Present for the Board Meeting were Mayor Joe Phelps, and Commissioners Eric Ha11man, Frances Dancy, Michael Gering, Brian Lowen, and Evelyn Lloyd. Staff present were Town Manager Eric Peterson, Assistant Town Manager/Public Works Director Demetric Potts, Town Clerk Donna Armbrister, Planning Director Margaret Hauth, Police ChiefNathaniel Eubanks, and Town Attorney Bob Hornik. Mayor Joe Phelps called the Closed Session to order. 11.CLOSED SESSIONA.Closed Session as authorized by North Carolina General Statute Section 143-318.11(3)to meet with Town Attorney regarding pending Litigation Proceedings and Status Report Colonial Inn -Attorney Hornik reported that he wrote a letter to the Colonial Inn attorney Gordon Brown with the Town's conditions. He met with him at the site and 15 of the 18 items on the Planning Director's list had been addressed in some manner. At least a dozen other issues were observed that needed to be addressed. They had made a proposal that the Town accept the work that has been completed as mooting the Demolition by Neglect enforcement action. Hornik stated that he has prepared a 4 point proposed counter proposal and will be meeting again with Judge Allen on March 21 st• Copies of both proposals are hereby incorporated by reference and made a part of these official Minutes as an Attachment.B.Closed Session as authorized by North Carolina General Statute Section 143-318.11(6)to discuss a Personnel Matter (Police Chief Search Update)Upon a motion by Commissioner Lowen, seconded by Commissioner Lloyd, the Board moved to return to Open Session by a vote of 5-0.
