CALL TO ORDER AND ROLL CALL

Mayor Giles called the special meeting of the McCall City Council to order at 5:30 p.m.
Mayor Giles, Council Member Maciaszek, Council Member Nelson, Council Member
Nielsen, and Council Member Thrower all answered roll call.
City staff members present were Anette Spickard, City Manager; Bill Punkoney, City Attorney;
BessieJo Wagner, City Clerk; Sarah Porter, Deputy Clerk; Linda Stokes, City Treasurer; Brian
Parker, City Planner; Chris Curtin, Information Systems Manager; Nathan Stewart, Public Works
Director; Sean Reilly, Network Administrator; Meredith Todd, Assistant City Planner.
Fire District Board and Staff present were Garret DeJong, McCall Fire Protection District Chief;
Sadie Noah, McCall Fire Protection District Chair; Jeremy Olson, McCall Fire Protection District
Commissioner; Nick Erekson, McCall Fire Protection District Commissioner; Bill Gigray, McCall
Fire Protection District Attorney.

AB 23-182 Request to Adopt Resolution 23-20 approving State and Local Agreement
Addendum KN 22950 with Idaho Transportation Department for Transportation
Alternatives Grant (TAP) Design and Construction
Public Works Director Nathan Stewart presented to the City Council. The City of McCall was
awarded a $551,000 Transportation Alternatives Program grant to support construction of
pedestrian (sidewalk, curb, and gutter) and streetscape (trees and light pole bases) improvements

along 1st Street between E. Lake Street (SH55) and Park Street as part of Phase 3B of the City's
downtown core reconstruction project. These federal funds require a local match share of at least
7.34% (approx. $40,311). The original State and Local Agreement for this grant project was
approved by City Council in December 2021. The Addendum to the original State and Local
Agreement (SLA) stipulates the roles and responsibilities for both the grant agency (LHTAC/ITD)
and the City now that final engineering design has been completed and a final engineer's
construction estimate has been approved by LHTAC/ITD. This SLA will cover the construction
phase of the project. This agreement has been reviewed by the Public Works Director and the City
Attorney. LHTAC/ITD has requested return of this signed agreement no later than September 8,
2023. Approving this resolution and associated SLA Addendum will allow LHTAC/ITD to secure
the necessary funding so that bidding can commence early this Fall 2023 to ensure the most
competitive bidding environment.
The City Council had no questions regarding the adoption of Resolution 23-20.
Council Member Nelson moved to adopt Resolution 23-20 approving the Addendum to
State/Local Agreement for TAP Grant KN 22950, 1st Street, Phase 3B Surface
Improvements, between the City of McCall and the Idaho Transportation Department and
authorize the Mayor to sign all necessary documents. Council Member Maciaszek seconded
the motion. In a roll call vote, Council Member Nelson, Council Member Maciaszek, Mayor
Giles, Council Member Nielsen, and Council Member Thrower all voted aye, and the motion
carried.
JOINT MEETING WITH MCCALL FIRE PROTECTION DISTRICT DEVELOMENT
IMPACT FEES
City Clerk BessieJo Wagner reviewed the meeting posting and public hearing publication dates.
The agenda was posted online and at City Hall on September 1, 2023, and it stated the time, place,
and contents of the meeting. A legal ad for the public hearing notices was placed in the Star News
in both the August 10, 2023, and August 17, 2023, publications. Additionally, although not legally
required, a display ad of the agenda ran in the September 7, 2023, publication of the star news.
McCall Fire Protection District Chief Garret DeJong noted that the meeting agenda for the district
was posted on September 4, 2023 at the fire station and online.
Chairman Noah called the special meeting of the McCall Fire Protection District Board of
Commissioners to order at 5:38 p.m. Chairman Noah, Commissioner Erekson and
Commissioner Olson were all in attendance.
Commissioner Erekson made a motion to approve the agenda as posted. In a voice vote, all
Commissioners voted aye, and the motion carried. The City Council held a voice vote to
approve the agenda as posted. All voted aye and the motion carried.
Council Member Maciaszek moved to authorize Mayor Giles to conduct the joint meeting.
Commissioner Erekson seconded. In a voice vote, all voted aye, and the motion carried.

JOINT PUBLIC HEARINGS 1 & 2

Council Member Nielsen moved to open hearings 1 & 2. Commissioner Erekson seconded
the motion. In a voice vote, all voted aye, and the motion carried.
McCall Fire Protection District Chief Garrett DeJong presented to the City Council and the
McCall Fire Protection District Board of Commissioners (Commissioners). Chief DeJong gave
an overview of the process the Commissioners have gone through prior to the public hearing.
The City Council and the Commissioners had no questions regarding the consideration a
resolution to adopt the McCall Fire Protection District Impact Fee Study and Capital
Improvement Plan Final Report — June 2022 and to impose by City Ordinance, pursuant to an
intergovernmental agreement new development impact fees.
Hearings 1&2: Conduct the following joint City Council and Fire District Board of
Commissioners combined public hearings to receive comments regarding the City Council's and
the Fire District Board of Commissioner's intent to each consider:
• a resolution adopting the McCall Fire Protection District Impact Fee Study and Capital
Improvement Plan Final Report — June 2022 (the Capital Improvements Plan"); and
• to impose by City ordinance, pursuant to intergovernmental agreement, the below
described new development impact fees:
A. New fee summary — City of McCall: The City Council and the Fire District Board of
Commissioners intend to establish the following new Fire District Development Impact
Fees within the boundaries of the City of McCall, all of which lies within the
boundaries of the McCall Fire Protection District:

