CLOSED SESSION MINUTES
HILLSBOROUGH TOWN BOARD
July 12, 2004 7:30 PM, Town Barn The Hillsborough Town Board held a Closed Session on July 12, 2004 in the Hillsborough Town Barn as authorized by North Carolina General Statute Section 143-3 18.ll.(a)(3) to consult with Town Attorney regarding potential litigation. Present for the Closed Session were Mayor Joe Phelps, and Commissioners Eric Ha11man, Michael Gering, Brian Lowen, and Evelyn Lloyd. Absent from the Meeting was Commissioner Frances Dancy. Staff present were Town Manager Eric Peterson, Town Clerk Donna Armbrister, Assistant Town Manager/Public Works Director Demetric Potts, Planning Director Margaret Hauth, Fire Marshal/Code Enforcement Officer Todd Chavious, Town Engineer Kenny Keel, and Town Attorney Bob Hornik. Mayor Joe Phelps opened Closed Session. Town Attorney Bob Hornik reported that he has received a judgment from Judge Jolly 1

Minutes Approved: September 13, 2004 reversing the action on Kenion Grove. Within a couple of weeks we should have a si ed �sion approval to Kenion Grove. -At this time, there is no action necessary, but the Board may need toconsider it at their Workshop on the 26th• Town Attorney Hornik reported that the time for the Colonial Inn to answer runs out on the 26th• Upon a motion by Commissioner Hallman, seconded by Commissioner Lloyd, the Board moved to return to Open Session by a vote of 4-0.
