The Regular Monthly Meeting of the Savannah Beach City
Council was held this afternoon at "3:00 P.M. with Mayor M. J.
Counihan presiding and a quorum consisting of the following
councilmen present: W. C. Fleetwood, Fred deBorde, Ed Jung,
Jerome Bettencourt, Karen Losey and Nick Alexander. City Attorney,
Lance Smith, was also present.
Mr. Dexter Bates, Secretary of the Chamber of Commerce,
asked the Mayor and Council for financial help on printing new
brochures for the tourists. He stated it would run around $643.60
for the first 25,000 brochures. He was instructed by Council
to get all material together to present to them.
Mr. Ron Reed appeared before Council requesting a busi-
ness license to sell hot dogs and soft drinks from a push cart.
This request was denied by Council.
Mrs. Joan Guyer appeared once again requesting help with
the flooding of her apartments following a heavy rain. Councilman
Alexander gave her a copy of a letter he . had recently written to
Congressman Bo Ginn asking for help.

The minutes of one Special Council. Meeting of March 21,1977
were approved as written.
Councilman deBorde asked what was the legality under
the parliamentary procedure, if the Minutes are not kept up to
date. Mayor Counihan explained the problem in the City Hall
of being short of help and there not being a Clerk.
COMMUNICATIONS: Under Communications one Clerk read a
letter dated March 8, 1977 . from Mr. Bert Barrett, Chairman of
the Savannah Beach Planning Commission, requesting that one study
the possibility of rezoning a large part of the North End of the
island to RT Zoning. After much discussion, Councilman Fleetwood
moved that they study the recommendation further. The motion was
seconded by Councilman Jung and carried with a vote of five (5)
for and one (1) abstaining, that, one being Councilman Alexander.
The Clerk then read two letters from Colonel Walter of
the Corps of Engineers and Mr. Joe Tanner, Commissioner of the
Department of Natural Resources pertaining to the shore protection

line study performed by Dr. Oertel. Colonel Walter requested
that any decision on the Northend parking be delayed until he
has a chance to study Dr. Oertel's report. Mr. Tanner asked that
a meeting be set up as soon as possible to discuss the report
from Dr. Oertel as well as the Northend parking. The letters
were taken as information.
A letter from Mr. Barnard Portman of Smith and Portman,
Attorneys, was read by the Clerk in which he stated that he and
his partners were willing to allow their Building Permit for
the Tybee Lights condominiums be amended showing that they would
construct sand dunes under the direction of Dr. Oertel. After
much discussion Council decided that this was not necessary as
the building would be forty -one (41) feet from the Shores Pro-
tection Line.
Bills of the various departments for the month of March
were approved for payment. A list of these accounts with the
amounts due are attached to and form a part of the minutes of
this meeting.
A suit between the City of Savannah Beach and Mr. John .
deBorde for the damage to carpeting, etc. in his home was turned
over to City Attorney Lance Smith for further study.
Mr. Earl Anderson was appointed for a three -year term
to the Savannah Beach Planning Commission.
The following members were appointed to the newly formed
Board of Adjustments and Appeals:
Lee Meyer 2 year term
Scott Thompson 2 year term
Carl Collins 1 year term
Pete Meyers 1 year term
Edward Jung 3 year term
Councilman Fleetwood moved that the members appointed be approved.
The motion was seconded by Councilman Alexander and carried on a
vote of five - one with Councilman deBorde opposing. The Board
of Adjustments and Appeals will follow procedures according to
the Southern Standard Building Code, not the Savannah Beach Fire
Code.
A probe and test of Water Pump Number Two was approved
by Council to be performed by Heater Well Company of South Carolina
on May 14th. -
An Ordinance to provide for a business license fee
II entitled "Rifle Range, Shooting Gallery" was read by the Clerk as
follows:

ORDINANCE
Following the reading of the Ordinance a motion was made
by Councilman Bettencourt for approval as read. The motion was
seconded by Councilwoman Losey and unanimously carried on first
and second readings. The City Attorney explained that this ordi-
nance would not conflict with the Office of the State Fire Marshall.
Ordinances providing for a business license and setting
a fee for Private Investigator were read by the City Clerk. The
Ordinances read as follows:
ORDINANCES
Following their readings, Councilman Fleetwood moved for
their adoption as read. The motion was seconded by Councilman
Alexander and unanimously carried.
Councilman Fleetwood read the following proposed budget
for the Fiscal Year 1977 -1978. The Budget was broken down into
the heading of General Fund, Water and Sewer Fund, and Revenue
Sharing Fund.
PROPOSED BUDGET 1977 -1978
Following the reading of the Budget the Mayor asked for
a motion inserting the purchase of the fire engine discussed in
March which is to be paid out of Revenue Sharing. Councilman
Fleetwood moved for the approval of the purchase of the fire engine
from Mack, Inc. The Motion was seconded by Councilman deBorde
and carried on a vote of 5 - 0 with Councilman Alexander abstaining.
Councilman Alexander asked Councilman. Fleetwood whether
the proposed fishing pier for 15th Street can be funded from the
Hotel Motel tax which is °supposed to be used for tourism. Council-
man Fleetwood stated he saw no reason why it could not be. At this
time Councilman Alexander moved that the proposed pier be funded
from the Hotel /Motel tax upon approval of the plans by the Depart-
ment of Natural Resources. The motion was seconded by Councilman.
Jung and unanimously carried.
At this time the Clerk read three bids received on a new
dump truck to be purchased from the Revenue Sharing funds. The
bids were as follows:
Dearing Chevrolet $9,702.57
J.C. Lewis Ford 9,388.00
Dan Vaden Chevrolet 8,135.76

