March 21, 1977
A special called meeting of the Savannah Beach City Council
was held this morning in the Council chambers at City Hall for
the purpose to review the study of the Shore Protection Line
and to approve or disapprove same.
The meeting was presided over by Mayor M. J. Counihan and
a quorum consisting of the following Councilmen was present:
Edward Jung, Bill Fleetwood, Fred DeBorde, Nick Alexander and
Jerome Bettencourt. City Attorney Lance Smith was also present.
Others attending the meeting were Mr. Bill Greer of Diversified
Developments, Mr. Barney Portman and Dr. George Oertel.
To outline the steps he plans to follow for the study,
Mayor Counihan called upon Dr. Oertel. At this time Dr. Oertel
explained the proposed contract,describing each phase of the
study in detail. He stressed there should be several meetings
between the City, County, State and himself where he could keep
everyone informed of the progress of the study.
Mr. Jim Tally of the Georgia Department of Natural Resources
and Mr. Walter Benton of the U.S. Corps of Engineers agreed
with the recommendations for the management of the Tybee shoreline
as presented by Dr. Oertel.
Mr. Tally continued by stating that following the meeting
of March 17th he had been in contact with the Office of Planning
and Budget. They informed him that they had received clearance
on the money from Coastal Zone. Management for the study and
they suggested that the money be funneled to the Department of
Natural Resources for disbursement to the City. Therefore the
D.N.R. would have to make the same type of agreement with the
City of Savannah Beach as they will make with the Office of
Planning and Budget. He added that the auditing and other
requirements would be left up to the City. A copy of the
agreement was given to the City Attorney for his preparation.
Mr. Barnard Portman, part owner of the Tybee Lights Con-
dominiums, stated that he agreed with the study proposed by
Dr. Oertel and added that he and his partners would agree to follow
any recommendations made by him.
Councilman Fleetwood asked what authority did the Mayor and
Council have if they could not grant a variance. He asked
if they always had to do as the State and County requested.
Councilman Alexander made a motion that we proceed with the
study as proposed by Dr. Oertel. The motion was seconded by
Councilman Bettencourt and carried with Councilman Fleetwood
abstaining. A copy of the agreement between Dr. Oertel and
the City of Savannah Beach is attached to and make up a part
of these minutes.
AGREEMENT WITH DR. OERTEL
At this time Council Bettencourt stated he wanted to
read the minutes of the meeting of November 3, 1976 on the
Tybee Lights Condominiums. He stated he felt the Mayor and
Council had been receiving undue criticism for their decision
to approve the variance for the condominiums. He continued
by saying that they made their decision based on intake from
the Savannah Beach Planning Commission and other sources. It
was not on their own. At this time he read the minutes of
November 3, 1976:

Mr. Tally of the D.N.R., Mr. Benton of the Corps and Mayor
Counihan again stated they were willing to look at Dr. Oertel's
study.
There being no further business, the meeting was adjourned
to the next regular or special called meeting.

Gentlemen:
As proposed in our meeting of 16 March 1977, here
are my recommendations for the management of the Tybee shoreline:
1. Revise and adopt a shore protection ordinance based .
on a study proposed herein.
2. Develop a plan for the landscape architecture of the
scenic easement along the dune zone.
Develop a plan for:
a. providing access across the dunes
b. controlling blowing sand
c. releiving rain water flooding problems

AGREEMENT
between
GEORGE OERTEL, CONSULTANT
and
CITY OF SAVANNAH BEACH
THIS �P.GREEMENT entered into as of this 1( day of
1977 by and between George Oertel, Consultant
(hereinafter called the "Consultant ") and City of Savannah
Beach ( hereinafter called the "City ").
WITNESSETH THAT:
WHEREAS, the City desires to engage the Contractor to
render certain technical or professional services hereafter
described in connection with the development and refinement
of a Shore Protection Ordinance for Savannah Beach, Georgia:
NOW, THEREFORE, the parties hereto do mutually agree
as follows:
I. SCOPE OF SERVICES TO BE PERFORMED BY THE CONSULTANT:
The CONSULTANT agrees to provide the following services:
Design Standards: Develop design standards for setbacks
based upon the historical and present environmental
conditions of the shore. (2 day)
Coordination Meetings: Coordinating meetings with DNR,
- City and Corps of Engineers. (2, 2 day meetings)
Initial Meeting: Discuss with City Council the application
of design standards to each section of beach. (2 day)
Reconnaissance: Field survey of entire Tybee shoreline
to determine local application of design standards (1 day)
Research for Design Standards: Design standards for
setbacks on different types of shorelines will be determined
by researching erosional rates, geomorphic units, wave
exposure and the integrity of engineering structures. (1 day)
Ordinance Rewrite: Rewrite ordinance to accomodate recent
nourishment and simplil`y the confusing sections of text
(1 day)
Zoning Map: Tra fer design standards to zoning map and
construct a shore protection line. (1 day)
Surveying: One day will be required to assist the City
survey team in interpreting transect measurements from zoning
maps, particularly with respect to actual ground positions..
(1 day)
Final= Meeting: A final meeting with the City- Council
will be set up to discuss the revised draft ordinance and
accompanying shore protection map. (2 day)
Assistance to Zoning Administrator: Two half day sessions
will be set aside to assist the zoning administrator
in interpreting the ordinance with respect to applications
for construction. (1 day)

II. TIME OF PERFORMANCES
The work to be accomplished under the terms of this
AGREEMENT will be completed by the CONSULTANT no later
than May 30, 1977•
III, END PRODUCT:
The CONSULTANT shall provide:
1. A revised shore protection ordinance recommended
for adoption.
2. A set of zoning maps with the suggested positions
for the shore protection line.
IV. FEE:
The CONSULTANT agrees to perform all services set forth
and described in this agreement for a cost not to
exceed $1,700.00.
