HomeMy Public PortalAbout05-10-2004 Regular Session Closed SessionUnsealed by Board Action on September 12, 2005 Closed Session M'lllules May 10, 2004 Closed Session Page 1 of 1 M'mules Approved: June 14, 2004 CLOSED SESSION MINUTES HILLSBOROUGH TOWN BOARD May 10,2004 7:30 PM, Town Barn The Hillsborough Town Board held a Closed Session on May 10, 2004 in the Hillsborough Town Barn for the purpose of discussing potential litigation regarding the Colonial Inn. Present for the Closed Session were Mayor Joe Phelps, and Commissioners Brian Lowen, Frances Dancy, Michael Gering, Eric Hallman, and Evelyn Lloyd. Staff present were Town Manager Eric Peterson, Town Clerk Donna Armbrister, Planning Director Margaret Hauth, Assistant Town Manager/Public Works Director Demetric Potts, Fire Marshal/Code Enforcement Officer Todd Chavious, and Town Attorney Bob Hornik. Mayor Joe Phelps opened the Closed Session. Planning Director Margaret Hauth updated the Board reporting that Mr. Faulk had made an offer of $500,000 to purchase the Colonial Inn but his offer has been declined. All of the documentation has been forwarded to the News of Orange. Fire Marshal/Code Enforcement Officer Todd Chavious was able to conduct a fire inspection. The building is not connected to electricity at this time and is unoccupied. There has been some moisture damage to the ceilings and walls. All the fire extinguishers are expired and the batteries are dead or beeping in the smoke detectors. He passed the fire inspection with the condition that upon occupation, the smoke detectors and fire extinguishers would need to be updated. Town Attorney Bob Hornik reported that he has sent the letters to Frances Henry and his attorney Gordon Brown and that they were both present for the fire inspection done by Todd. As of today, the Civil Penalties are $4,500. He suggested that pursuing the Civil Penalties would show that the Town is serious. Upon a motion by Commissioner Hallman, seconded by Commissioner Gering, the Board moved to return to Open Session by a vote of 5-0. The motion was declared passed. � espectfully submitted, DonnaF.
