Discussion and Possible Action Regarding: a) Community Trails Plan Resolution 2014-08-05 Approving the Community Trails Plan for the Town of Fraser TP Trotter briefed the Board on the conception of the Community Trails Plan and the community involvement with moving this plan forward. The document will evolve as the trails throughout the community evolve and change. This will include a ½ mile loop, and the cost to move a part of the trail that currently sits on the Safeway property over to the Town property. We have received the Army Corp of Engineers permit and a grant from $10,000 Grand County. Meeting adjourned at 9:32 p.m. Lu Berger, Town Clerk MEMO TO: Mayor Smith and the Board of Trustees FROM: Catherine Trotter, AICP, Town Planner DATE: August 29, 2014 SUBJECT: Cogswell easement vacation MATTER BEFORE BOARD: We are in receipt of an application for an easement vacation from Gary and Bonnie Cogswell, owners of Lot 56, East Mountain Filing 1 in Rendezvous. There is an existing access, utility and snow storage easement on their lot which also accommodates an emergency turn-around. The recorded easement is in the packet. See page 10 of 14 of the document (Reception # 2003- 000789) to view the exhibit of the legal description of the easement on Lot 56. The owners would like to vacate the existing easement and relocate the easement to the northeast corner of the lot, in order to accommodate a new single family dwelling. ACTION REQUESTED: The easement vacation review procedure is detailed in Section 17-3-50 of the Fraser Town Code at http://www.colocode.com/fraser/fraserpdf/fraser_17.pdf. The applicant is requesting that the Board approve this easement vacation request and allow them to relocate the easement on the northeast corner of Lot 56. BACKGROUND: Please review the application as submitted by the applicant. Town staff has referred a copy of the vacation petition/request and all accompanying documents to affected governmental agencies, special districts and private and public utility companies for review and comment. Email review comments are included in the packet. There is an existing 10 utility and snow storage easement per the East Mountain Filing 1 plat (Reception # 2001-002997) that is located adjacent to the ROW. This easement will remain. ALTERNATIVES: The Code states that the Board shall consider the vacation petition and review an ordinance vacating the easement at a public hearing and either approve, approve with conditions or deny the vacation petition within thirty days after the commencement of such a hearing. Wherever the term Grantor is used herein it shall mean Grantor and/or Grantor's successors and assigns. The burdens and benefits hereof shall run with the Easement Parcel and any person or entity that acquires any interest in the Easement Parcel as described herein shall be bound by the burdens and entitled to the benefits hereof. BACKGROUND: This property is zoned Planned Development District PD and we are processing a Final Planned Development Plan/Final Plan (FPDP) and a Major Subdivision Final Plat, Filings No. 1, 2, 3 and 4 concurrently. The Final Plan application is being processed in accordance with Section 16-5-410 of the Fraser Municipal Code. The Grand Park development is subject to the requirements contained in the 2003 Rendezvous Annexation Agreement and Planned Development District Plan (PDD), as amended by the 2005 Grand Park PDD Plan amendment. This proposal relates to Planning Area (PA) 2W, as shown on the Grand Park PDD Plan, Reception # 2005-012709, but only a portion of PA2W is covered by this proposal. The PDD land use and development notes indicate adjacent to the railroad and served by Old Victory Road. A series of ponds and wetland related landscape may be utilized to transition to The PDD development standards for PA 2W allow for a mixed-use land use, a 10% open space setback from Old Victory Road. Setbacks allowed in mixed-use planning areas are subject to FPDP and plat approval by the Town of Fraser. Grand Park Development LLC, the applicant, is proposing 70 lots to be platted and constructed in four phases. The Fraser Municipal Code Sec. 17-5-110 allows for a phased development review process. The SIA is required prior to the recordation of each final plat. The SIA required improvements and collateral associated with those improvements shall be subject to Town Engineer and Town Attorney approval prior to execution, and the schedule for completion of said improvements shall be within one (1) year of execution of the SIA. Variance Request: Grand Park, in a letter dated July 22, 2014, has requested a variance to the five-inch (5") minimum asphalt pavement thickness as required by Fraser's adopted Municipal Code Section 14-3-120 1 Pavement Design. Attached to Grand Park's request was a geotechnical report prepared by Ground Engineering. Grand Park has requested use of a pavement section consisting of three (3) inches of asphalt over seven (7) inches of Class 6 road base. Fraser's Pavement Design Requirements: Section 14-3-120 Pavement Design of the Fraser Municipal Code requires all new streets and roads to be paved. Specifically: Subsection 14-3-120(a)(2) states "Structural sections shall be designed for all new streets or existing streets being upgraded due to increased traffic. The applicant shall provide a pavement design report performed by a Geotechnical Engineer, licensed by the State, prior to approval of the final street design. The structural section shall include the asphalt and/or concrete street surface and the aggregate street sub-base. Aggregate sub-base shall be Class 6 road base material and/or Class 6 road base material in combination with other locally available CDOT aggregate classifications to meet the design requirements for the street per the Geotechnical Report pavement design." Subsection 14-3-120(a)(2) states "The final pavement design for all streets must meet all the procedures and requirements within the CDOT Pavement Manual. Minimum as-built thickness of asphalt shall be five (5) inches." Willows Subdivision Subsurface Exploration Program Findings: TM The DARWin computer model was used for the pavement design in the Ground Engineering report. Traffic loadings used for the Willows Subdivision are consistent with traffic counts previously used for other local neighborhoods in Rendezvous. Soils analysis was performed on four samples taken on-site to determine soil classifications from which the street pavement section design structural numbers were determined. The soil sampling and testing procedures are consistent with Fraser's standards. The pavement design procedure is consistent with Fraser's standards as well. Several factors should be considered in this evaluation including serviceability, cost and long term maintenance requirements. The pavement design program takes into account design factors for a 20-year pavement life based on subsurface soil classifications and the estimated traffic loading of the street. This "design life" is qualified in the Ground Engineering report as The standard care of practice in pavement design describes the flexible pavement section as a "20-year" design pavement period: however, most pavements will not remain in satisfactory condition without routine maintenance and rehabilitation procedures performed throughout the life of the pavement. Amended Findings from the Final Drainage Report Calculations: The final drainage report included calculations detailing stormwater management through the Willows subdivision. As detailed in the Final Drainage Report received on August 16, 2014, portions of the stormwater flows are proposed to be conveyed through the subdivision streets. As such a part of Mountain Willow Drive and all of Coyote Willow Court will carry storm flows at or above the top of the 6-inch curb and gutter. In areas where the flows exceed the top of the curb and gutter section, a permanent six inch berm section will be necessary. Review / Recommendation: Issues for the Town to consider in evaluating this variance request include: The computer program accounts for serviceability factors and reliability levels based on the soil samples taken; however, variability in the on-site soils under the asphalt / road base pavement section can adversely impact Town streets. This becomes more critical in locations, such as Fraser, where extreme weather and frost conditions prevail. Maintenance can be more difficult with thinner asphalt mats. If an overlay is required, milling 1½" to 2" from a street is more critical with a 3-inch asphalt mat than with a 5-inch mat. History has shown that asphalt paving is not a perfect science. As-built core plugs on previously paved streets have noted areas where new street asphalt is at a depth thicker than the design thickness and areas where the depth is thinner than the design thickness. The initial street traffic loading in any new subdivision will consist primarily of construction traffic hauling materials and equipment in and out. The anticipated design traffic loading in the report considers traffic loading over the entire 20 year design life period. The five (5) inch minimum depth of asphalt thickness has a proven track record for serviceability and durability in Fraser; dating back to the original street improvement program in 1998 and 1999. Aside from crack filling and a few isolated repair sections, maintenance has included only the recent chip seal coating. To maintain proper drainage through the Willows, and not impact adjacent properties, sections of Mountain Willow Drive and all of Coyote Willow Court cannot be candidates for any future asphalt overlay. An increase in the pavement height will decrease the stormwater capacity of the street. If the proposed 3-inch thick pavement fails, significant patching, or reconstruction, will be the repair option(s) available. Based on the above review and findings, it is my recommendation that Fraser require all streets within the Willows subdivision to include a minimum asphalt thickness of five (5) inches as required by Fraser's Municipal Code. 6013 E. DATE: August 25, 2014 SUBJECT: GP Willows Subdivision - Grand Park Request for Local Street Section Variance Variance Request: Grand Park, in submittal of the construction plans, has proposed a variance to the local street section to use a 6-inch vertical curb on each side of the street