HomeMy Public PortalAboutOrdinance 5401 2 3 4 5 6 7 8 9 10 11 12 13 14 15 16 17 18 19 20 21 22 23 24 25 26 27 28 29 30 31 32 ORDINANCE NO. 540 AN ORDINANCE OF THE CITY OF BEAUMONT, CALIFORNIA CONSOLIDATING THE DATE FOR GENERAL MUNICIPAL ELECTIONS WITH THE UNIFORM DISTRICT ELECTION DAY (NOVEMBER OF ODD - NUMBERED YEARS). WHEREAS, S.B. 230, Chapter 10.13, 1981 Statutes provides that Cities may consolidate the general municipal election with the State Primary, the State General Election or the Uniform District Election Day, and; WHEREAS, the Board of Supervisors must acquiecse in the City's request for general municipal election day consolidation, and; WHEREAS, the Board of Supervisors must take action prior to January 14, 1982, and; WHEREAS, the consolidation of the general municipal election will result in the reduction of election costs to the City, and; WHEREAS, the consolidation of the general municipal election should result in greater local interest and resultant greater voter participation; NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF BEAUMONT, CALIFORNIA DOES ORDAIN AS FOLLOWS: SECTION 1: AUTHORITY. This Ordinance is adopted under the authority granted to the City of Beaumont ("City") to call general municipal elections for the same day as the Uniform District's Elections pursuant to Section 36503.5 of the California Government Code. SECTION 2: INTENT OF THIS ORDINANCE. The intent of this Ordinance is to reduce the costs of con- ducting general rtunicipal elections in the City by permitting the consolidation of the City's general municipal election with the Uniform District Election conducted by the Clerk of the County of Riverside. In addition, it is anticipated that there will be an increas in vcter participation in the general municipal election under this ordinance because of heightened interest in multiple local district candidates and issues. This Ordinance will govern the calling of general municipal elections in. the City until repealed by the City Council. SECTION 3: CALLING OF THE ELECTION. The general municipal election shall be held in the City of Beaumont on the same day as the Uniform District Election. Those elected officials whose terms of office would have, prior to this Ordinance, expired on Tuesday succeeding the second Tuesday in April shall, instead, continue in their offices until not later than the second Tuesday after the day of the general municipal election. 11 Page 1 1 2 3 4 5 6 7 8 9 10 11 12 13 14 15 16 17 18 19 20 21 22 23 24 25 26 27 28 29 30 31 32 SECTION 4: REQUEST FOR CONSOLIDATION. A. At the same time the resolution calling the general municipal election is adopted, the Riverside County Board of Supervisors may be requested, by resolution, to order that the general municipal election for the City of Beaumont be conso- lidated with the Uniform District Election. Such resolution shall set forth the exact form of any question, proposition, or office to be voted upon at such election, as the same is to appear upon the ballot. B. Pursuant to Section 23314 of the Elections Code, each such consolidated election will be held and conducted, election officers appointed, voting precincts designated, ballots printed, Polls opened and closed, ballots counted and returned, returns canvassed, results declared, certificates of election issued and all other proceedings incidental to and connected with the election shall be regulated and done, in accordance with the provisions of law regulating the Uniform District Election with which. the Beaumont municipal election is consolidated. SECTION 5: NOMINATIONS. The period for the filing of nomination documents by candi- dates in each municipal election for the City of Beaumont shall commence on the 89th day prior to the election. The nomination documents shall be filed not later than 5:00 P.M. on the 68th day prior to the Uniform District Election in the Office of the County Clerk of the County of Riverside during regular office hours. SECTION 6: NOTICE TO VOTERS. Within thirty (30) days after this Ordinance shall become operative, following its approval by the Board of Supervisors of the County of Riverside, the City Clerk is hereby ordered to cause a notice to be mailed to all registered voters informing the voters of the change in the election date. The notice shall also inform the voters that as a result of the change in the election date, elected City officeholders' terms of office shall be extended and that no terms shall be decreased. SECTION 7: REQUEST FOR APPROVAL. The Board of Supervisors of the County of Riverside requested to approve this Ordinance permitting the City of Beaumont General Municipal Election to be held on the same day as the Uniform District Election. is hereb SECTION 8: EFFECTIVE DATE. The Mayor shall sign this Ordinance and the City Clerk shall attest thereto. The Clerk is authorized and directed to file a certified copy of this Ordinance with the Board of Supervisors of the County of Riverside. This Ordinance shall become operative immediately upon approval by the Board of Supervisors, pursuant to Section 36504.5 and 36933(b) of the Government Code.
