Mayor Joe Phelps called the Closed Session to order. Town Manager Eric Peterson placed a conference call on the Board Room Telephone to Town Attorney Bob Hornik. Attorney Hornik gave the Board an update on the Colonial Inn litigation. He suggested the Board discuss this issue further at their March 14th meeting. Commissioner Hallman suggested the Town demand an inspection of the property with the results of the inspections and the dates for expected repairs be presented to the court. Planning Director Margaret Hauth stated that she could put together a list of persons who could do the inspection. Commissioner Dancy suggested increasing the "charitable contribution" to at least $8,000 and having part of that contribution go to the Town. The Board directed the Town Manager to determine how much expense the Town has incurred so far on this issue in legal fees. Upon a motion by Commissioner Dancy, seconded by Commissioner Lowen, the Board moved to return to Open Session by a vote of 4-0. The motion was declared passed. Respectfully submitted, DonnaF.
