HILLSBOROUGH TOWN BOARD
January 10, 2005 7:30 PM, Town Barn The Hillsborough Town Board held a Closed Session on January 10, 2005 in the Hillsborough Town Barn. Present for the Closed Session were Mayor Joe Phelps, and Commissioners Eric Hallman, Michael Gering, Brian Lowen, Frances Dancy, and Evelyn Lloyd. Staff present were Town Manager Eric Peterson, Assistant Town Manager/Public Works Director Demetric Potts, Town Clerk Donna Armbrister, Planning Director Margaret Hauth, Town Engineer Kenny Keel, and Town Attorney Bob Hornik Mayor Joe Phelps called Closed Session to Order I 0:34:02 PM Added Closed Session Item A.l. Carolina General Statute Section 143-318.11(5) concerning property acquisition
A.Closed Session as authorized by North Carolina General Statute Section 143-
318.11(3) to meet with Town Attorney regarding Colonial Inn Litigation Proceedings
Status Report10:45:19 PM Town Attorney Bob Hornik summarized that it was a very unfruitful mediation. He reported that they agreed that 6-7 Items needed to be addressed immediately. He told Mr. Henry's attorney that there would need to be a deadline on having the work completed. They met again with a mediator on Jan 5, 2005. Mr. Henry would not agree to any civil penalties at all and wanted an apology. Motions for Summary Judgment are scheduled for February 14th•Mr. Henry's attorney presented a settlement document which is in the Board's packet tonight. Minutes Approved: February 14, 2005 Upon a motion by Commissioner Dancy, seconded by Commissioner Lowen, the Board moved to retwn to Open Session by a vote of 5-0. The motion was declared passed. 2
