W H E RE A S , the Village Manager presented to the Village Council a "Tentative General Fund Operating Budget" for the fiscal year commencing October 1, 2021 and the Village Council scheduled the public hearing required by Section 200.065(2)(c), Florida Statutes to be held on September 8, 2021 at 6:00 p.m.; and WHEREAS, the Property Appraiser has properly noticed the public hearing scheduled for September 8, 2021, at 6:00 p.m., as required by Chapter 200 of the Florida Statutes; and WHEREAS, said public hearing, as required by Section 200.065(2)(c), Florida Statutes, was held by the Village Council on September 8, 2021, commencing at 6:00 p.m. as previously noticed and the public and all interested parties having had an opportunity to address their comments to the Village Council, and the Village Council having had an opportunity to amend the tentative budget as it deemed appropriate and having considered the comments of the public regarding the tentative budget and having complied with the "TRIM" requirements of Florida Statutes; and WHEREAS, pursuant to Section 200.065(2)(d), Florida Statutes, a final public hearing to adopt the budgets for the fiscal year commencing on October 1, 2021, through September 30, 2022, was held, as advertised, on Tuesday, September 21, 2021, at 6:00 p.m. and the Council considered comments from the public. NOW, THEREFORE, BE IT ORDAINED BY THE VILLAGE COUNCIL OF THE VILLAGE OF KEY BISCAYNE, FLORIDA, AS FOLLOWS: s e c ti o n 1. Recitals. That the above-stated recitals are true and correct and are incorporated herein by this reference. Section 2. Adopting Budgets. That upon prior adoption of the Village's final millage rate, which is hereby ratified, the Village of Key Biscayne budgets for the fiscal year commencing October 1, 2021 attached hereto as Exhibit A are approved and adopted. Section 3. Effective Date. That this Ordinance shall become effective immediately upon final adoption on second reading and shall be applicable from and after October 1, 2021. Two other men, Jason Van Eman, 41, ofOklaho· ma, and former Wells Fargo Bank employee Benjamin Rafael, 30, of South Florida, were also charged. Rafael was sentenced to three and a half years in prison in July. Van Eman is awaiting trial. Investigators say from 2013 to 2019 McConley and Van Eman billed themselves as producers and financiers and offered 10 provide funding to others who were working on motion pictures, thea· ter performances and other projects. The men guaranteed thatthevictims'cash contributions would be matched dollar for dollar. The victims were told lo deposit the money in an account controlled by McConley, Van Eman and Rafael. The U.S. Attorney's Office said in a news re- lease Tuesday that the "victims lost millions of dollars based on these false representations and promises." The money, the at· torney's office said, was spent on stocks, real estate and luxury items, includ- ing automobiles, jewelry, designer clothes and pri- vale and commercial air travel.
