PRESENT: Mayor Dan Gubler, Council President Rob Geray, Council Member Michael Thompson, Council Member Peter Wadsworth, Council Member Kathy McNamara, City Attorney Andrew Rawlings, Public Works Director Zech Prouse (via teleconference) and City Clerk/Treasurer Keri West. ABSENT: None. VISITORS: Chris Williams, Butch Colson, Todd Hyde, Brenda Hyde, Allen Horton, Joel Brinkerhoff, Rebekah Brinkerhoff, Daren Long, Shane Harrigfeld and Aimee Harrigfeld. Mayor Gubler welcomed everyone and Council President Geray led the Pledge of Allegiance. A roll call was taken by Clerk West to open the meeting. CONSENT AGENDA: City Council Work Meeting and Regular Meeting Minutes of April 20, 2021 were reviewed. Council reviewed the finance reports for the period ending April 30, 2021 (58% of the fiscal year elapsed). The City had $1,487,210.34 in the bank and routine bills had been paid, "Exhibit A". Mayor Gubler entertained a motion. Council Member Thompson made a motion to approve the consent agenda as presented. Council President Geray seconded the motion. All in favor. Motion carried. ITEMS OF BUSINESS: Public Hearing, Application for Annexation — Shane & Aimee Harrigfeld, 4913 E. 49th N., Parcel #RP03N38E366603 containing 19.75 acres — Mayor Gubler opened up the Public Hearing for this Annexation Application and asked if anyone in the audience is in favor of or opposes the annexation. No response from the audience. Clerk West encouraged the applicant to introduce themselves and their request. Shane Harrigfeld of 4913 E. 49th North approached the podium and stated they have been approached by many people inquiring about purchasing their house or a portion of their land. He continued and stated they are limited on what they can do going forward in Bonneville County. Mr. Harrigfeld explained they have more options on how they split and use their property if they are annexed into the City of Iona. He continued and stated he does not have any plans to develop a subdivision or any type of development at this time. He stated the desire to possibly sell the house with a couple acres and continue farming the rest of the land. Mayor Gubler asked again if anyone in the audience had any questions. No response. Mayor Gubler closed the Public Hearing portion of this agenda item. Council President Geray stated on the application it does not specify a zone. Mayor Gubler stated he felt the Residential Agricultural (R-A) Zone was the most appropriate for the use of this land. Clerk West stated the applicant submitted the application quickly to meet the public hearing deadline and notified her afterward their desire to apply for the R-A Zone. Council President Geray asked if the Planning & Zoning Commission (P&Z) had any other concerns or questions. Clerk West stated their only IONA CITY COUNCIL REGULAR MEETING—MAY 19, 2021 concern was their interpretation of the Code stating Mr. Harrigfeld would be required to connect to the City water system. However, Clerk West discussed this with Attorney Rawlings and researched the Code to confirm he would not be required to hook up to the water system at this time. He would only be required to connect to the water system for any future development. Council President Geray asked if there were any other concerns with annexing the property and zoning it as R-A. Attorney Rawlings stated he did not find anything that would cause any concern. He continued and stated normally annexations are done along with a development agreement, which gives the City more leverage. However, this annexation does not require a development agreement and any future developments must adhere to the City Code. Attorney Rawlings also stated with this annexation, it does cause an enclave where City property is surrounding un-annexed property. He continued and advised the Council to be aware of the possibility of future Category B Annexations. Mayor Gubler stated he is not interested in pursuing any unnecessary annexations. Mayor Gubler entertained a motion. Council Member Wadsworth made a motion to approve the Annexation Application for Shane & Aimee Harrigfeld's property at 4913 E. 49th N. Parcel #RP03N38E366603, with the initial zoning of R-A. Council Member McNamara seconded the motion. A roll call vote was taken: Council President Geray: YES Council Member Wadsworth: YES Council Member McNamara:YES Council Member Thompson: YES Discussion of Dogs at Large, Allen Horton and Todd Hyde — Allen Horton approached the podium and stated they have been having a lot of problems with loose dogs attacking the chickens at their home. He continued and stated his neighbor, Brenda Hyde was attacked by a dog while she was on a walk. Mr. Horton continued and stated he talked to the Mayor about the dog attack and he told him he had not heard anything about it. He continued and expressed concern over the lack of communication between the Bonneville County Sheriff's Office (BCSO) and the City leaders. Mr. Horton stated the dog attack was on April 7, 2021 and he feels the Mayor should have been informed of something that serious happening in the City. Clerk West stated she was informed and advised Mrs. Hyde to contact the Animal Control Division of BCSO. Clerk West also stated she received the same information from Deputy Williams the same day after Mrs. Hyde called BCSO. Discussion continued pertaining to the coverage and reports the City receives from BCSO. Council President Geray reminded Mr. Horton the agenda item is "Dogs at Large" and the discussion needs to stay on topic. Mr. Horton continued to discuss law enforcement communication. Mayor Gubler stated he did receive a report regarding the incident involving the Hortons' chickens and can confirm the dog was caught and taken to the shelter. Mr. Horton also stated he was told by Mayor Gubler that they have the right to shoot a dog that is on their property. Mayor Gubler agreed. Deputy Williams stated it is allowed in Idaho State Code to protect your livestock and family when other animals trespass on your property. Mr. Horton continued expressing concern over the communication between the City and BCSO. Council President Geray reiterated the importance of staying on topic with the agenda item. He continued and stated if Mr. Horton would like to discuss law enforcement he needs to add that as an agenda item to a future meeting. Mr. Horton asked how often Animal Control is patrolling the City. Council Member Wadsworth stated Animal Control is done 2 IONA CITY COUNCIL REGULAR MEETING—MAY 19, 2021 through Bonneville County and they only have 2 deputies for the entire county. He continued and stated