HomeMy Public PortalAboutOrdinance 5541 2 3 4 5 6 7 8 9 10 11 12 13 14 15 16 17 18 19 20 21 22 23 24 25 26 27 28 29 30 31 32 URGENCY ORDINANCE NO. 554 AN ORDINANCE OF THE CITY OF BEAUMONT, CALIFORNIA, ADOPTING BY REFERENCE ARTICLE 4, CHAPTER 6, PART 3 (SECTIONS 5470 TO 5474.10 OF THE HEALTH AND SAFETY CODE OF THE STATE OF CALIFORNIA) AND PROVIDING FOR THE AMENDMENT TO ORDINANCE NO. 370 AND RESOLUTION NO. 1978-28 AND ORDINANCE NO. 416 AND RESOLUTION NO. 1978-27. , THE COUNCIL OF THE CITY OF BEAUMONT DOES ORDAIN AS FOLLOWS: SECTION 1: The City of Beaumont did adopt Ordinance No. 370 and Resolution No. 1978-28 pertaining to the collection and disposal of garbage and rubbish and did provide in said documents the fees to be charged for said work. SECTION 2: The City of Beaumont did adopt Ordinance No. 416 and Resolution No. 1978-27 pertaining to the disposal of sewage and for the collection of sewer charges and collection thereof. SECTION 3: The City of Beaumont did adopt Ordinance No. 370 and Resolution No. 1978-28 regarding the collection of garbage and rubbish, and provides for costs thereon and the collection of charges and fees. SECTION 4: Section 5473 of the Health and Safety Code of the State of California, empowers an entity to adopt by ordinance the right to have charges made a lien and placed upon the tax rolls. SECTION 5: It is the intention of the City Council as an alternate means of collecting for sewage and other sanitation facilities to place the costs thereof and make them a lien on the tax rolls in accordance with Article 4, Chapter 6, Part 3 of the Health and Safety Code of the State of California. SECTION 6: Section 521 of Ordinance No. 416 and Resolution No. 1978-27 is hereby amended to read in part as follows: SECTION 521. PROPERTY LIENS FOR DELINQUENCIES The fees provided for in Section 521 or Ordinance No. 416 and Resolution No. 1978-27, may hereafter be amended 1 2 3 4 5 6 7 8 9 10 11 12 13 14 15 16 17 18 19 20 21 22 23 24 25 26 27 28 29 30 31 32 and shall constitute a civil debt due to and owing the City. In addition to, but not in limitation of the foregoing, the said fees provided for in said Ordinance and Resolution shall constitute a lien assessed against the property and shall be collected in accordance with Article 4, Chapter 6, Part 3 of the Health and Safety Code of the State of California. SECTION 7: Ordinance No. 370 and Resolution No. 1978-28 is hereby amended by adding thereto a new Section known as Section 13A to Ordinance No. 370 to read as follows: SECTION 13A: In addition, but not in limitation of the foregoing, the said fees provided for in said Ordinance and Resolution shall constitute a lien assessed against the property in accordance with Article 4, Chapter 6, Part 3 of the Health and Safety Code of the State of California. SECTION 8: URGENCY This is an urgency ordinance which, for the protection of the public health, safety and welfare, is required to become effective immediately upon its passage and adoption. Grounds for such urgen- cy are that the revenues herein provided are required immediately in order to provide the sanitation service and maintenance of the City Sewage Plant and that the remedy of a lien is necessary in order to protect the sewage system of the City of Beaumont. SECTION 9: The City Clerk shall certify to the adoption of this ordinance and shall cause the same to be published once in the Daily Record -Gazette Newspaper of General circulation, circu- lating the City of Beaumont, California, and immediately after its adoption, this ordinance shall be in full force and effect.
