A RESOLUTION OF THE TOWN COMMISSION OF THE TOWN OF GULF
STREAM, FLORIDA, WHICH SUPERSEDES RESOLUTION 009 -4.
ESTABLISHING FEES FOR THE PROCESSING AND REVIEW OF
APPLICATIONS FOR BUILDING PERMITS, PROVIDING FOR THE RECOVERY
OF COSTS ASSOCIATED WITH THE PROCESSING OF SAID APPLICATIONS,
PROVIDING FOR A WAIVER OF SUCH FEES AND EXPENSES; PROVIDING
AN EFFECTIVE DATE; AND FOR OTHER PURPOSES.
WHEREAS, the Town of Gulf Stream Building and Building related
Codes require applications be submitted for various building permits
and provides for the processing, review and final disposition of such
applications; and
WHEREAS, the Town staff is required to expend time in performing
certain duties in processing and reviewing applications, monitoring
construction and conducting Town- related inspections associated with
new constructions; and
WHEREAS, the Town incurs additional direct materials and
professional review expense in processing applications and reviewing
for compliance with Zoning, Design Manual and other local requirements;
and
WHEREAS, Section 42 -27 of the Town of Gulf Stream Code of
Ordinances establishes that fees shall be charged for the Town review
of permit applications for compliance with zoning, design and other
Town regulations; and
NOW, THEREFORE, BE IT RESOLVED BY THE TOWN COMMISSION OF THE
TOWN OF GULF STREAM, FLORIDA THAT:
Section 1. Application Fees: The following fees are hereby
established for applications for building permit review as necessary to
partially off -set the cost of Town Staff time and related overhead
expenses:
A. New Homes, Additions, Renovations and Other Improvements
(Pools, Docks, Seawalls, Gazebos etc.)

Section 2. Recoverable Direct Expenses: In addition to the
application fees provided for in section 1, applicants shall reimburse
the Town for all direct expenses associated with processing the
application and inspecting the construction. These expenses shall
include, but not limited to: advertising, postage, copying /duplicating,
recording fees, mileage, signs /postings, and similar materials costs.
In addition, applicants shall reimburse the town for any and all
professional review fees incurred including, but not limited to:
attorneys, engineers, architects, landscape architects, planners,
environmentalists, surveyors, utility contractors, building
contractors, and other professionals may be called upon by the Town to
review and comment on an application. Use and selection of outside
professionals to review applications shall be at the discretion of the
Town.
Within sixty (60) days of final action on an application, the Town
shall submit an itemized bill to the applicant which shall include all
recoverable direct expenses incurred in processing the application
which bill shall be due in full within thirty (30) days of receipt,
provided however, that the Town shall not process or grant other
development permits or approvals involving the subject property until
the bill is paid in full.
Section 3. Waiver of Fees and Expenses: The Town Commission may
waive all or part of required fees and expenses upon a finding that
such a waiver is in the public interest of residents of Gulf Stream or
that the fees and expenses pose an undue hardship to the applicant.
Motions to approve such waivers shall require three (3) affirmative
votes for passage.
Section 4. Withdrawal of Application: If a permit application is
withdrawn after Town staff review of the permit has been conducted, and
before any work has commenced, the applicant may request in writing a
refund of 50% of fees paid.
Section 5. Effective Date: This resolution shall become effective
immediately upon passage.
