HomeMy Public PortalAbout2022.313 (12-20-22)RESOLUTION NO. 2022.313 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF LYNWOOD AWARDING AN AGREEMENT TO ROBERT D. NIEHAUS, INC. TO PREPARE THE 2023 WATER AND SEWER RATES STUDY; AUTHORIZING THE MAYOR TO EXECUTE AN AGREEMENT IN AN AMOUNT NOT TO EXCEED $89,900; AND AUTHORIZING THE CITY MANAGER TO APPROVE UP TO TEN PERCENT OF THE CONTRACT PRICE FOR ADDITIONAL SERVICES AS NEEDED WHEREAS, the City collects revenues that are intended to be sufficient to cover the costs of operating the water and sewer systems; and WHEREAS, these revenues allow the City to protect public health; and safely and reliably treat and convey water and sewer; and WHEREAS, the City will need to undertake a comprehensive cost of water and sewer service study to meet substantive requirements of Proposition 218 (Prop 218); and WHEREAS, a comprehensive water and sewer rates study is a highly technical study to prepare requiring specialized skills and competency to gather, characterize, and synthesize water/sewer related information into a financial plan that will withstand Prop 218 challenges; and WHEREAS, on November 3, 2022, staff issued a Request for Proposals from qualified consulting firms to prepare a comprehensive water and sewer rate study and to develop a 5 -Year Rate structure that meets the Prop 218 requirements; and WHEREAS, on November 29, 2022, the City received proposals from seven firms: Bartle Wells Associates, Black & Veatch Management Consulting, LLC, HG&H Consultants, LLC, NewGen Strategies and Solutions, LLC, Raftelis Financial Consultants, Inc., Robert D. Niehaus, Inc. (RDN), and Willdan Financial Services; and WHEREAS, Robert D. Niehaus, Inc. (RDN) will ensure the necessary depth and breadth of expertise needed to prepare a comprehensive water and sewer rates study that meets the substantive requirements under Prop 218. NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF LYNWOOD DOES HEREBY FIND, PROCLAIM, ORDER AND RESOLVE AS FOLLOWS: Section 1. That the City Council approves to award an agreement to Robert D. Niehaus, Inc. (RDN) to prepare a water and sewer rates study for a not to exceed amount of $89,900 and authorizes the Mayor to execute an Agreement attached hereto as Exhibit A in a form approved by the City Attorney. 1 Section 2. That the City Council approves the following appropriation: APPROPRIATION Fund Dept Div Object Description Amount 6051 45 450 62015 Water Fund - Professional/Contractual Services $85,000.00 6401 45 460 62015 Sewer Fund - Professional/Contractual Services $27,000.00 Section 3. That the City Council authorizes the City Manager to approve additional services for a not to exceed amount of 5% of the contract price. Section 4. That the City Council authorizes the City Attorney to negotiate the final form of the Agreement. Section 5. That this Resolution shall take effect immediately upon its adoption. Section 6. That the City Clerk shall certify to the adoption of this Resolution. PASSED, APPROVED and ADOPTED this 20th day of December 2022.
