TYBEE ISLAND, GEORGIA
August 9, 1978
A regular meeting of the City Council of Tybee Island, Georgia was
held at 3:30 p.m. on Wednesday, August 9, 1978 at the City Hall, with Mayor
M. J. Counihan presiding. The following members of Council were present:
William C. Fleetwood, John J. Owen, Edward Jung, Karen Losey, Jerome W.
Bettencourt and Nick C. Alexander. Danny C. Johnson, City Administrator, and
W. Lance Smith, III, City Attorney were also in attendance.
Mr. W. F. Brogdon appeared before Council to make several complaints
concerning the management of the City; his primary complaint concerned loose
dogs on the beach.
Mrs. Helen Burton appeared before Council representing the Tybee
Womens Council, who wished to thank Councilman Alexander for his help in
removing the recycling collection from Memorial Park after August 7, 1978.
She stated that the group responsible had failed to remove the collection and
that Mr. Alexander was very helpful in providing City employees for the purpose.
The meeting was opened for business legally presented.
The minutes of July 12, 1978 were approved as written.
The bills for the month of July, 1978 were approved: Capital Outlay -
$1,772.21 (plus $185.00 for a stripping machine for Public Works), General
Government - $3,849.94, Sewer Department - $2,530.85, Water Department - $1,015.16,
Police Department - $931.80, Meter Department - $187.90, Fire Department - $268.49,
Recreation Department - $1,350.64, Ceramics - $42.73, Sanitation Department -
$3538.45, and Public Works - $1,571.30.
Councilwoman Losey read a Resolution authorizing a temporary loan
by the City of Tybee Island, Georgia. The Resolution read as follows:

R E S O L U T I O N
AUTHORIZING TEMPORARY LOAN BY THE CITY OF TYBEE ISLAND, TYBEE
ISLAND, GEORGIA
UNDER THE CONSTITUTION OF THE STATE OF GEORGIA, ARTICLE VII,
SECTION VII, PARAGRAPH IV, AND FOR OTHER PURPOSES.
WHEREAS, under and by virtue of the Constitution of
the State of Georgia, Article VII, Section VII, paragraph IV
(Section 2 -6004 of the Georgia Code of 1933, Annotated) each
County, Municipality or Political Subdivision of the State
authorized to levy taxes is given the authority to make
temporary loans between January 1, and December 31 in each
year to pay expenses for such year, upon certain conditions,
and
WHEREAS, such conditions have been fulfilled by the
City of Tybee Island, Georgia as hereinafter appears, and
WHEREAS, the said City of Tybee Island, Tybee Island,
Georgia has now outstanding no temporary loan, or loans, made
in the current year, or in any prior year, and
WHEREAS, the total gross income of said City of Tybee
Island, Georgia from taxes in the last preceding fiscal year
(1977 -1978) was $245,626.00, and
WHEREAS, the total anticipated revenue of the City
of Tybee Island, Tybee Island, Georgia for the fiscal year
1978 -1979 exceeds $848,444.00, and
WHEREAS, the amount to be borrowed, $46,548.75, plus
all other anticipated obligations and expenses of the City of
Tybee Island, Tybee Island, Georgia for the fiscal year
1978 -1979 are less than the total anticipated revenue from all
sources for such fiscal year, and
WHEREAS, under the aforesaid authority, The City of
Tybee Island, Tybee Island, Georgia may make such temporary
loan, or loans, in the fiscal year 1978 -1979 in a total amount
not to exceed $46,548.75; and
WHEREAS, the Mayor and Council constitute the govern-
ing body of the City of Tybee Island, Tybee Island, Georgia.

NOW, THEREFORE, BE IT RESOLVED by the Mayor and
Council of the City of Tybee Island, Tybee Island, Georgia
in a legally called meeting, assembled August 9, 1978:
That the City of Tybee Island, Tybee Island, Georgia
is hereby authorized to borrow from Savannah Bank & Trust
Company of Savannah the sum of $46,548.75 to be represented
by a Promissory Note bearing interest at the prevailing and
best obtainable rate of interest per annum, and the entire
amount, together with interest, to be repaid on or before
December 31, 1978. The Promissory Note evidencing said loan
shall be executed in the name of the City of Tybee Island,
Tybee Island, Georgia and signed by the Mayor and /or Pro
Tem and City Treasurer and /or Finance Chairman at any time
subsequent to January 1, 1979.