Councilman Jung recommended that the bid from Dan Vaden
Chevrolet be accepted. This was agreed to by all.
Councilman deBorde moved that the tentative budget read
by Councilman Fleetwood earlier be adopted as read. The motion
was seconded by Councilman Jung and unanimously carried.
Mayor Counihan asked the Clerk to read the bids received
from various auditors for the accounting SUCS for the year 1977-
1978. The bids were as follows:
1. Shuman, Meecham & Halligan $4,750.00
2. Spillane, Rhoads, Lebey, Cann & Sieg 7,800.00
3. Bart & Haupt 6,425.00
4. Layard, Layard, Curlie & Bennett 6,000.00
5. Karp & Aronson, P.C. 5,900.00
Following the reading of the bids a motion was made by
Councilman Fleetwood to accept the bid by Shuman, Meehan & Halligan
of $4,750.00. The motion was seconded by Councilman deBorde and
unanimously carried.
There being no further business, the meeting was adjourned
to the next regular or special called meeting.

Re: Tybee Island Beach Erosion Control Project

Dear Mayor Counihan:
We appreciate the invitation recently extended to the Corps of Engineers
to attend the City Council meeting of 1 April 1977 during which Dr. George
Oertel presented his most recent analysis of the dune protection zone.
Although this meeting was attended by . three members of my staff, I regret
that I was unable to be present due to a previous commitment.
Dr. Oertel has consented to brief me individually on this subject very.
shortly. I would like to review his plans and have an opportunity to
comment to you and the Department of Natural Resources after an analysis.
Therefore, it would be most appreciated if the City would suspend imple-
mentation of any parking and access plan for the north reach of the beach
until I have had an opportunity to comment upon the Oertel . study and its
effect upon the approved parking and access plan north of First Street.

In order to satisfy the requests of the Department of
Natural Resources and to clear up any questions which you
might have in regard to the building permit previously
issued to the above - captioned project, we would be happy
to allow you to amend our building permit on the following
terms and conditions:
Our landscape plan would be amended to show the
construction of sand dunes to be located and constructed
in the manner which has been recommended to us by Dr. George
Oertel.
We would appreciate the Council approving this change
in our permit, and a drawing showing details of the same
as approved by Doctor Oertel will be submitted by our planner,
and will become a part of the records and application for
our building permit.
We would interpret this amendment to be at the request
and with the permission of all parties concerned.

RESOLUTION
WHEREAS, the present code of ordinances of the City
of Savannah Beach, Tybee Island, Georgia, dealing with housing
has specifically adopted the Southern Standard Housing Code,
1973 edition, and
WHEREAS, Section 106.1 of the Southern Standard Housing
Code provides for the creation of the Housing Board of Adjustments
and Appeals and further provides that the governing body of the
City of Savannah Beach, Tybee Island, Georgia, shall appoint
the three members of the Housing Board of Adjustments and Appeals.
NOW THEREFORE, BE IT RESOLVED by the Mayor and Councilmen
of the City of Savannah Beach, Tybee Island, Georgia, in Council
duly assembled that the following residents of Savannah Beach
be appointed to the Housing Board of Adjustments and Appeals
for the terms noted:
Lee Meyer (2 years), Scott Thompson (2 years), Carl Collins (1 year),
Pete Meyers (1 year), Edward Jung (3 years).

CODE OF ORDINANCES, CITY OF SAVANNAH BEACH,
TYBEE ISLAND, GEORGIA, BE AMENDED BY ADDING
A SECTION TO BE NUMBERED 11 -11; PROVIDING
FOR THE LICENSING OF A RIFLE RANGE OR SHOOT-
ING GALLERY.
BE IT ORDAINED by the Mayor and Council of the
City of Savannah Beach, Tybee Island, Georgia, in regular
monthly council duly assembled, and it is hereby ordained
by authority of the same as follows: That the Code of
Ordinances of the City of Savannah Beach, Tybee Island,
Georgia, be amended by adding a section to be numbered 11 -11,
to read as follows:
Before a license will be issued by the City of
Savannah Beach, Tybee Island, Georgia, for a rifle range or
shooting gallery, the premises must be inspected and approv-
ed as a safe facility by the Chief of Police of the City of
Savannah Beach, Tybee Island, Georgia, and the recommenda-
tion of the Chief of Police of the City of Savannah Beach
will be submitted to the Mayor and Council of the City of
Savannah Beach, Tybee Island, Georgia, for their approval.
Before a license will be issued for a rifle range
or shooting gallery the following safety standards must be
complied with by the person or persons applying for such
business license.
1. Any rifle range or shooting gallery
must be in a building or room which has
walls that are completely panelled with
lead sheets.
2. The owners /operators of any rifle range
or shooting gallery must have on the
premises a safe with a combination lock
in working order, and must store all
ammunition in this safe and must keep
the safe locked.

3. A rifle range or shooting gallery cannot
use any weapon larger than a .22 caliber
rifle.
Before a license for a rifle range or shooting
gallery can be issued the City of Savannah Beach license
tax of $250.00 must be paid.
Before a license for a rifle range or shooting
gallery can be issued the Mayor and Council of the City of
Savannah Beach, Tybee Island, Georgia, may further consider,
in order to protect the health and welfair of the residents
of the City of Savannah Beach, the impact of such a business
on the traffic congestion and noise pollution factor.
This ordinance shall be in full force and effect
immediately upon its adoption. All ordinances or parts of
ordinances in conflict herewith be and the same are hereby
repealed.
