also trans- portation, Councilman Tyrell seconded and moved to adopt the amended Resolution No. 62.184, Councilman Fitzjohn seconded and carried by the following roll call vote: AYES: Councilmen- Buchan, Fitziohn, Merritt, Tyrell, Dickason NOES: Councilmen -None ABSENT: Councilmen -None 234 Council Minutes, January 22, 1962, page 3 13. COMMUNICATIONS: City Manager Woollett read a letter from the L. A. County Boun- dary Commission re an annexation in the City of Industry, Coun- cilman Merritt moved to receive and file, Councilman Tyrell seconded and carried. City Manager Woollett read a letter requesting a proclamation for Brotherhood Week from Febr. 18 to 25th. Councilman Tyrell moved to table, Councilman Merritt seconded, and carried. City Manager Woollett read a letter from the Crippled Childrens Society of Los Angeles County, requesting a charitable solicita- tion permit for use from March 22 through Easter week April 22, Councilman Fitzjohn moved to grant, Councilman Tyrell seconded, and carried. City Manager Woollett read a letter from the Young People's Group of the Temple City Church of Christ, requesting permission for a car wash on January 27 at the Church of Christ at 5272 N. Sereno Drive. Councilman Tyrell moved to grant, Councilman Fitzjohn seconded, and carried. City Manager qoollett read a letter from Haydn Burns, 9071 Las Tunas, requesting permission to continue use of a bicycle rack in front of his store. The City Manager recommended that he be authorized to place the rack next to the front wall of his building where it is not an obstruction. Inasmuch as Mr. Burns is in the bicycle sales and repair business'and after discussion Councilman Merritt moved permission be granted in this instance, Councilman Fitzjohn seconded and carried. 14. TIME RESERVED FOR AUDIENCE PARTICIPATION: No one came forward to speak at this time. 15. MATTERS FROM CITY OFFICIALS: Councilman Buchan asked for clarification regarding the trip to Sacramento and City Manager Woollett advised the League of Calif. Cities is called upon to make representation before the Legislature many times, and this meeting was to provide city officials information concerning various plans used in other parts of the country and to discuss and review legislation with respect to metropolitan governments. The meeting will provide a great deal of information as this is a fact - finding meeting. City Manager Woollett also gave a short report on the curb and gutter program. Councilman Tyrell made a motion the Council Meeting called for Tuesday, Jan. 23, 1962, be cancelled, Councilman Buchan seconded Roll call vote as follows: AYES: Councilmen- Buchan, Fitzjohn, Merritt, Tyrell, Dickason NOES: Councilmen -None ABSENT: Councilmen -None 16. ADJOURNMENT: Councilman Fitzjohn moved to adjourn, Councilman Tyrell second- ed and carried. Council adjourned at 8:35 P.
