Savannah Beach, Georgia
January 12, 1977
The Regular Meeting of the Savannah Beach City Council
was held at 3:30 p.m. at City Hall with Mayor Michael J.
Counihan presiding. The following Councilmen were present:
Ed Fahey, Karen Losey, Nick Alexander and William Fleetwood.
City Attorney Lance Smith was also present.
The owner of "The Tank" property located at Second
Street and Butler Avenue, Mr. Charles Masters, appeared re-
questing permission to remove one of the two water meters
located on the property. He explained that the buildings
were not occupied and he would rather pay for only one meter.
Following a brief discussion between the Water /Sewer
Committee and the City Attorney, Mayor Counihan ordered one
meter removed and instructed Mr. Masters to contact the
Water /Sewer Department for any adjustments on the bill.
Mr. Jack Knauz, contractor, appeared before Council
on behalf of his client, Mr. Murray Bono on Eighth Terrace,
asking permission to remove the sand that is blocking his
rear exit. The City Attorney instructed him to get some
photographs of the situation to be sent to the Department of
Natural Resources who will then issue the permission he needs.
Mrs. Annie Mae Bird of Live Oak Avenue told Council
she had been charged $450.00 for a sewer stubbing but the
Code of Ordinances only requires $300.00. She was requesting
a refund. Her request was turned over to the City Attorney.

Mrs. Faye Lucas was given permission to place a small
sign over the entrance of her Beauty Salon.
The meeting was opened for the transaction of business
legally presented.
The minutes of the meeting of October 27, 1976 were un-
animously approved as written.
COMMUNICATIONS: Under Communications the Clerk read a
letter from Senator Charles Wessels in which he requested the
Georgia Department of Transportation to stop maintenance on
Wilmington River Bridge during peak traffic hours. The letter
was received as information.
The bills for the month of December were approved and
copies of same are attached to and form a part of these minutes.
Councilman Alexander described to Council the location of
Nineteenth Street. then he moved to have Council approve its
opening. He explained it would provide additional access to
the beach as well as additional parking. The motion was
seconded by Councilman Fahey :. The City Attorney assured the
Council that the City held title to the street. The motion
was then unanimously carried.
Councilman Fahey requested Council's approval to conduct
a feasibility study, including costs and plans, on the re-
modeling of City Hall to add additional office space for the
General Government and the Police Department. He made a motion
to this effect which was seconded by Councilman Fleetwood and

unanimously carried.
At this time Councilman Fahey explained to Council that
a committee had been appointed to draw up a list of proposed
changes in the City of Savannah Beach Charter. The Council
discussed the proposed revisions and agreed on the following:
1. Shortening the length of time between the
Election Day and the day of taking office.
2. Increasing the maximum Police Court fine

The second Reading of an Ordinance setting the millage
rate at 21 mills was read by the Clerk. The Ordinance read
as follows:
ORDINANCE
Following the reading a motion for its approval was made
by Councilman Fleetwood, seconded by Councilwoman Losey and
unanimously carried.
A report read by Councilman Fahey on the number of calls
received and answered by the Savannah Beach Police Department
was accepted as information.
Mayor Counihan instructed Councilman Alexander to study
his proposal for an ambulance for the City further and report
back to Council at a later date.
Councilman Fleetwood presented the Mayor and Council
with a letter of January 11, 1977 from Mr. F. V. George of
Thomas & Hutton Engineering Company in regards to an update to

the original Sewer User Charge Study. In the update Thomas &
Hutton recommend a rate of $9.00 per month for 3,600 gallons
minimum for City and County residents. Members of Council felt
this was still too high. Councilman Fahey then suggested that
the matter be presented to the residents of Savannah Beach in
the form of a Public Hearing. This was agreed by all with a
date to be set at the next Regular Meeting.
Earlier in the meeting Councilman Fleetwood had stated to
Council that there were presently $17,000.00 in Water and Sewer
checks being held for lack of funds. Due to this, Councilman
Fahey moved that the General Fund make a temporary loan to the
Water /Sewer Fund in order to release these checks. The motion
was seconded by Councilwoman Losey.
City Attorney Smith suggested that Council begin charging
the City buildings for water used, thus paying the Water &
Sewer Fund from the General Fund. There being no discussion on
this, the Council approved the original motion.
There being no further business the Regular Meeting was
adjourned to the Auditorium for a continuation from December 15,
1976 Public Hearing on a re- zoning request by Mr. David Thomas.
Mr. Thomas is requesting permission for the re- zoning of
his property described as Lots 109 -132, Fort Ward.
Mr. Carl Collins represented Mr. Thomas in his absence.
He briefly gave an update on the hearing of December 15th, 1976.
Following the update, there was much discussion from both

