HomeMy Public PortalAboutRES 12/03RESOLUTION 012 -03 A RESOLUTION OF THE TOWN COMMISSION OF THE TOWN OF GULF STREAM, FLORIDA, AUTHORIZING A CONSTRUCTION AGREEMENT WITH THE STATE OF FLORIDA, DEPARTMENT OF TRANSPORTATION FOR CONSTRUCTION, INSTALLATION AND MAINTENANCE OF SIGN IMPROVEMENTS WITHIN THE STATE RIGHT OF WAY; DIRECTING THE APPROPRIATE TOWN OFFICIAL TO EXECUTE THE AGREEMENT; PROVIDING FOR REPEAL OF ANY CONFLICTING RESOLUTION; SEVERABILITY; AND PROVIDING AN EFFECTIVE DATE. WHEREAS, the Town of Gulf Stream has proposed the installation of signage to better inform the public of the location of the municipal limits of the Town of Gulf Stream; and WHEREAS, it is in the interest of the Town and community residents and visitors that this additional signage be constructed, installed and maintained; and WHEREAS, the Town has reached an agreement with the State of Florida, Department of Transportation ( "the Department ") for the construction, installation and maintenance of such additional signage. NOW, THEREFORE, BE IT RESOLVED BY THE TOWN COMMISSION OF THE TOWN OF GULF STREAM, FLORIDA THAT: Section 1. Recitals. Each "WHEREAS' clause set forth is true and correct, and herein incorporated by this reference. Section 2. Execution of Agreement. The Town Manager is hereby authorized to execute on behalf of the Town the Construction Agreement (the "Agreement ") with the Department in the form attached hereto as Exhibit "A" with such non - material changes as may be approved by the Town Manager and Town Attorney, and such other documents necessary to implement the terms of the Agreement. Section 3. Authorized Individuals. The Town Manager and his designee and the Town Attorney are authorized to take all actions necessary to implement the terms of the agreement. Section 4. Conflict. All resolutions or parts of resolution in conflict herewith are hereby repealed to the extent of such conflict. Section 5. Severability. If any clause, section or other part of this resolution shall be held by any court of competent jurisdiction to be unconstitutional or invalid, such unconstitutional or invalid part shall be considered as eliminated and in no way affecting the validity of the other provisions of this resolution. Section 6. Effective Date. This resolution shall become effective immediately upon its passage. PASSED AND ADOPTED this day of March , 2012.
