AN URGENCY ORDINANCE OF THE CITY OF BEAUMONT, CALIFORNIA
ENACTED PURSUANT TO ®36934 OF THE CALIFORNIA GOVERNMENT
CODE AMENDING ORDINANCE NO. 333 PROVIDING UPDATE OF
BUSINESS LICENSE FEE SCHEDULES
The City Council of the City of Beaumont does hereby ordain
that Ordinance No. 333 shall be amended as follows:
1. Sections 8-a, 8-b, 8-c and 8-d of Ordinance No. 333 as
written shall be deleted.
2. Section 8-a shall be added as follows:
SECTION 8-a. The Fiscal Year for the Payment of licenses
shall be from July 1 to June 30 of succeeding year. When the
licenses provided by this ordinance are fixed at so much per annum,
they shall be for the full year, except that new operations
commencing after January 1 may obtain a half-year license. The
fee shall be fifty percent (507) of the normal yearly license fee,
all fees payable in advance.
3. Section 8-b shall be added as follows:
SECTION 8-b. Class I, Class II, Class III, Class IV,
Class V, Crass -V1 and Class VII fee schedules are adopted by
reference as an integral part of this ordinance. Each class shall
be certified as an integral portion of Section 8-b and may from
time to time be changed by the Governing Bodies` action and
certified by the City Clerk as to current fee schedules for any or
all classes.
4. Section 8-c shall be added as follows:
SECTION 8-c. All fees and taxes set forth herein may be
amended from time to time by Resolution.
5. Section 8-d shall be added as follows:
SECTION 8-d. Any person, firm or corporation violating
any of the provisi ns of this ordinance shall be deemed guilty of
a misdemeanor and may have bail assessed in the amount of Fifty
Dollars ($50.00). Upon conviction thereof, such person shall be
punishable by a fine of not more than Three Hundred Dollars ($300.00)
or by imprisonment in the County Jail for a period of not more than
ninety (90) days, or both such fine and imprisonment. This provi-
sion does not alter or replace the schedule for late payment of the
Business License Tax.
6. This Ordinance is passed, adopted and enacted, pursuant
to §36934 of the California Government Code as an urgency measure
pursuant to the police power of the City of Beaumont. The intent
of this ordinance is to protect the public health, safety and
welfare through regulation of all types of operations doing busines
within the City of Beaumont by creating a business license tax that
reflects the cost of regulation and enforcement programs for the
benefit of the citizens of Beaumont effective July 1, 1981 the
beginning of Fiscal Year 1981-82.

Gross Receipts Defined.
"Gross Receipts" shall include the total amount of the sale price of
all sales and the total amount charged or received for the performance
of any act, service, or employment, of whatever nature it may be, for
whicha charge is made or credit allowed, whether or not such act,
service, or employment is done as a part of or in connection with the
sale of materials, goods, wares, or merchandise, or the rendition of
personal services. Included in "gross receipts" shall be all receipts,
cash, credits, and property of any kind or nature, without any deduction
therefrom on account of the cost of the property sold, cost of materials
used, labor or service costs, interest paid or payable, or losses, or
other expenses whatsoever, and receipts attributable to selling activi-
ties or personal services within the city. Excluded shall be cash
discounts allowed and taken on sales, credit allowed on property accepted
as part of the purchase price and which property may later be sold, any
tax required by law to be included in or added to the purchase price
and collected from the consumer or purchaser.

POSTING AND KEEPING OF LICENSES: All licenses shall be kept and posted
ih the tollowing manner; and no person having a duty to do so, shall
fail, refuse or neglect to comply with the following regulations:
Any licensee using a motor vehicle in connection with his
business shall affix the license or copy of same to the
right hand lower corner of the windshield of such vehicle;
as authorized by the vehicle code.
COMBINED MANUFACTURERS GROSS WEIGHT FIXED FEE SCALE: The following
manufacturers gross weight tixed fee scale shall apply to the special
catagories of delivery, trucking and transportation including trailers
and mobile homes being transported to this city by out-of-town
businesses for the purpose of resale to and/or use by a wholesaler
or manufacturer.

SIGNS ON VEHICLES REQUIRED: Every motor vehicle or combination of
veTic1s used to carry the property of others for hire or to carry
passengers for hire and any vehicle used in conjunction with any
business inside the City and all other vehicles doing business or
delivery with the City shall bear the trademark or name and address
or phone number of the company whose authority the vehicle is being
operated under. The display of name, trademark and address or phone
number shall be in a shape and contrast to the background with
lettering of such size and shape to be readily legible during the
daylight hours at a distance of 50 feet. Those signs required by
California Vehicle Code are acceptable.
