ORDINANCE NO.~I'
AN ORDINANCE DEFIIrlING "ITINERANT MERCHANTS'; PROVING FOR
LICENSE, REQUIREMENTS, FEES, PRORATION; PROVIDING FOR
LICENSE APPLICATIONS.
BE IT ORDAINED BY THE GOVERNING BODY OF THE CITY OF BEL AIRE. KANSAS:
Section 1. DEFINITIONS
The'tenns "transient merchant", ''''itinerant merchant' or "itinerant vendor"
means any person, firm or corporation either as owner-, principal officer,
agent, servant or employee, and who is not a resident'of this City, who engages
in the temporary business of selling and delivering any goods, wares or merchandise
wholesale or retail within the city, and who, in furtherance of such business
purposes, hires, leases, uses or occupies any building, structure, motor vehicle,
tent, public room in hotels, motels, lodging houses. apartments, shops or
any other pl ace wti hi n the city authori zed for such use by city ordinance',
for the exhibition and sale of such goods, wares or merchandise, either privately
or publicly. Such definition shall not be construed to include any person,
finn or corporation who while occupying such temporary location does not sell
from stock, but exhibits samples only for the purpose of securing orders for
future delivery. The person, finn or corporation so engaged shall not be relieved
from complying with the provisions of this section merely by reason of associating
temporarily with any local business, dealer, trader or merchant. or by conducting
such transient business in connection with, as part of or in the name of any
local business, dealer, trader or merch~nt.
Section 2. LICENSE-REQUIRED
It shall be a misdemeanor for any itinerant merchant, as defined in this
ordinance hereof, to operation in the citv without having'obtained a license
from the license collector.
Section 3. LICENSE-FEES-PRORATION.
All iti nerant merchants shall paY" an occupati ona 1 1 i cense fee of thi rty-
five dollars, said license to be effective for a maximum period of ten consecutive
days only. Such transient merchants shall be required to pay an additional
thirty-five dollars occupational license for each consecutive ten-day period
they conduct business within the city. The license fee shall not be prorated
for the conducting of business for less than the ten day period of the license.
Section 4. LICENSE-APPLICATION
Applications for license under this ordinance, whether a person, firm
or corporation, shall file a written, sworn application signed by the applicant
and filed with the license collector, showing:
(2) The name or names of the person or persons having the management
or supervision of the applicant's business during the time that it is proposed
that it will be carried on in the city; the permanent address or addresses
of such person or persons; and, if a corporation, under the laws of what state
the same is incorporated;
(b) The place or places in the city where it is proposed to carryon
applicant's business and the length of time during which it is proposed that
such business shall be conducted;
(c) A statement of the, nature, character and qual ity of the goods, wares
or merchandise to be sold or offered for sale by the applicant in the city;
where the goods or property proposed to be sold are manufactrued or produced
and where such goods or products are located at the time said application
is filed;
(d) And demonstrating that they are registered with the state Sales
Wax Division;
(e) And indicating zoning approval from the City inspectors.
Section 5. EFFECTIVE DATE
This ordinance shall take effect and shall be in force from and after
its publication in the official city newspaper,
