HomeMy Public PortalAbout019-1985- AUTHORIZING THE BOARD OF PUBLIC WORKS AND SAFETY AND THE MAYOR UPON RECOMMENDATION OF THE CITY ATTORNEYORDINANCE WO_ 19-1985 AN ORDINANCE AUTHORIZING THE HOARD OF PUBLIC WORKS AND SAFETT AND THE MAYOR UPON THE RECOMMENDATION OF THE CITY ATTORNET TO SETTLE CERTAIN CLAIMS AND LIABILITIES OF THE CITY OF RICHMOND WHEREAS, IndianaE Code I C. 34-4-16.5-15 provides that the governing body of a political subdivision may compromise, settle, or defend against a claim received and brought against a. political subdivision or its employees, and; WHEREAS, The Common Council desires to delegate the settlement of certain matters involving limited liability to the Board of Public Works and Safety and the City Attorrney's office. NOWTHEREFORE BE IT ORDAINED by the Common Council of the City of Richmond, that thie Board of Public Works and Safety and. the Mayor, upon the recommendation of the City Attorney may settle and compromise claims against the City of Richmond in an amount not to exceed the total amount allocated for that purpose in each year. The Board of Public Works and Safety shall have a fund established for the payment of such compromises of claims on an annual basis. Indiana Code I.C. 34-4-16.5-15 provides that the governing body of a political subdivision may compromise, settle or defend claims received by or against it or its employees. The Board of Public Works and Safety does have a fund set up designated as Refunds, Awards and Indemnities. This ordinance would allow the Board of Publin Works and Safety, upon the recommendation of the City Attorney, to help with claims in amounts not to exceed the budgeted amount in a given year. Part of the reason Chat this ordinance is proposed is to prevent alot of minor suits, that can be settled for very small sums, from coming before the Council, taking up your time and attracting undue publicity.
