A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF LYNWOOD
TO APPROVE AN AGREEMENT WITH 316 CONSTRUCTION &
ENGINEERING, INC. FOR AN AMOUNT OF $145,150 TO INSTALL
THREE RAIN GARDENS PER DESIGN ON BULLIS ROAD; AND
AUTHORIZING THE CITY MANAGER TO APPROVE UP TO TEN
PERCENT OF THE CONTRACT PRICE FOR ADDITIONAL SERVICES
AS NEEDED
WHEREAS, The construction on the Bullis Road Street Improvement Project was
completed on June 22, 2020.; and
WHEREAS, staff conducted the final inspection on June 29, 2020 and found that
all work was completed in accordance with the project plans and specifications; and
WHEREAS, there is stormwater drainage problem along Bullis Road between Platt
Avenue and the Lynwood Unified School District main office driveway: and
WHEREAS, water ponding caused by the stormwater drainage problem creates
accelerated deterioration of the current street infrastructure and can lead to safety issues
if not addressed; and
WHEREAS, on November 28, 2022 pursuant to LMC Section 6-3.7(b)(2), staff
issued a Notification of a Job Walk for December 5, 2022 at the project location with a
Request for Quotes to receive bids for the design upgrades due on December 12, 2022;
and
WHEREAS, only one company arrived for the job walk, reviewed the design plans
with clarification questions asked, and submitted a quote for requested services.; and
WHEREAS, staff recommends that the City Council authorize the City Manager to
open and proceed with the award of the work to 316 Engineering & Construction, Inc. for
$145,150.00 for the installation of three (3) rain gardens to mitigate for stormwater
drainage problem along Bullis Road from Martin Luther King Junior Boulevard to Platt
Avenue.
WHEREAS, staff recommends that the City Council authorize the City Manager to
approve additional services for a not to exceed amount of 10% of the contract price.
NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF LYNWOOD DOES
HEREBY FIND, PROCLAIM, ORDER AND RESOLVE AS FOLLOWS:
Section 1. The City Council of the City of Lynwood hereby finds and declares
that the foregoing recitals are true and correct, and incorporates them herein as findings
and as a substantive part of this Resolution.

Section 2. That the City Council accepts proposal from 316 Engineering &
Construction, Inc. for $145,150.00 for the installation of three (3) rain gardens along Bullis
Road and authorizes the Mayor to execute an agreement in a form approved by the City
Attorney.
Section 3. That the project budget $659,878.
Section 4. That the City Council of the City of Lynwood authorizes the City
Manager under LMC 6-3.15(d) to exceed the specific dollar amounts or percentage
limitations under LMC 6-3.15(a) and authorizes the City Manager to approve consultant,
vendor agreements, modifications, change orders or agreement amendments related to
the Project up to the available Project Budget.
Section 5. That this Resolution shall take effect immediately upon its adoption.
Section 6. That the City Clerk shall certify to the adoption of this Resolution and
hereafter the same shall be in full force and effect.