Mayor Giles called for Public Comment at 5:49 pm

In response to the written comment Chief DeJong went over the options to address the cost of
impact fees for affordable housing developments. Council Member Nelson asked if there was a
defmition of affordable housing and how it is decided that the development is affordable housing,
and the fees should be waived. Chairman Noah reviewed the information that came up during the
commissioner's process to establish impact fees before the public hearing and how the fees are
determined to be waived. Affordability and deed restriction are not stipulations to waiving the
impact fee. The waiver is not a complete waiver, and the money still needs to be paid from a
different source. Attorney Gigray noted that the definition of affordable housing is not addressed

specifically in the Ordinance and will be addressed in a public policy which supports the exemption
of the impact fees for affordable housing developments.
Council Member Nelson moved to close the public hearings 1 & 2. Council Member
Maciaszek seconded the motion. In a voice vote, all voted aye, and the motion carried.
CITY COUNCIL PUBLIC HEARINGS 3 & 4
Council Member Nielsen moved to open the public hearings 3 &4. Commissioner Erekson
seconded the motion. In a voice vote, all voted aye, and the motion carried.
Chief DeJong presented to the City Council and Commissioners with an explanation of how the
fire district can collect fees through a City Ordinance and the need to amend the City
comprehensive plan.
Hearings 3&4: Conduct the following City Council combined public hearings to receive
comments regarding the City Council's intent:
• To consider an amendment to The City of McCall In Motion 2018 McCall Area
Comprehensive Plan by the amendment of the Public Facilities, Utilities, and Services,
Goals + Policies of the Comprehensive Plan by the addition of a new Goal 8 and Policy
8.1 for the purpose of enacting an ordinance and entering into the intergovernmental
agreement with the McCall Fire Protection District for the collection and expenditure of
development impact fees for the Fire District's systems improvements as identified in the
McCall Fire Protection District Impact Fee Study and Capital Improvement Plan Final
Report — June 2022 ( the "Capital Improvements Plan") to be appended to the
Comprehensive Plan as Appendix A.
• To consider the adoption of the McCall Fire Protection District Development Impact Fee
Ordinance for the purpose of imposing development impact fees for the Fire District's
systems improvements as identified in the Capital Improvements Plan.
Council Member Nelson moved to close the public hearings 3 &4. Council Member Nielsen
seconded the motion. In a voice vote, all voted aye, and the motion carried.
NEW BUSINESS AGENDA CITY COUNCIL
Request to adopt Resolution 23-17 of The City Council of The City Of McCall for the Purpose
of Approving The McCall Fire Protection District Capital Improvements Plan McCall
Fire Protection District Impact Fee study and Capital Improvement Plan Final Report
— June, 2022; Directing the City Clerk; and Setting an Effective Date.
The City Council had no questions regarding Resolution 23-17.
Council Member Maciaszek moved to adopt Resolution 23-17 of The City Council of The
City of McCall for the Purpose of Approving the McCall Fire Protection District Capital

Member Nielsen, Mayor Giles, Council Member Nelson, and Council Member Thrower all
voted aye, and the motion carried.
Request to adopt Resolution 23-19 of The Citv Council Of Citv Of McCall For the purpose
of entering into the City of McCall/McCall Fire Protection District Intergovernmental
Agreement and Joint Powers Agreement for the Collection and Expenditure of
Development Impact Fees for Fire District Systems Improvements by and between the
City of McCall and the McCall Fire Protection District for the collection and
expending of development impact fees for the Fire District's systems improvements
as identified in the Capital Improvements Plan.
Clerk Wagner noted changes to the resolution to include that there would be no fee imposed on
the District by the City to collect the impact fees and that the funds would be transferred to the
district quarterly instead of monthly. Both Attorney Punkoney and Attorney Gigray have reviewed
the resolution and agreed with the changes.
The City Council had no questions regarding Resolution 23-19.
Council Member Thrower moved to adopt Resolution 23-19 of The City Council For the
purpose of entering into the City of McCall/McCall Fire Protection District
Intergovernmental Agreement and Joint Powers Agreement for the Collection and
Expenditure of Development Impact Fees for Fire District Systems Improvements. Council
Member Maciaszek seconded the motion. In a roll call vote, Council Member Thrower,
Council Member Maciaszek, Mayor Giles, Council Member Nelson, and Council Member
Nielsen all voted aye, and the motion carried.

committees.
The City Council had no questions regarding the adoption of Ordinance No. 1019.
Council Member Nelson moved to suspend the rules and read by title only one-time only
Ordinance No. 1019 creating a New Chapter 10 Title 1 of the McCall City Code: Establishing
the development impact fee advisory committees as standing committees. Council Member
Maciaszek seconded the motion. In a roll call vote Council Member Nelson, Council Member
Maciaszek, Mayor Giles, Council Member Nielsen, and Council Member Thrower all voted
aye, and the motion carried.

Protection District consider a motion to enter into City of McCall/McCall Fire
Protection District Intergovernmental Agreement and Joint Powers Agreement for the
Collection and Expenditure of Development Impact Fees for Fire District Systems
Improvements by and between the City of McCall and the McCall Fire Protection
District for the collection and expending of development impact fees for the Fire
District's systems improvements as identified in the Capital Improvements Plan.

Commissioner Erekson moved to adopt Resolution 2023-7. Commissioner Olson seconded
the motion. In a voice vote all voted aye, and the motion carried.
Request to adopt Resolution 2023-8 of the Board of Commissioners of the McCall Fire
Protection District consider a motion to approve and adopt the new Title 24 Policy Code
Impact Fee Administrative Policy.
Commissioner Erekson moved to approve Resolution 2023-8 approving the new Title 24
policy code impact fee, administrative policy. Commissioner Olson seconded the motion. In
a voice vote, all voted aye, and the motion carried.
The City Council and the Commission provided compliments to one another on maintaining a
positive working relationship.