they do not patrol because they are too busy taking calls for the county as a whole. Council Member Wadsworth also stated the City Council understands there is a dog problem in Iona and they have taken steps to try to minimize the problem. He continued and explained the City Council rose the impound fees for dogs that are taken to the shelter to encourage residents to be more responsible for their dogs. Mr. Horton stated when his wife goes for walks she often sees loose dogs out. Council Member Thompson encouraged residents to call Animal Control when they see loose dogs also. Todd Hyde then approached the podium and stated his wife was hesitant to call BCSO when she was attacked by the dog because she did not want to upset her neighbors. He continued and stated she finally called BCSO three days later. Mayor Gubler stated he did get the report and was told Animal Control talked to Mrs. Hyde directly and she did not want to press charges. Clerk West stated it is important to call because it can potentially protect someone else from also being attacked. Discussion then continued regarding dogs barking and the nuisance law in the City. Mayor Gubler then stated he is always available on his City cell phone if a resident has a concern. He also stated he understands the relationship with BCSO is a work in progress. Solid Waste Hauler License Application, Western Waste — Joe Wrenfrow with Western Waste approached the podium and stated they are interested in coming to the City of Iona and providing solid waste hauler services. Mayor Gubler asked if they are aware the City only allows solid waste haulers to provide service on Tuesdays. Mr. Wrenfrow confirmed. Clerk West stated she will email Mr. Wrenfrow the Iona City Code chapter pertaining to Solid Waste Haulers so they can adhere to all requirements. Mr. Wrenfrow stated they currently work with 9 cities and their office is based out of Twin Falls. Council President Geray inquired about the type and condition of the vehicles that will be used in the City. Mr. Wrenfrow stated they have new trucks and will take care of any spill that may happen. Council President Geray made a motion to approve the Solid Waste Hauler License Application for Western Waste Services to provide residential solid waste services. Council Member Wadsworth seconded the motion. All in favor. Motion carried. Ordinance to Amend Iona City Code § 9-4-0.; pertaining to Penalties for Public Parking Violations (Ord. 257-05-21) — Mayor Gubler stated this item was discussed at last month's Council Meeting and required additional research by the City Attorney. Attorney Rawlings stated he did research parking penalties in surrounding cities and adjusted this chapter to coincide with other areas. He continued and stated there were adjustments made to the handicap parking penalties and the fee schedule for this chapter. Council President Geray asked Deputy Williams if this update addresses his initial concern with the chapter. Deputy Williams confirmed he has read it and agrees with the changes made. Mayor Gubler entertained a motion. Council Member Wadsworth made a motion to approve Ordinance No. 257-05-21, an Ordinance of the City of Iona, Idaho; amending section 9-4-23 of the Iona City Code; specifying penalties for violations of parking regulations; providing methodology; preserving prior ordinances in each instance; providing for severability; and establishing an effective date. Council Member Wadsworth also made a motion to dispense with 3 IONA CITY COUNCIL REGULAR MEETING—MAY 19, 2021 the rule of reading the proposed Ordinance in full and on three separate occasions. Council President Geray seconded the motion. All in favor. Motion carried. Ordinance to Amend Iona City Code §§ 6-5-4, 6-5-5 and 6-5-6; specifying procedures for Solid Waste Hauler Applications and Renewals (Ord. 262-05-21) —Attorney Rawlings stated this chapter needed to be updated to clarify the City Council approval requirement for all Solid Waste Hauler Applications. Clerk West then added this amendment updates the fee schedule to coincide with the Business License fee schedule. Mayor Gubler entertained a motion. Council Member Thompson made a motion to approve Ordinance No. 262-05-21, an Ordinance of the City of Iona, Idaho; amending sections 6-5-4, 6- 5-5, and 6-5-6 of the Iona City Code; specifying fees and procedures for Solid Waste Hauler License Applications and renewals; providing methodology; preserving prior ordinances in each instance; providing for severability; and establishing an effective date. STAFF REPORTS: Clerk West stated the Sunrise Acres Subdivision water line is complete and the final amount the City paid to upsize the water line from 8" to 16" was $56,274.93. The total billed amount was $76,047.13, and the developer reimbursed the City $19,772.20. Clerk West stated she has nothing else to report. Director Prouse stated the existing water tank was due for a cleaning and inspection this year. He continued and stated they came at the beginning of May with their diving equipment and found no structural damage. He stated they also found little to no sediment, which means the well and pump for that tank are in good shape. Director Prouse also reported he has contacted the contractor to fix the patch on Rushton Road and it is scheduled to be completed by early next week. Council Member Wadsworth stated nothing to report. Council President Geray stated the agenda needs to be followed for meetings. He continued and stated the City Council members could be personally liable for discussing items that were not properly noticed on the agendas. Council Member Thompson stated the Council discussed during the Work Meeting the prospect of fiber in the City. He continued and stated the City may be allocated monies from the American Rescue Plan and are entertaining various ideas on how to use it to benefit the community. Council Member McNamara stated the Iona Historical Museum is having an Open House this Saturday from 11:00am-1:00pm. She also stated the building for the museum has officially been paid off by private donors. Mayor Gubler stated the City is working on a revamp of the entire AN system in the Council Room that will include a projector. Clerk West stated she will touch base with the company 4 IONA CITY COUNCIL REGULAR MEETING—MAY 19, 2021 tomorrow to check progress and next steps. Mayor Gubler also stated he is having a problem with Bonneville County Road& Bridge regarding road paving requirements during projects. SUGGESTED AGENDA ITEMS: Council President Geray asked to add Franchise Fees to next month's meeting.
