AN ORDINANCE OF THE VILLAGE OF KEY BISCAYNE,
FLORIDA, AMENDING SECTION 30-t92 66REQUIRED
srGNS" OF THE VTLLAGE CODE OF ORDTNANCES'
RELATING TO ADDRESS NUMERALS ON WATERFRONT
PROPERTIES; PROVIDING FOR SEVERABILITY;
PROVIDING FOR CONFLICTS; PROVIDING FOR
CODIFICATION; AND PROVIDING FOR AN EFFECTIVE
DATE.
WHEREAS, the Village of Key Biscayne (the "Village") has adopted Zoning and Land
Development Regulations in order to promote the health, safety, order, convenience, comfort, and
general welfare of the public, and to promote and preserve the character and ecological quality of
the Village as articulated in the Village's Comprehensive Plan; and
WHEREAS, in order to assist the Village's public safety officials, the Village Council
desires to require single family home waterfront properties to have address numerals on the
waterside of the property; and
WHEREAS' the Village Council, sitting in its capacity as the Local Planning Agency, has
reviewed this Ordinance and recommends approval; and
WHEREAS, the Village Council finds that the changes within this Ordinance meet the
applicable review criteria set forth in Section 30-71(b) of the Code; and
WHEREAS, the Village Council finds that the adoption of this Ordinance is in the best
interest of the residents of the Village.
NOW, THEREFOREO BE IT ORDAINED BY THE VILLAGE COUNCIL OF THE
VILLAGE OF KEY BISCAYNE, FLORIDA, AS FOLLOWS:1
Section 1. Recitals. That the above-stated recitals are true and correct and are
incorporated herein by this reference.
Section 2. Section 30-192 of the Villaee Code Amended. That Section30-192 of the
Code of Key Biscayne, Florida, is hereby amended to read as follows:

Sec. 30-192. - Required Siens.
The following Signs shall be placed where relevant by a property owner:

(1) House numbers
a. Residential Building with four Dwelling Units or less - address numerals at
least four inches high, but not greater than ten inches.
b. Residential Building with more than four Dwelling Units and nonresidential
Buildings - address numerals at least ten inches high.
c. On Single-Family Dwelling waterfrontproperties" address numerals as provided
in subsection (a) above shall be at least four inches. but not greater than ten
inches high. located on the waterside of the propertlz, and shall be clearly visible
from the water.

Section 3.Severabilitv. That the provisions of this Ordinance are declared to be
severable and ifany section, sentence, clause or phrase ofthis Ordinance shall for any reason be
held to be invalid or unconstitutional, such decision shall not affect the validity of the remaining
sections, sentences, clauses, and phrases of this Ordinance but they shall remain in effect, it being
the legislative intent that this Ordinance shall stand notwithstanding the invalidity of any part.
Section 4. Conflicts. That all ordinances or parts of ordinances, resolutions or parts of
resolutions, in conflict herewith, are repealed to the extent of such conflict.
Section 5. Inclusion in Code. It is the intent of the Village Council that the provisions
of this Ordinance shall become and be made apart of the Village's Code of Ordinances, and that
the sections of this Ordinance may be renumbered or relettered, and the word "ordinance" may be
changed to "section," "articIe," "regulation," or such other appropriate word or phrase in order to
accomplish such intentions.
Section 6. Effective Date. That this Ordinance shall become effective immediately
upon final adoption on second reading.
