ORDINANCE NO. 599
AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF
BEAUMONT, CALIFORNIA, ADDING TO THE CITY OF
BEAUMONT MUNICIPAL CODE A CHAPTER 15.38 AUTHORIZING
THE CITY BUILDING INSPECTOR TO ISSUE CITATIONS FOR
CERTAIN CODE VIOLATIONS
THE CITY COUNCIL OF THE CITY OF BEAUMONT DOES ORDAIN AS
FOLLOWS:
SECTION 1: There is hereby added to the Beaumont Municipal
Code a Chapter 15.38, which chapter is to read as follows:
BUILDING INSPECTOR
SECTION 15.38.010 - ENFORCEMENT.
(a) The Building Inspector is authorized to enforce all pro-
visions of Title 15 of the Beaumont Municipal Code, including
those uniform codes incorporated into Title 15 by express
provisions and Section 17.72.440 of the Beaumont Municipal Code.
(b) Pursuant to Section 836.5 of the California Penal Code
the Building Inspector may arrest a person without a warrant
whenever he has reasonable cause to believe that the person to be
arrested has committed a misdemeanor in his presence which is a
violation of any of the provisions stated in Subsection (a) of
this section.
In any case in which a person is arrested pursuant to
this Subsection and the person arrested does not demand to be
taken before a magistrate, the Building Inspector making the
arrest shall prepare a written notice to appear and release the
person on his promise to appear, as prescribed by Chapter 5 of the
California Penal Code, commencing with Section 853.6. The provi-
sions of that Chapter shall thereafter apply with reference to any
proceeding based upon the issuance of a written notice to appear
pursuant to this chapter of the Beaumont Municipal Code.