sides on the request. Mr. Ernest Carpenter stated he had no
objections while Mr. Richard Grosse expressed concern over
the possibility of spot- zoning. Mr. Jim Shealey added that
the re- zoning would be a step toward commercializing the R1
Fort Screven area. Mr. Dennis Hutton and Mr. John Hutton
agreed. Mr. Dennis Hutton stated there were many lots avail-
able in other places that could be used, preventing this
re- zoning.
A letter in favor of the re- zoning, from Mr. Nathaniel
Bronner of Atlanta, was read by the Clerk.
In answer to a question from Mrs. Marion Dean on the
Water and Sewer facilities, Councilman Fahey assured her that
the new sewerage treatment plant was capable of handling many
additional homes.
Dennis Hutton concluded for the opposition by saying they
did not want to see any of Fort Screven Ward re- zoned.
Carl Collins expressed to Council that this was a chance
to bring additional taxes into the City as well as provide lots
affordable by the common man.
City Attorney Lance Smith stated that Council could not
make a final decision until they received some type of sub -divi-
sion regulations from the Planning Commission to go by. At that
time the Council will submit in writing their findings. This
would not require another hearing.

There being no further business, the hearing was
adjourned; and the Council adjourned to the next Regular
or special called meeting.

ORDINANCE
TO PROVIDE THE DATE FOR THE 1977 SAVANNAH
BEACH, TYBEE ISLAND, GEORGIA AD VALOREM TAXES
TO BECOME DUE AND PAYABLE AND TO FURTHER
PROVIDE WHEN THE SAME SHALL BECOME DELIN-
QUENT AND SUBJECT TO PENALTIES AND INTER-
EST; TO PROVIDE, REQUIRE AND SET THE PAY-
MENT OF SAID TAXES IN TWO INSTALLMENTS,
THE FIRST INSTALLMENT TO BE DUE AND PAY-
ABLE ON MAY 1, 1977. AND THE SECOND INSTALL-
MENT TO BE DUE AND PAYABLE ON NOVEMBER 1,
1977; AND TO PROVIDE THE TERMS UPON WHICH
SAID INSTALLMENT SHALL BE DUE AND PAYABLE;
TO PROVIDE A SEVERABILITY CLAUSE; TO PRO-
VIDE AN EFFECTIVE DATE; TO REPEAL CONFLICTING
ORDINANCES AND FOR OTHER PURPOSES:
BE IT ORDAINED by the Mayor and Councilmen of the
City of Savannah Beach, Tybee Island, Georgia, in Council
duly assembled, and it is hereby ordained by the authority
thereof this 15th day of December, 1976, as follows:
SECTION I. By striking section one of the existing ordinance
providing for taxation of real and personal property in
Savannah Beach, Tybee Island, Georgia and inserting in
lieu thereof the following:
"Section 1. Dates When Taxes Are Due.
The 1977 Savannah Beach, Tybee
Island, Georgia Ad Valorem Taxes shall be due
and payable in two installments. The first
installment shall be due and payable on May 1,
1977, and the second installment shall be due
and payable on November 1, 1977."
SECTION II. By striking section two of the existing ordin-
ance providing for taxation of real and personal property
in Savannah Beach, Tybee Island, Georgia and inserting in
lieu thereof the following:

