ORDINANCE NO.~l)
AN ORDINANCE DEFINING "STREn MERCHANDISE VENDORS; PROVIDING~FOR
A LlCENCE THEREFORE; PROVIDING FOR LICENSE EXEMPTIONS; PROVIDING
FOR LICENSE FEES-EXCEPTIONS;"PROVIDING FOR REGULATIONS.
BE IT ORDINANED BY THE GOVERNING BODY OF THE CITY OF BEL AIRE, KANSAS:
Section 1.
DEFINITION
"Street merchandise vendor" means any person who travels by foot or by
any type conveyance from house to house, or place to place, selling or offering
for sale any merchandise in the city; provided, however, no personsslla11 be
considered a street merchandise vendor when orders are taken for merchandise
to be delivered to the ultimate consumer on a day subsequent to the date of
the sale. "Street merchandise vendor" includes partnerships, corporations,
associations, companies or organizations of any kind, or charitable organizations,
that have representative who go from house to house or place to place, selling
or offering for sale any merchandise in the city, .
Section 2. LICENSE REQUIRED
It is unlawful for any street merchandise vendor, as defined in Section 1, to
operate in the City without having first obtained a license from the license
co 11 ector.
Section 3. LICENSE EXCEPTIONS
Nothing in this section shall be construed to require'any license
for any person or business which operates within the limits of interstate
commerce or which might constitute an undue burden on interstate commerce
or for any charitable organization which has existed in the City for at least
six months prior to the date of application.
Section 4 LICENSE FEES-EXCEPTIONS
The following fees shall be required for license to issue, and shall
be paid to the license collector:

No fee shall be charged for a license to an honorably dischargedl'veteran
who has been a resident of Sedgwick County for six months immediately preceding
application for license, or for any street merchandise vendor who has been a
resident of the City for six months immediately preceding application for license,
or for any other street merchandise vendor who has a regularly established business office
which has been in the City of Bel Aire for at least six months prior to the
application.
Section 5. REGULATIONS
Individual street merchandise vendors licensed hereunder shall have their
licenses on their persons and all other street merchandise vendors licensed
hereunder who have representative shall require such representatives;to carry
identification cards stating the name of the company, the name of the representative
and the city street merchandise vendor license number. No street merchandise
vendor shall be allowed to make sales on the streets, alleys or sidewalks
in the congested districts, nor make sales within two blocks of any public
or parochial school. Sales may be conducted in residential districts, but
no street merchandise vendors shall make a stand on any street or alley, nor
shall any street ,merchandise vendor be allowed to cross the lawn or other
portions of the premises of others, except upon the duly constituted sidewalks
and walks leading directly to the front doors of any residence.
Section 6, EFFECTIVE DATE
This Ordinance shall take effect and shall be in force from and after
its pUblication in the official city newspaper.
Adopted and passed by the Council of the City of Bel Aire this/~day
of March, 1983.