in lieu of the 2-foot valley pan as included in the Fraser's adopted Municipal Code for local streets. Fraser's Pavement Design Requirements: Attachment A-8 Cross-Section for Local Street in the Fraser Municipal Code requires all new streets and roads to be constructed with a 2-foot wide valley pan on each side. This provides for conveyance of the minor storm flows and provides a pavement section that minimize damage during winter snow plowing operations. Willows Subdivision Findings: The 6-inch curb and gutter, as proposed, provides for additional storm water conveyance capacity than can be provided by the valley pan. For this subdivision, the additional capacity is needed due to off-site flows passing through the subdivision and the general configuration of the subdivision. Review / Recommendation: Issues for the Town to consider in evaluating this variance request include: Use of the 6-inch curb and gutter increases the stormwater flow conveyance capacity of the street section to minimize the use of inlets and underground piping. Typically underground stormwater pipes have been problematic in the valley with snow/ice accumulations in the winter. Their use is discouraged unless necessary. Maintenance could be somewhat higher in cost as sections of the curb and gutter will require replacement due to breakage. It is anticipated this will be less cost overall than the use of inlets and underground pipes. Maintenance on the streets in this subdivision will be critical in that the entire street section, from top of curb to top of curb, is required in some areas to convey the 100-year storm water. Overlay of these streets will lessen the flow carrying capacity of the street system. With decrease in the street stormwater capacity in the street, storm flows of smaller magnitude would be prone to overtop the curbs and flow onto/across private property. Based on the above review and findings, it is my recommendation that Fraser accept this variance to the standards and allow for 6-inch curb and gutters on the Willows Subdivision streets, provided that street maintenance procedures maintain the flow capacity of the street. 6013 E. With addition of the storm sewer profiles, it has become apparent that the headwall height is sufficient to require handrails as a safety precaution for pedestrians in the area. Additionally a bar grate (trash rack) should be added to the inlet side of the 48-inch Cozens Ditch culvert to prevent someone being swept into the pipe by high flows. 5. Sheet 24. The street typical section doesn't meet the requirements of the Fraser Standards. The proposed section includes a 6-inch vertical curb and gutter in lieu of the 2-foot valley pan required by Fraser's Standards. The curb and gutter is proposed for its increased stormwater carrying capacity. A brief variance review memo is attached. 6. Construction details of the following swales weren't found in the plan set. Please add them to the plans or direct me to their location in the submittal. Swale typical section from triple 18-inch RCPs under Mountain Willow Dr to Pond #1. Swale typical section from Pond #1 to Pond #2. Swale typical section from Pond #2 to the confluence with the swale from Coyote Willow Ct. Swale typical section and plan, with contours, from the Coyote Willow Ct to the wetland mitigation / detention pond. Phase III Drainage Report: I concur with the proposed use of the wetland mitigation / detention pond, located north of the site to detain the stormwater flows from the Willows subdivision. There are a few details / clarification needed to fully detail the proposed system. The following comments outline those. 7. Clarify the last paragraph of Section I General Location and Description. It currently states that Basins OS2 and OS3 are directed to the no-name drainage and all other basins are directed to Cozens Ditch and then to the existing wetlands / mitigation ponds. Based on review of the Final Drainage Map and grading plans, it appears Basins G, H, M and approximately one-half of L do not drain to Cozens Ditch, but rather are directed into the meadow or to the no-name drainage undetained. Following clarification, modify the report text and calculations accordingly. 8. The fourth paragraph on page 6 of the Final Drainage Report suggests that a second wetland mitigation pond exists. Only the wetland mitigation / detention pond west of The Village has been reviewed and approved as stormwater detention for projects within the meadow. If a second wetland mitigation pond is being proposed, then detail of that pond shall be submitted for review. If it isn't, then the drainage report requires modification to over detain from the flows directed to the existing wetland mitigation / detention pond or the grading plan requires modification to direct additional flows to the existing wetland mitigation / detention pond. 9. The Allowable Capacity for One-Half of Street calculations in the report appendix utilize a street section with a 6-inch curb to carry the theoretical "minor storm" storm flow and a suggested allowable depth of 12-inches to carry the theoretical "major storm" storm flow. This theoretical maximum carrying capacity of the street