HomeMy Public PortalAboutRES 11/02RESOLUTION NO. 011 -2 A RESOLUTION OF THE TOWN COMMISSION OF THE TOWN OF GULF STREAM, PALM BEACH COUNTY, FLORIDA, DESIGNATING THE SUPERVISOR OF ELECTIONS AND ONE (1) PALM BEACH COUNTY COMMISSIONER AS THE CANVASSING BOARD OR, IN THE ALTERNATIVE, DESIGNATING THE SUPERVISOR OF ELECTIONS AND THE TOWN CLERK AS THE CANVASSING BOARD, TO BE IN ATTENDANCE FOR THE TESTING OF THE COMPUTER ELECTRONIC SYSTEMS TABULATING EQUIPMENT TO BE USED FOR THE GENERAL ELECTION SCHEDULED FOR MARCH 8, 2011 AND TO CANVASS RETURNS OF SUCH ELECTION INCLUDING THE ABSENTEE BALLOTS; ASSIGNING SUPERVISOR OF ELECTIONS TO HANDLE THE ABSENTEE BALLOTS; PROVIDING FOR REPEAL OF PRIOR RESOLUTIONS IN CONFLICT HEREWITH AND PROVIDING AN EFFECTIVE DATE WHEREAS, Section 101.5612 (1) of the Florida State Statutes provides for the testing of automatic tabulation equipment; and WHEREAS, Section 101.5612 (1) further provides that the canvassing board shall convene and certify to the accuracy of the test or designate one member to represent it at the testing; and WHEREAS, the Town Commission desires to designate a person or persons as a member or members of the canvassing board for the purpose of canvassing the returns and certifying the results of any election, including all absentee ballots, in the Town of Gulf Stream, Florida, and or to attend the testing of the automatic tabulating equipment; and WHEREAS, the Supervisor of Elections has proposed the utilization of a central canvassing board for all municipal elections occurring on March 8, 2011, made up of the Supervisor of Elections and one (1) County Commissioner; and WHEREAS, the proposed central canvassing board will be available, at the discretion of the Supervisor of Elections, if a sufficient number of municipalities agree to employ it so as to make the canvassing and post - election audits more efficient and cost - effective for the municipalities and the Supervisor of Elections; and WHEREAS, Chapter 101 of the Florida Statutes provides for the handling of absentee ballots. NOW THEREFORE, BE IT RESOLVED BY THE TOWN COMMISSION OF THE TOWN OF GULF STREAM, FLORIDA, that: Section 1. Pursuant to Section 101.5612 (1) and Section 101.68 of the Florida Statutes, Susan Bucher, Supervisor of Elections in and for Palm Beach County, or her successor or designee, and one (1) Palm Beach County Commissioner are hereby appointed to serve as the canvassing board of the Town of Gulf Stream for the General Election to be held on March 8, 2011, and to serve as the Town's representative for the testing of the automatic tabulating equipment at the Palm Beach County Supervisor of Elections Tabulation Center, at 7835 Central Industrial Drive, Riviera Beach, Florida; and for the Supervisor of Elections, or her successor or designee, and one (1) Palm Beach County Commissioner to further certify to the accuracy of the equipment on the evening of the General Election held March 8, 2011; and to canvass the election results, including all absentee ballots; and to conduct all and such other post - election functions, including testing and audits, as is required by law; provided, however, that should the Supervisor of Elections or the County Commission, in their sole discretion, determine that the Supervisor of Elections and a County Commissioner cannot or should not constitute the Town's canvassing board for the purposes set forth above, then, upon notice provided to the Town by the Supervisor of Elections of such termination, the Supervisor of Elections, or her successor or designee, and the Town Clerk are hereby appointed to serve as the canvassing board of the Town of Gulf Stream for the General Election to be held on March 8, 2011, and to serve as the Town's representatives for the testing of the automatic tabulating equipment at the address listed above and to further certify to the accuracy of the equipment on the evening of the General Election held March 8, 2011; and to canvass the election results, including all absentee ballots; and to participate in and conduct all and such other post - election functions, including testing and audits, as is required by law. Section 2. Pursuant to Chapter 101 of the Florida Statutes, Susan Bucher, Supervisor of Elections in and for Palm Beach County, or her successor or designee, is designated to distribute and certify absentee ballots for the municipal election. Section 3. All Resolutions or parts of Resolutions in conflict herewith including, but not limited, to Resolution No. 011 -1, are hereby repealed to the extent of such conflict. Section 4. This Resolution shall take effect immediately upon adoption.
