Action on SepEmber 12, 2005 Closed Session M'111ufes April 12. 2004 Closed Session Page 1 of2 Minutes Approved: May 10, 2004 CLOSED SESSION MINUTES HILLSBOROUGH TOWN BOARD April 12, 2004 7:30 PM, Town Barn The Hillsborough Town Board held a Closed Session at the end of their regular meeting on April 12, 2004 in the Hillsborough Town Barn. Present for the Closed Session were Mayor Joe Phelps, and Commissioners Mike Gering, Frances Dancy, Evelyn Lloyd, Eric Hallman, and Brian Lowen. Staff present were Town Manager Eric Peterson, Town Clerk Donna Armbrister, Planning Director Margaret Hauth, Interim Assistant Finance Director Greg Siler, Police Chief Nathaniel Eubanks, Assistant Town Manager/Public Works Director Demetric Potts, and Town Attorney Bob Hornik. CLOSED SESSION Mayor Joe Phelps opened the Closed Session A.Closed Session for the purpose of discussing potential litigation regarding the ColonialInnPlanning Director Margaret Hauth introduced this Item by reporting that the appeal deadline and start deadline for staff-ordered repairs to the Colonial Inn have passed without action by the owner, except to place the building on the market for sale. Town Attorney Bob Hornik reported that Section 21. 7.5 provides some protection for propert6ies actively marketed; however, staff agrees that the section implies that the property had to be actively marketed when the complaint was made against it, which was not the case for the Colonial Inn. There is the further question of whether the building was actively marketed before the 30-day start deadline. Additionally, the Ordinance allows a stay of up to 6 months. Hornik stated that the next step of recourse is to get a court order to have the owner to comply. Meanwhile, the Town is assessing civil penalties in the amount of$100/day. Attorney Hornik stated that the Town would need to get an administrative search warrant to view the damages inside the building. By consensus, the Board authorized Town Attorney Hornik to initiate settlement by letter. 2
