Tybee Island, Georgia
February 7, 1979
A special called meeting of the Tybee Island City Council was held
at 7:00 p.m. on Wednesday, February 7, 1979 at the City Hall. This special meeting
was called for the signing of a Resolution accepting a grant from the Georgia
Department of Natural Resources for the public safety /bathhouse facility, and for
other purposes.
Mayor M. J. Counihan presided, and the following members of Council
were present: Nick C. Alexander, Jerome Bettencourt, Karen Losey, Edward Jung,
Jack Owen and William C. Fleetwood. W. Lance Smith, the City Attorney, was also
present.
A report on the status of the negotiations for a cable television
franchise was made by the City Attorney. After discussion, Council decided that
the franchise will be approved if it includes other services offered by the cable
television company, such as burglar and fire alarm systems. The City Attorney was
instructed to notify Mr. Steele, who represents the company, that the contract is
nearing completion and should be ready for signing in the near future. After signing
of the contract the company will have ninety days in which to begin the work.
The City Attorney read a letter from Mr. Burt Weerts of the State
Department of Natural Resources. He then read the proposed contract. After dis-
cussion Councilman Alexander moved to approve the contract, Councilwoman Losey
seconded, and the contract was approved by unanimous vote of Council.
The Resolution was then read, as follows:
WHEREAS, AT THE SPECIAL CALLED MEETING OF THE CITY COUNCIL OF THE CITY OF TYBEE
ISLAND, CHATHAM COUNTY, GEORGIA, HELD ON FEBRUARY 7, 1979, A MOTION WAS MADE AND
DULY SECONDED THAT THE CITY OF TYBEE ISLAND AGREE TO THE TERMS OF A CONTRACT BETWEEN
THE GEORGIA DEPARTMENT OF NATURAL RESOURCES AND THE CITY OF TYBEE ISLAND AUTHORIZING
THE MAYOR TO EXECUTE SAID CONTRACT ON BEHALF OF THE CITY OF TYBEE ISLAND AND ACCEPT
THE GRANT PROVIDED FOR IN SAID CONTRACT IN THE AMOUNT OF $62,500.00. NOW THEREFORE,
BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF TYBEE ISLAND, CHATHAM COUNTY, GEORGIA,
THAT THE TERMS AND CONDITIONS OF THE CONTRACT BETWEEN THE GEORGIA DEPARTMENT OF
NATURAL RESOURCES AND THE CITY OF TYBEE ISLAND AND THE GRANT PROVIDED FOR IN SAID

CONTRACT IN THE AMOUNT OF $62,500.00 IS HEREBY ACCEPTED TO BE USED UNDER THE TERMS
AND CONDITIONS OF SAID CONTRACT, INCLUDING BUT NOT LIMITED TO THE PROVISION REQUIRING
THE CITY OF TYBEE ISLAND TO CERTIFY AND ASSURE IT HAS THE ABILITY AND INTENTION TO
FINANCE $62,500.00 OF THE COST FOR THE PROJECT AND THAT SUFFICIENT FUNDS HAVE BEEN
DESIGNATED TO ASSURE THE ACQUISITION AND /OR DEVELOPMENT, OPERATION AND MAINTENANCE
OF THE FACILITIES IDENTIFIED IN SAID CONTRACT. READ AND UNANIMOUSLY ADOPTED IN THE
SPECIAL CALLED MEETING OF THE CITY OF TYBEE ISLAND HELD ON FEBRUARY 7, 1979.
After the reading of the Resolution, a motion to adopt was made by
Councilman Fleetwood and seconded by Councilman Jung. The vote was unanimously in
favor of the Resolution, and the Councilmen each signed it.
Information concerning a claim for damages to an automobile made by
Ms. Linda Williamson was given to Council. After discussion the City Attorney ad-
vised that the claim should be denied. Councilman Fleetwood moved that the claim
be denied and the motion was seconded by Councilman Bettencourt. The motion carried
unanimously.
Discussion of the Resolution requesting state aid for emergency funds
for lifeguards which was passed at the regular meeting in January, followed. It
was decided that our State Representative, Bobby Phillips, be contacted and asked
to proceed with this request as soon as possible.
There being no further business, the meeting was adjourned.