"Section II. Tax Digest and Rendition of
Statements of Taxes Due.
The first installment of taxes for
the year 1977 shall be paid on statements pre-
pared and rendered on the basis of one -half of
the total tax billed on said property in 1976
by the tax -payer of said property for the calen-
dar year 1976; with the updating of ownership
and other necessary corrective changes in order to
issue said tax bills."
The second installment shall be
due and payable on November 1, 1977 and the tax
statement for this payment shall be made on
the basis of the 1976 tax digest approved by
the State Revenue Commissioner with the billing
taking into consideration the adjustments, cre-
dits, and changes made necessary by the final
assessment as approved on the 1976 tax digest
giving due and proper credit for the payment
made on May 1, 1977.
The rate of taxation upon real es-
tate and business personal property within the
limits of said town of Savannah Beach, Tybee
Island, Georgia shall be two and one tenth
per cent (2.1% ) upon the assessed or returned
value of same, bearing forty per cent (40 %) of true
market value, of real estate improvements to
be ascertained from the returns of the com-
mittee on assessments of said Mayor and Council-
men, and the valuation of business personal
property to be ascertained from the returns of the
owners thereof in pursuance of the applicable
laws and ordinances providing for the assess-
ment and valuing of taxable property in the
town of Savannah Beach, Tybee Island, Georgia
and to carry into effect the provisions of
the act of the General Assembly of the State
of Georgia approved August 19, 1972, Section
21, as amended."

SECTION III. By striking section three of the existing or-
dinance providing for taxation of real and personal property
in Savannah Beach, Tybee Island, Georgia and inserting in
lieu thereof the following:
"Section 3. Transfer of Owner ship by Deed -
Notice to Chief Tax Assessor
Each purchaser of property located
in Savannah Beach, Tybee Island, Georgia shall
give notice to the Chief Tax Assessor of Chatham
County, Georgia, that ownership of real property
or personal business property has been changed.
Said notice shall be given upon a form duly ap-
proved by the Chief Tax Assessor of Chatham County
and the notice shall be filed in the office of the
Chief Tax Assessor."
SECTION IV. By striking section four of the existing ordi-
nance providing for taxation of real and personal property in
Savannah Beach, Tybee Island, Georgia, and inserting in lieu
thereof the following:
"Section 4. Penalties and Interest.
Taxes which are not paid on the re-
gular due date of each installment for the cal-
endar year 1977 shall bear penalties and
interest as are authorized under the general laws
of the State of Georgia. The interest rate
on all delinquent payments shall be nine
percent (9%) per annum."
SECTION V. Purpose and Intent of Ordinance:
The purpose of this ordinance is to require the
payment of taxes in the calendar year 1977 in two regular
installments, as hereinabove set forth. The earlier receipt
of tax monies will save Savannah Beach, Tybee Island, Georgia
interest on borrowed funds.

SECTION VI. Executions:
Executions will be issued as provided by the
general law of the State of Georgia on all properties for
which the 1977 taxes are not paid at the installment due
date, that is May 1, 1977 and November 1, 1977.
SECTION VII. Severability:
The provisions of this ordinance are severable.
If any section of this ordinance is declared and unconstitu-
tional, illegal or void, it shall not affect or impair any of
the remaining sections of this ordinance.
SECTION VIII.
All ordinances or parts of ordinances in conflict
with this ordinance are hereby repealed.
ADOPTED in open Council Meeting this , day of
1971.

Dear Mr. Moreland:
The people of the 2nd Senatorial District
have a human problem which is probably unique in
Georgia. It seems as though each year when the
tourists begin to go to Savannah Beach and when
commuter traffic is already heavy coming to and
fro from Wilmington Island and Whitmarsh Island,
the Department always schedules bridge maintenance.
Would it be possible in scheduling main-
tenance on the bridges, over the Wilmington River
particularly, to have this periodic work done before
June 1st and after Labor Dar. - In addition, if
work could be performed outside of the peak traffic
times which are generally between 8:00 a.m. and
9:00 a.m. and 4:30 p.m. and 5:30.p.m., it would
be most helpful.
This is a little matter, but one which
would certainly mean a lot to our residents here
in Chatham County.
I look forward to working with you as a
member of the Senate Transportation Committee and
hope that we will have a very productive and good
year.
