Dear Custodian of Records,
Forwarded herein is your latest response to my requests to obtain the final version of a complete
and unaltered Comprehensive Land Use Plan for the Town of Gulf Stream. You have replied:
Be advised that no such records exist. The most recent and only Comprehensive Land Use Plan
available is at the following link: http://www2.gulf-
stream .org /WebLink8/DocView.aspx ?id= 6528 &dbid =0, which was given in the previous letter.
This is not the record I seek. Therefore I will try to ask for the record I want in another way.
Please respond to this follow up request for a public record.
Pursuant to Article 1. Section 24 of the Florida Constitution and Chapter 119.07 of the Florida Statutes I
wish to make a public records request of your agency for the following records:
Most recent commission approved Comprehensive Land Use Plan subsequently
submitted to another agency and created prior to the version found at the
following link http: / /www2.saulf-
If any records that would have been responsive to this request have been destroyed,
then please provide any and all records identifying the destruction or other means of
disposition of records that would have been responsive to this Public Record Request.
If you contend that any of the records I am seeking, or any portion thereof, are exempt from inspection or
disclosure please cite the specific exemption as required by 6119.07(1)(e) of the Florida Statutes and
state in writing and with particularity the basis for your conclusions as required by 4119.070)(f) of the
Florida Statutes.
Please take note of 6119.07(c) Florida Statues and your affirmative obligation to (1)
promptly acknowledge receipt of this public records request and (2) make a good faith effort which
"includes making reasonable efforts to determine from other officers or employees within the agency
whether such a record exists and, if so, the location at which the record can be accessed." I am,
therefore, requesting that you notify every individual in possession of records that may be responsive to
this public records request to preserve all such records on an immediate basis.
If the public records being sought are maintained by your agency in an electronic format please produce
the records in the oricinal electronic format in which they were created or received. See 6119.01(2)(f).
Florida Statutes.
If you anticipate the production of these public records to exceed $1.00 please notify me in advance of
their production with a written estimate of the total cost. Please be sure to itemize any estimates so as to
indicate the total number of pages and /or records, as well as to distinguish the cost of labor and
materials.

Be advised that no such records exist. The document found at the link: http://www2.eulf-

Comprehensive Land Use Plan and was the only document that was submitted to a state agency.
If you would like to see the previously approved Comprehensive plan, which is no longer in
effect, please advise.

Your response to my request is confusing to me. I asked for: Most recent commission

recent commission approved Comprehensive Land Use Plan and was the only
document that was submitted to a state agency. If you would like to see the
previously approved Comprehensive plan, which is no longer in effect please
advise.
I did not ask you for a Comprehensive Land Use Plan still in effect. I asked for the
Comprehensive Land Use Plan created PRIOR to the version found at the above
referenced link. I assume that would be the previously approved Comprehensive Land
Use Plan created PRIOR to the current version AND submitted to a State Agency.
If your response is that all prior versions of the current Comprehensive Land Use Plan
were never submitted to a State Agency; I do not believe this is true. I believe a
Comprehensive Land Use Plan for the Town of Gulf Stream has been on file with the
State of Florida since as early as December of 1979.
I can not think of any other way to ask for this record. I want the version filed with the
State of Florida prior to the amended version found on the Town's website at the link
you provided. Please again review my request (forwarded herein) and provide this
public record.