After the reading of the Resolution Councilman Fleetwood moved its
adoption; Councilman Bettencourt seconded the motion; it passed unanimously.
The First Reading of an Ordinance regulating the Fire Department
was read by the City Attorney and accepted by the Council. A Second Reading
was scheduled for the next regular Council meeting.
An ordinance amending the ordinance regulating business hours for the
sale of alcoholic beverages was read and was unanimously passed on First and
Second Reading. The ordinance read as follows:
AN ORDINANCE OF THE CITY OF TYBEE ISLAND, GEORGIA, PROVIDING THAT
THE CODE OF ORDINANCES, CITY OF TYBEE ISLAND, GEORGIA, BE AMENDED AS FOLLOWS:
AN ORDINANCE TO AMEND CHAPTER 3, ARTICLE I, SECTION 3 -1, PARAGRAPH (a) (1)
BUSINESS HOURS - SPECIFIED; AND RESPONSIBILITY FOR COMPLIANCE.
BE IT ORDAINED BY THE MAYOR AND COUNCIL OF THE CITY OF TYBEE ISLAND,
GEORGIA, THAT THE ABOVE SECTION 3 -1, PARAGRAPH (a) (1) BE AMENDED TO READ AS
FOLLOWS:
IT SHALL BE UNLAWFUL FOR ANY PERSON OR BUSINESS TO SELL OR OFFER FOR
SALE ANY ALCOHOLIC BEVERAGES, DISTILLED SPIRITS, OR SPIRITOUS LIQUORS FOR
BEVERAGE PURPOSES BY THE DRINK FOR CONSUMPTION ON THE PREMISES AS SUCH TERMS
ARE DEFINED BY GEORGIA CODE SECTION 58 -1011 DURING THE FOLLOWING TIMES, EXCEPT
AS PROVIDED IN SECTION 3 -1 (a) (3): SUNDAY: 2:56 a.m. to 9:00 a.m. MONDAY,
TUESDAY: 4:01 a.m. to 9:00 a.m. TUESDAY, WEDNESDAY: 4:01 a.m. to 9:00 a.m.
WEDNESDAY, THURSDAY: 4:01 a.m. to 9:00 a.m. THURSDAY, FRIDAY: 4:01 a.m. to
9:00 a.m. FRIDAY, SATURDAY: 4:01 a.m. to 9:00 a.m. SATURDAY.
BE IT ALSO ORDAINED THAT CHAPTER 3, ARTICLE I, SECTION 3 -1, PARAGRAPH
(a) (3) BE ADDED AS FOLLOWS:
ANY LICENSED EATING ESTABLISHMENT WHICH DERIVES AT LEAST FIFTY PERCENT
(50 %) OF ITS TOTAL ANNUAL GROSS FOOD AND BEVERAGE SALES FROM THE SALE OF PRE-
PARED MEALS OR FOOD ARE ALLOWED TO OPEN FOR THE SALE OF DISTILLED SPIRITS, MALT
BEVERAGES OR WINE FOR CONSUMPTION ONLY ON THE PREMISES ON SUNDAY BETWEEN THE
HOURS OF 12:30 P.M. AND 12:00 MIDNIGHT.
The above ordinance was read and enacted on August 9, 1978 and became
effective as of that date.
The Mayor then opened the floor for nominations for Mayor- Pro -Tem.
Councilman Jung nominated Councilman Bettencourt; Mayor Counihan called for
a second to the nomination; there was no second and the motion was dropped.
The Mayor then asked for a secret ballot. Councilman Fleetwood was elected
by majority vote of the Council, and was named Mayor- Pro -Tem, effective
immediately.

There being no further business, the Mayor adjourned the meeting
until the next regular or special called meeting.
