HomeMy Public PortalAboutOrdinance 6261 2 3 4 5 6 7 8 9 10 11 12 13 14 15 .16 17 18 19 20 21 22 23 24 25 26 27 28 29 30 31 32 ORDINANCE NO. 626 AN URGENCY ORDINANCE OF THE CITY COUNCIL OF THE CITY OF BEAUMONT, CALIFORNIA, AMENDING CHAPTER 13.16 OF THE BEAUMONT MUNICIPAL CODE BY ADDING TO SECTION 13.16.080 A NEW St11SECTION E TO PROVIDE FOR A ONE MEMBER COMMISSION WHEN INSUFFICIENT MEMBERS ARE AVAILABLE TO FORM A COMMISSION WHEREAS, a petition has been submitted requesting a hearing before the Mobile Home Rent Review Commission pursuant to Municipal Code Chapter 13.16, and WHEREAS, the City has published public notice requesting applications for membership on said commission and the members of the City Council have personally, without success, attempted to recruit individuals to serve on said commission, and WHEREAS, it is urgent that the rights of mobile home park owners and residents under said Chapter 13.16 be protected in a timely manner. THEREFORE, IT IS HEREBY ORDAINED by the City Council of the City of Beaumont as follows: SECTION I: That this ordinance is adopted for the immediate preservation of the public peace, health and safety. SECTION II: That there is added to the Beaumont Municipal Code Chapter 13.16 section 13.16.080 a new subsection E at the end thereof, which shall read as follows: 13.16.080 E. In the event that there are, at the time a petition is filed and for fifteen days thereafter, insufficient applicants to create the commission or if among commission members and alternates there are insufficient members who are neither park owers nor mobile home residents of the affected park, the City Manager after consultation with the administrative officer, shall appoint from the list of judicial arbitrators available for judicial arbitration in the Superior Court of Riverside County a mediator, who is not a resident of Beaumont, who shall serve as a commission of one with all powers, duties and limitations ascribed herein to the commission. Said mediator shall be compensated at a rate (hourly or otherwise) fixed by the City Manager at the time the mediator is appointed and shall be paid pursuant to section 13.16.100B herein below.
