Present for the Closed Session were Mayor Joe Phelps, and Commissioners Eric Hallman, Michael Gering, Brian Lowen, Frances Dancy, and Evelyn Lloyd. Staff present were Assistant Town Manager/Public Works Director Demetric Potts, Town Clerk Donna Armbrister, Planning Director Margaret Hau� Fire Marshal/Code Enforcement Officer Todd Chavious, Town Engineer Kenny Keel, and Town Attorney Bob Hornik. Mayor Joe Phelps opened the Closed Session. 12.CLOSED SESSIONA.Discuss Kenion Grove LitigationTown Attorney Bob Hornik reviewed the Court Ruling with the Board. He reported that the revised plan includes two amendments as follows: -parking spaces outside the lot that would not obstruct sidewalk-parking pad and two car garageMayor Phelps requested a Straw Poll of Board members on the approval of the Kenion Grove Subdivision Plan. The Straw Poll results are as follows: Dancy -in favor of agreement Gering -in favor of appeal Hallman -in favor of appeal Lloyd -in favor of agreement Lowen -in favor of agreement B.Discuss Corbinton Commons Litigation 1 Redacted Minutes Unsealed by Board Action on September 12, 2005 Closed Session Minutes September 13, 2004 Regular Board Meeting Page2of2 Minutes Approved: October 11, 2004 Hornik reported that there has been no further information on Colonial Inn.