is determined based on the design detail of the street. The calculated site storm flows are then compared to this theoretical street capacity. It was noted that at Design Points 1, 2 and 3B the calculated 100-year storm flow is contained within the six-inch curbed street section. At Design Points 3 and 4 the calculated 100-year storm flow exceeds the capacity of a six inch curbed street section. The flows do remain within the suggested theoretical 12-inch deep criteria set in the calculations; however, this implies that a six inch graded berm shall be constructed behind the back of curb along the entire length of Coyote Willow Ct. To my understanding the Town has no controls in place to ensure that this berm will be built and maintained in perpetuity. The south end of the street has a longitudinal slope of 0.64% which will lessen the street capacity and increase the potential occurrence of storm water spillage onto private lots. Please clarify. It appears that if stormwater flows along Mountain Willow Drive and Coyote Willow Ct could be lessened in magnitude by: Directing stormwater flows from Basins OS1A and OS1B to Design Point 3A, through Pond #1. Directing stormwater flows for the upper reach of Mountain Willow Drive into the same swale at Design Point 3A. 10. Add the hydraulic calculation and details to size the swale from Coyote Willow Ct to the wetland mitigation / detention pond. Stormwater Wetland Mitigation / Detention Pond Agreement: 11. However, there is no plat dedication or other document that I saw which provides for such dedication. As noted previously, the existing water line easement is not adequate for access. If the completion of other sections of OVR will be required in subsequent phases, that should be addressed in the FPDP or through some other documentation. 2. Phase III Drainage Report dated May 23, 2014 July 7, 2014: 31.The overall concept plan of the stormwater collection and detention system as presented in the drainage report remains unclear. Thirteen on-site sub-basins and four off-site basins are identified for this Willows development. The off-site basins represent areas upstream of the Willows development which historically flow through the Willows development. The thirteen on-site sub-basins collect storm water within the development, at various points, and direct it to the detention facilities (i.e.: ponds, wetlands, etc.).“NO OUTLET” SIGNS HAVE BEEN REVISED AND STREET SIGN CALL OUTS ADDED. It appears, from the basin description paragraphs included in the drainage report, that stormwater flow from all off-site and on-site sub-basins is being directed into either the proposed relocated Cozens Ditch or into Water Feature Pond #1 or #2, which are each an inline pond of the Cozens Ditch system. The drainage map included in the construction plan set and the drainage report depict Cozens Ditch connecting to the existing pond located in line with the "No Name" drainage way. This existing pond is located south of the Cozens Meadow development. The drainage report states the Willows development stormwater will be detained in the existing wetland mitigation / detention ponds (Cells A, B & C) located north of the Town Center development adjacent to the landscape berm paralleling the highway. There is no proposed infrastructure included in either the construction plans or this drainage report that would suggest the Willows development stormwater flows are directed to the existing wetland mitigation / detention ponds located north of Town Center. All submitted plan detail indicates the Willows stormwater flows to the existing pond located south of the Cozens Meadow development. THE PROPOSED COZENS DITCH HAS BEEN REVISED TO CONNECT WITH THE DESIGN POINT 4 August 14, 2014 Page - 9 - DRAINAGE SWALE AND CONNECT TO THE EXISTING SWALE THAT LEADS NORTHERLY INTO THE EXISTING WETLANDS MITIGATION / DETENTION PONDS CELL A. Clarification and detail is needed regarding the applicant's proposed stormwater collection and detention system. If it is proposed that the existing ponds located south of Cozens Meadow are proposed for the Willows stormwater detention, then additional information on that pond system is needed and the drainage report revised. Additionally, it appears that the proposed relocated Cozens Ditch is a key component of this proposed stormwater system. It was my understanding at our meeting on July 1, 2014, that this project is not planned for construction at this time. If Cozens Ditch is part of the stormwater collection system, its construction with the Willows improvements is required. It should be noted in: Section 17-7-630 Stormwater drainage and management facilities in Fraser's Code states that "The Town shall not approve any subdivision plat that does not make adequate provision for stormwater drainage and management... ...The Town shall require on- site detention of stormwater flows during peak periods. New development shall release water from the development at a rate equal to the historic rate prior to development. Stormwater drainage and management facilities must be constructed within the first phase of any development activity." It was also noted that the drainage report