HomeMy Public PortalAbout062-1985-ZONING - 3413 EAST MAIN STREETGENERAL ORDINANCE NO. 62-1985 AN ORDINANCE AMENDING CHAPTER 154 OF THE MUNICIPAL CODE, BEING ORDINANCE NO. 2325-1968, COMMONLY KNOWN AS THE ZONING ORDINANCE OF THE CITY OF RICHMOND, INDIANA, PROVIDING FOR THE REZONING OF THE PROPERTY LOCATED AT 3413 EAST MAIN STREET, FROM R-2 SINGLE FAMILY RESIDENCE DISTRICT TO C-2 COMMUNITY BUSINESS DISTRICT. WHEREAS, the Zoning Map which is a part of Ordinance No. 2325- 1968 designates and describes as R-2 Single -Family Residence District the property located at 3413 East Main Street; and, WHEREAS, it is the intent and purpose hereof to change the zoning classification of said property from R-2 Single -Family Residence District to C-2 Community Business District; and, WHEREAS, a study of this Ordinance was conducted by the Richmond City Plan Commission the o23no( day of C�,�c _ , 1985, at which time remonstrances were h and from all parties interested in or affected by this Ordinance;. and, WHEREAS, the vote of the Richmond City Plan Commission was to J in favor of/ recommending the passage of Ordinance No. 62-1985. NOW THEREFORE BE IT ORDAINED by the Common Council of the City of Richmond, Indiana as follows: SECTION 1. That the zoning classification of the property described below, and the same is hereby changed to C-2 Community Business District, and that said property be regulated in accordance with the Zoning Ordinance of the City of Richmond, Indiana and all amendments thereto: Being a part of the Southeast Quarter of Section 35, Township 14 North, Range 1 West in Richmond, Indiana; more specifically described as follows: Beginning at a point in the west line of the property owned by Richmond D & K Company, Inc., said point be- ing on the south right-of-way line of U.S. Highway No. 40; running thence east along said right-of-way line 75 feet; running thence south 140 feet; running thence west 75 feet; thence north 140 feet to the place of beginning. ALSO: Being a part of the Southeast Quarter of Section 35, Township 14 North, Range 1 West in Richmond, Indiana, more particularly described as follows: Beginning at a point in the west line of the property owned by Richmond D & K Company, Inc., said point be- ing 140 feet south of the south right-of-way of U.S. Highway No. 40 (National Road); thence south along said west line 181 feet; thence east 75 feet; thence north 181 feet; thence west 75 feet to the place of beginning. SECTION 2. This Ordinance shall be in full force and effect from and after its passage and approval as by law required. GENERAL ORD. Mayor ATTEST:Yzat";a City C erk CITY PLAN COMMISSION RICHMOND, INDIANA July 31, 1985 Mr. Marion Williams, President Members of Common Council and Mrs. Mary Merchanthouse, City Clerk Municipal Building Richmond, Indiana 47374 Re: Ordinance No. 62-1985 Plan Commission Case PC-85-7 Dear Mr. Williams, Members of Common Council and Mrs. Merchanthouse: The Richmond City Plan Commission conducted a public hearing on Tues- day, July 23, 1985, on the petition of D and K Company, Inc., owners; George R. Reller, Agent, requesting a rezoning from the R-2'Single- Family Residence District to the C-2 Commercial Dsitrict at 3413 East Main Street. Fourteen (14) notices of public hearing were sent to surrounding residents with two (2) returned in favor of the petition and seven (7) returned in opposition to the petition. During the public hear- ing, three (3) persons spoke in opposition to the request. The Plan Commission considered the following testimony in making its determination: (1) The property in question adjoins a primary thoroughfare and is adjacent to an existing C-2 Zoning District. (2) The overall pattern of land use in the area is a mix of commercial and residential struc- tures. The predominate commercial occupancy in the area is C-2. (3) The property in question is a single parcel divided by a Zoning District Boundary Line. Overall the property is 461 feet deep. The first 140 ft. of the property is zoned C-2 and the remainder is R-2. The Zoning Boundary Line runs through the middle of a building on the proprty which houses the Ziebart Undercoating business. Located at the rear of the Ziebart building is a garage that is being used for commercial purposes.
