ORDINANCE NO. 577
AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF
BEAUMONT, CALIFORNIA PROHIBITING DISPOSAL OF DEBRIS
OR OTHER PERSONAL PROPERTY ON OTHER PEOPLE'S PROPERTY
WHEREAS, the City Council has determined that it is in the
public interest to upgrade the appearance of the community; and
WHEREAS, the City Council has determined that the accumula-
tion of debris may be dangerous to the public health, safety and
welfare; and
WHEREAS, the depositing of debris in other people's trash
containers without permission constitutes trespass of other
people's property and use of that property which is costly to the
owner;
NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF BEAUMONT,
CALIFORNIA DOES ORDAIN AS FOLLOWS:
SECTION I - DEBRIS AND PERSONAL PROPERTY DISPOSAL
A. Violations - No person shall deposit any debris,
trash or other personal property upon any other person's property
or in any other person's commercial trash bin or can without that
person's permission.
B. Notice of Violation -- Any person violating the provi-
sions of this Ordinance may be issued a citation.
C. Penalty - Any person who violates any provisions of
this Ordinance shall be guilty of an infraction, pursuant to the
provisions of Government Code Section 36900 and the penalties pro-
vided therein, and upon conviction thereof shall be punishable by
a fine in the amount of:
$ 25.00 to $50.00 First Conviction
$100.00 Second Conviction (within 1 year)
$250.00 Third Conviction (within 1 year)
D. Cumulative Remedy - The remedies prescribed herein
are intended to be in addition to any other procedures or penalties
prescribed by law.
SECTION II - SEVERABILITY
If any section, subsection, sentence, clause, phrase or
portion of this Ordinance is for any reason held to be invalid or
unconstitutional by the decision of any court of competent juris-
diction, such decision shall not affect the validity of the
remaining portions of this Ordinance. The City Council of the City
of Beaumont hereby declares that it would have adopted this
Ordinance and each section, subsection, sentence, clause, phrase or
portions thereof irrespective of the fact that any one or more
sections, subsections, sentences, clauses, phrases or portions be
declared invalid or unconstitutional.
SECTION III -
The Mayor shall sign this Ordinance and the City Clerk
shall attest thereto and shall within fifteen (15) days of its

adoption cause it or a summary of it to be published once in the
Record -Gazette, a newspaper published and circulated in the City
of Beaumont and thereupon and thereafter this Ordinance shall take
effect and be in force according to law.
MOVED, PASSED AND ADOPTED this 22nd day of August
1983.
