HomeMy Public PortalAbout2022.308 (12-20-22)RESOLUTION NO. 2022.308 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF LYNWOOD ACCEPTING THE FERNWOOD AVENUE PARK PROJECT CHANGE ORDER LIMIT INCREASE APPROVAL. WHEREAS, as part of the 5 -Year CIP plan, a budget of $3,671,259.00 including funding from the Water Fund, RMC Grant, General Fund, Lease Revenue Bond, Measure R Fund and Safe Clean Water Fund was approved by the City Council on February 1, 2022 for the Fernwood Avenue Park Project; and WHEREAS, the Project consists of the renovation of vacant land into public city park, including walking trail, pedestrian bridge, new landscaping, seating areas, public right away improvements and custom playground to decrease impermeable surfaces and runoff, and enhance opportunities for stormwater infiltration management. The Project will include educational component on water saving techniques as well as stormwater runoff reduction. Project also include off -site improvements.; and WHEREAS, California Landscape and Design, Inc. was awarded the contract for the project at a bid of $2,385,294.70 on February 1, 2022; and WHEREAS, due to various unforeseen circumstances throughout the project, the total amount of $192,956.01 or 8.1% of the original bid amount has been approved up to date for the change orders; and WHEREAS, the contractor requested approval for additional change order in amount of $164,616.20 for contaminant removal (arsenic) using soil abatement methods; and WHEREAS, the Fernwood Avenue Park Project will remain within budget and no additional funding is needed; and NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF LYNWOOD DOES HEREBY FIND, PROCLAIM, ORDER, AND RESOLVE AS FOLLOWS: Section 1. That the City Council of the City of Lynwood approves the increase of set change order limit to 20% of the original construction contract or $477,059.00 for the Fernwood Ave Park Project. Section 2. That the City Council of the City of Lynwood authorizes the City Manager under LMC 6-3.14(d) to exceed the specific dollar amounts or percentage limitations under LMC 6-3.14(a) and authorizes the City Manager to approve the change orders related to the Project up to the available Project Budget. Section 3. That the project budget remains at $3,671,259.00. Section 4. That this Resolution shall take effect immediately upon its adoption. 1 Section 5. The City Clerk shall certify to the adoption of this Resolution and hereafter the same shall be in full force and effect.
