HomeMy Public PortalAbout065-1985-PROVIDING FOR DEATH BENEFITS FOR MEMBERS OF THE POLICE DEPTAMENDED ORDINANCE NO. 65-1985 AN ORDINANCE PROVIDING FOR DEATH BENEFITS FOR MEMBERS OF THE POLICE DEPARTMENT WHEREAS, Indiana Code, I.C. 36--8-6-9.8, require a City to establish by ordinance death benefits payable to certain members of the police department;and WHEREAS, said provisions of the Indiana Code establish death benefits of Three Thousand Dollars ($3,000.00) for certain members of the police department who die after August 31, 1984; NOW, THEREFORE, BE IT ORDAINED by the Common Council of the City of Richmond, Wayne County, Indiana that: Section 31.51 of the Richmond City Code be amended in its entirety as follows: The following shall apply to members of the 1925 Police Pension Fund: (a) The 1925 fund shall be used to pay funeral benefits to the heirs or estate of an active or retired member of the police department who has died from any cause, in an amount fixed: ( 1) one thousand five hundred dollars ($1,500.00) for a member who dies before September 1, 1984; and (2) three thousand dollars ($3,000.00) for a member who dies after August 31, 1984. (b) In addition, a payment shall be made to the surviving spouse of a deceased member, in an amount equal to thirty-five percent (35%) of the monthly pay of a first class patrolman per month during his life if the spouse did not remarry before September 1,1983. If the spouse remarried before September 1,1983, benefits ceased on the date of remarriage. A payment shall also be made to each child of a deceased member under the age of eighteen (18) years, in an amount equal to fifteen percent (15%) of the monthly pay of a first class patrolman per month to each child: (1) until the child reaches the age of eighteen ( 18); or (2) during the entire period of the child's physical or mental disability whichever period is longer. However, the benefits under this subsection may not exceed the maximum benefits computed under Indiana Code, I.C. 36-8-6-9 for pension payments to a member who retires from active service after twenty (20) years or more of active service. (c) If a deceased member leaves no surviving spouse and no child under the age of eighteen ( 18) years but does leave a dependent parent or parents, an amount equal to twenty percent (20%) of the monthly pay of a first class patrolman per month from the time of his death shall be paid to the dependent parent or parents during their dependency. When both parents survive, the total amount is still twenty percent (20%), to be paid to them jointly. In all cases of payment to a dependent relative of a deceased member, the pension board is the final judge of the question of necessity and dependency and of the amount to be paid. The pension board may also reduce or terminate temporarily or permanently a payment to a dependent relative of a deceased member when it determines that the condition of the fund or other circumstances makes this action necessary. (d) If the salary of a first class patrolman is increased or decreased, the pension payable under this seciton shall be proportionately increased or decreased.
