A RESOLUTION OF THE TOWN COMMISSION OF THE TOWN OF GULF
STREAM, PALM BEACH COUNTY, FLORIDA, DECLARING ZONING IN
PROGRESS RELATING TO RECENTLY ANNEXED LANDS WITHIN THE TOWN
OF GULF STREAM CONSISTING OF APPROXIMATELY 16.6 ACRES, ALSO
KNOWN AS THE "SOUTH POCKET ", SO AS TO ALLOW A STUDY TO BE
UNDERTAKEN IN REGARD TO COMPREHENSIVE PLAN POLICIES RELATING
TO SAID AREAS AND ZONING REGULATIONS RELATING THERETO;
REQUIRING THAT NO BUILDING PERMITS BE ISSUED BYTHE TOWN DURING
THE PERIOD THAT ZONING IS IN PROGRESS FOR ANY PROJECT WHICH MAY
BE IN CONTRAVENTION OF ANY PROPOSAL UNDER STUDY; PROVIDING AN
EFFECTIVE DATE.
WHEREAS, the Town staff and the Town Commission are studying various comprehensive
plan proposals and zoning proposals for recently annexed lands consisting of approximately 16.6
acres within the Town, also known as the "South Pocket"; and
WHEREAS, to avoid frustrating the intent of these proposed comprehensive plan
amendments and zoning proposals by allowing permits to be granted for construction which is
potentially in conflict with or in contravention of what is under study in said proposals, it is necessary
to declare zoning in progress during the period of the study.
NOW THEREFORE, BE IT RESOLVED BY THE TOWN COMMISSION OF THE TOWN OF
GULF STREAM, FLORIDA, as follows:
Section 1. The Town Commission hereby declares zoning in progress commencing
March 15, 2011 for all of that area of recently annexed lands consisting of approximately 16.6 acres,
also known as the "South Pocket", located within the Town of Gulf Stream.
Section 2. During the period of zoning in progress, the Town is directed not to grant
permits for construction for any project which may potentially be in conflict with the comprehensive
plan and zoning proposals under study.
Section 3. Zoning in progress shall remain in effect until the completion of the study of
the zoning items and the final action of the Town Commission by adoption of comprehensive plan
and zoning amendments relating thereto or until March 30, 2012, whichever occurs first.
Section 4. Waivers to zoning in progress may be granted by the Town Commission for
good cause shown based upon competent substantial evidence that a proposed development will
not be contrary to the purpose and intent of the comprehensive plan and zoning proposals under
study.
Section 5. This Resolution shall become effective March 15, 2011.
PASSED AND ADOPTED by the Town Commission of the Town of Gulf Stream this 11th
day of March, 2011.
