RESOLUTION DENYING APPLICATION OF ABBOTT & NEWMAN TO
ei4J�{L RE-ZONE TRACT 2-C,A.S.TRIMBLE SURVEY TO INDUSTRIAL "J"
o WHEREAS, the firm of Abbott and Newman has heretofore made application to
the Planning and Zoning Board to change the zoning classification on the prop-
s erty known and shown on the Official Map of the Town of Richland Hills as
W Tract 2-C, A.S. Trimble Survey, said property being located in the Town of
op
Richland Hills; and
0. WHEREAS, the Planning and Zoning Board has heretofore made their recommend-
ations to the Board of Aldermen and Whereas, the Board of Aldermen has heretofore
held a public hearing after due notice as required by the ordinances of the Town
of Richland Hills and the laws of the State of Texas; and
0 WHEREAS, the firm of Abbott and Newman, by and through their duly authorized
Q representative did present evidence and argument to the Board of Aldermen of the
m Town of Richland Hills; and whereas, the Board of Aldermen also heard evidence
and argument from various other parties in opposition to the granting of the
requested change from Residential Classification zoning to Light Industrial
Classification; and
WHEREAS, the evidence as presented shows that the said tract of land is now
occupied by the firm of Abbott and Newman and the said area is being used by the
said firm for the purpose of processing gravel and the mixing of sand, gravel
and cement and other related uses; and whereas, the said firm also was operating
the said business on the said property prior to the passage of the original zon-
ing ordinance of the Town of Richland Hills, Texas; and
WHEREAS, it appears that• the entire tract of land is being used by the said
firm for their present operation and whereas if the zoning change was granted
there would be no property available for other uses other than the present use;
and whereas, it appears that the State of Texas and/or the United States are
planning and have proposed to construct a super highway or freeway along the
north side of the railroad tract which is the south boundary of the above de-
scribed property and whereas, it appears that the said governmental agencies
will in the near future purchase or take the above described property for high-
way use; and
WHEREAS, the property immediately to the north and adjacent to the above
�-• described property is now being used and occupied as Single Family homes and
Single Family residence dwellings; and whereas, it would not be to the nest
Z interest or promotion of the health, safety and general welfare of the re-
sidents of the Town of Richland Hills to zone the above described property for
1.1.1 Industrial use.

WNOW, THEREFORE, BE IT RESOLVED BY THE BOARD OF ALDERMEN OF THE TOWN OF
RICHLAND HILLS, TEXAS, THAT:
Section 1. The Application and request of the firm of Abbott & Newman to
re-zone Tract 2-C of the A. S. Trimble Survey as shown on the Official Map
of the Town of Richland Hills, Texas to Industrial Classification "J" be and
C) the same is hereby denied.
