HomeMy Public PortalAbout064-1985-STRICKEN - ADDING SECTION 31.55 TO THE CODEORDINANCE NO.64- 1985 AN ORDINANCE ADDING SECTION 31.55 TO THE RICHMOND CITY CODE ESTABLISHING A STANDARD TO BE USED IN CALCULATING BENEFITS AND ASSESSMENTS FOR RETIRED POLICE PENSIONERS UNDER THE 1925 POLICE PENSION FUND. WHEREAS, the benefits and contributions of retired police personnel under the 1925 Police Pension Fund are dependent upon a formula incorporating the base pay of a theoretical first-class patrol officer with senior status; and WHEREAS, the Richmond Police Pension Board has traditionally based its calculations on the tenure of the most senior police officer; and WHEREAS, the present most senior police officer has twenty-four (24) years of service, upon which such pension benefits and assessments are based; and WHEREAS, Indiana Code, I.C. 36-6-6-5(b) provides that the Common Council may not reduce the expenditures of the 1925 Police Pension Fund; and WHEREAS, it is necessary to establish a standard to be used as a guide for calculating benefits and for calculating assessments. NOW THEREFORE, BE IT ORDAINED by the Common Council of the City of Richmond, Wayne County, Indiana, that Section 31.55 be added to the Richmond City Code to provide as follows: For purposes of calculating benefits and assessments under the 1925 Police Pension Fund law, such calculations shall be made on the basis of the base pay of a First Class Police Patrol Officer with twenty-four (24) years of service on the police force. Barden, City Attorney m uca Room am &O@W8VV Maia&= T@ v File Pursuant to a discussion with the City Controller it. appears that the longevity will "cap out" at 20 years. The City Controller stated she will check this out with the State Board of Accounts. Tom Cox should proceed to calculate on the basis of a 20-year "cap", while the ordinance is being written. As to the ordinance itself, Chief Nimitz, Tom Cox, the City Controller, and the City Attorney will meet on Monday, July 1, 1985, at 2:00 p.m. to discuss the longevity and implementation of any state law changes on police pension benefits. The City Controller felt that the best time to present the ordinance to Council would be July 15, between passage of the salary ordinance and consideration of the 1986 Budget. Mary Merchanthouse is requested to look at previous Council ordinances or resolutions dealing with police pension benefits and/or longevity benefits and to furnish copies to this office. In addition, if Chief Nimitz has any suggestions those would be appreciated. Sorry for any delay, but the Controller felt this would 1w. the best approach. We'll meet on July 1st at 2:00 if possible.
