HomeMy Public PortalAboutOrdinance 5921 2 3 4 5 6 7 8 9 10 11 12 13 14 15 16 17 18 19 20 21 22 23 24 25 26 27 28 29 30 31 32 ORDINANCE NO. 592 AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF BEAUMONT, CALIFORNIA ADDING TO THE CITY OF BEAUMONT MUNICIPAL CODE A CHAPTER 2.14 CREATING A CODE ENFORCEMENT OFFICER THE CITY COUNCIL OF THE CITY OF BEAUMONT DOES ORDAIN AS FOLLOWS: SECTION 1: There is hereby added to the Beaumont Municipal Code a Chapter 2.14, which chapter is to read as follows: CODE ENFORCEMENT OFFICER Section 2.14.010 - Office Created. The office of Code Enforcement Officer is created and established. The Code Enforce- ment Officer shall be appointed by the City Manager, pursuant to Section 2.14.060 of this Code, and shall hold office at and during the pleasure of the City Manager. Section 2.14.020 - Purpose. The intent of this chapter is to permit the City Manager to more fully perform his duties as outlined in Section 2.12.060(A) of this Code. Section 2.14.030 - Reporting. Duplicates of all reports prepared and of all notices to appear issued by the Code Enforcemen Office shall be forwarded in a timely manner to the City Manager. Disposition of all notices to appear shall be as prescribed by Chapter 5C of the California Penal Code, commencing with Section 853.6. Section 2.14.040 - Duties. (a) The Code Enforcement Officer shall enforce the Beaumon Municipal Code. (b) Pursuant to Section 836.5 of the California Penal Code the Code Enforcement Officer may arrest a person without a warrant whenever he has reasonable cause to believe that the person to be arrested has committed a misdemeanor in his presence which is a violation of the Beaumont Municipal Code. In any case in which a person is arrested pursuant to this subsection and the person arrested does not demand to be taken before a magistrate, the Code Enforcement Officer making the arrest shall prepare a written notice to appear and release the person on his promise to appear, as prescribed by Chapter 5C of the Californi Penal Code, commencing with Section 853.6. The provisions of that chapter shall thereafter apply with reference to any proceeding based upon the issuance of a written notice to appear pursuant to this chapter of the Beaumont Municipal Code.