calculated stormwater capacities for street curbs using a six-inch high vertical curb. This is inconsistent with Fraser's typical street cross section which includes a two-inch deep valley pan. Correction of the street stormwater flow capacities is required. Rip-rap calculations for the pipe outlets were not found in the report or on the construction plans. Please add. THE STREET FLOW CAPACITIES WERE EVALUATED WITH A 6” CURB INSTEAD OF THE VALLEY PAN PER THE TYPICAL SECTION FOR THE ROADWAYS WITHIN THE PROJECT SITE AS SHOWN ON SHEET 24 WHICH UTILIZES 6” HIGH MOUNTABLE CURB AND GUTTER INSTEAD OF THE 2” DEEP VALLEY PAN. RIP- RAP WAS ADDED TO PLANS AS A PLACEHOLDERS – STILL NEED TO COMPLETE THE RIPRAP CALCULATIONS AND POSSIBLE DETAILS. A proposed operational agreement regarding management and operation of the detention facilities (pond/wetland) similar to the negotiated agreement for the Village at Grand Park is required. WHAT OPERATIONAL AGREEMENT IS THE TOWN REFERENCING? Until clarification is received, the stormwater plan, drainage report and construction plan details do not meet the minimum requirements of Fraser's Code/Standards. As required by Fraser Code the developed flows from any subdivision are to be detained and released at historical rates. The proposed drainage plan included in this submittal does not provide for this detention and slow release. The drainage report and construction plan set requires revision. Willows Wetland Exhibit dated March 26, 2014 : 32. The wetland delineation should be added to the Sheets 3 and 4 in the plan set to provide a location reference of the development to the wetland boundary. Not completed. The preliminary geotechnical considerations memo addresses general anticipated soil conditions within the proposed development. Only subsurface conditions for Test Holes 1, 2 and 3 in the 2007 Old Victory Road Geotechnical Report appear to be applicable to this development based on their vertical elevations along Old Victory Road compared to the vertical elevations of the Willows Subdivision. This document served as the preliminary geotechnical report for the preliminary submittal. Submittal of the Final Geotechnical Report is now required with this final construction plan submittal to provide detailed on-site underground soil profiles and pavement design data for the soils specific to the Willows development. I previously provided a Memorandum dated April 14, 2014, regarding the FPDP and Preliminary Plat application for this development. It is not clear whether all comments included in that Memorandum were communicated to the applicant or whether those comments have been adequately addressed. The following comments relate to the final plat materials. 1.With respect to Old Victory Road (OVR), the response from Vogel & Associates suggests that OVR remain in its current condition (undedicated gravel road) until "partner funding" is secured to complete the roadway. Contrary to the representations in such response, the Town need not wait for Grand Park to arrange "partner funding" before requiring the dedication and construction of OVR. As noted in my earlier Memorandum, the Annexation Agreement obligates Grand Park to construct OVR as a paved, two-land street to serve the development, regardless whether partner funding is arranged. The timing for such construction is at the discretion of the Town, and I understand that staff had proposed phasing of construction in RESPONSE: THE conjunction with the phased development of the Willows project. DEVELOPER HAS ELECTED TO PROCEED TO PAVE OVR FROM THE CURRENT END OF ASPHALT TO THE INTERSECTION WITH MOUNTAIN WILLOW DRIVE. 2.The final plats show OVR as primary access to all phases, and reference it as "non-exclusive easement - Town of Fraser Rec. 2009-006046". That recorded easement was granted for water facilities only and is not equivalent to a right-of-way for a public street. It is recommended that the entire road right-of-way be dedicated to the Town as a street, and that construction of the street and associated improvements be required, either with the initial phase or with segments to be completed with each phase of the development. STREETS~ RAMP- Coordinating potholing efforts for utility clearances for the traffic signal project at US 40 and First St/Rendezvous Rd. Review of variance request by GP for Pavement Depth design. Coordinating water tank access road alignment for Rick easement. Updating our snow management operations plan (SMOP) for a presentation coming soon. GARDENER~ The shelter structure for Gorenson Station park is tentatively slated for install in later September Preparing to decommission the south entry monument and planter in advance of the traffic signal install Preparing budgetary numbers for 2015 gardening/landscape improvements in various areas throughout town GENERAL~ Ryan Turk, Equipment Operator, CDOT forces. PW is looking for a replacement seasonal utility laborer. bridge was completed on 8/30. Continue working on finalizing the drainage alignment through Cozens Ranch Open Space (CROS) with the USACE. Need our Corps permit issued in time to get the project completed in conjunction with s diversion structure project.
