Tybee Island, Georgia
May 9, 1979
A regular meeting of the Tybee Island City Council was held
at 3:30 p.m. on Wednesday, May 9, 1979 at the Tybee Island City Hall.
Mayor M. J. Counihan presided and the following members of Council were
present: Nick C. Alexander, Jerome Bettencourt, Edward Jung, Jack Owen
and William C. Fleetwood. Mrs. Karen Losey was absent due to illness.
W. Lance Smith was also present.
Mayor Counihan invited visitors to speak and Mr. Matthew
Doyle was first to come forward. He asked that Council re- consider the
ruling that water accounts were not to be placed in tenants names. He
states that this is a hardship for out -of -town owners who rent or lease
property. This will be checked into.
William Whalen protested his water bill. The Mayor turned
this matter over to the water -sewer committee.
George Rentiers, President of the Tybee Island Jaycees, appeared
to ask the status of the ballfield lighting project. Mr. Bettencourt
replied that an architect had been consulted and had presented a contract
and he hoped to be able to begin actual construction in the near future.
Mr. Orville Rosen asked Council how Mrs. Karen Losey is pro-
gressing, and expressed the concern of many people. Mayor Counihan gave
information on the state of Mrs. Losey's health, and expressed his hopes
that her condition will improve.
Mr. Don Howard protested being billed $25.00 for a license to
use his filling station restroom as a dressing room. He stated that the

sign charging for the use of the restroom had been there since the previous
owner and that he was not in the habit of charging for use of the restroom.
It was agreed that he would not have to pay the business license if he re-
moved the sign and did not charge people for using his restroom. Mr. Howard
also stated that he feels paying a street maintenance decal and a license
for operating a wrecker is not fair.
The meeting was opened for business legally presented. The first
item on the agenda was a quit claim deed for Don C. Wahl. Mr. Wahl was
represented by Mr. John Hendrix, an attorney. There was a great deal of
discussion of the location of the property, known as PIN Number 4- 05- 14 -OO1A
because it was originally intended to be a part of a city street which has
never been opened to its full length. Mr. Fleetwood moved that the city
accept $2,000 for its possible claim to the property, and Councilman Owen
seconded. The motion was passed, with Councilman Bettencourt dissenting.
Councilman Bettencourt presented an architectual contract from
Hansen for drawing plans for ballfield lighting at Jaycee Park. Councilman
Fleetwood amended the motion to read that the contract exclude bleachers
and fencing. After discussion, Councilman Owen seconded the motion and it
passed unanimously.
The Clerk presented several business license applications to the
Council: Unanimous approval was given to grant licenses to the following
businesses: Mo -Ped, Tybee Hot Dogs, Tiki Lounge.
Councilman Fleetwood stated to Council that several individuals
had approached city officials to ask about the concession rights at the
North End parking lot. He stated that the city owns an old stand at that
location which could be renovated and that he feels the city should lease
the franchise rights with the tenant doing the renovation. Councilman

Fleetwood then moved that a franchise agreement for North End concessions
be granted and Councilman Owen seconded. Council voted unanimously in favor,
and the Mayor will grant a franchise for this service.
An announcement was made that a Police Study Committee is being
formed to study possible consolidation of police forces of cities and county.
Councilman Bettencourt moved that Councilman Jung be appointed as Tybee
Island's representative on this committee, and Councilman Alexander seconded.
The motion passed by a vote of four (4) to one(1) with Councilman Fleetwood
opposing.
Mrs. Wilma McCusker approached Council with a plan to trade some
of the old Tybrisa Property, which she owns, for a like section of nearby
property. She states that the location of the public safety /bathhouse has
lowered the value of her property and that she needs oceanfront access in
order to develop it. She then introduced Mr. Denney who showed Council
some sketches of a possible townhouse development in the vicinity of the
public parking lot. Council will study the plan presented by Mrs. McCusker.
A letter from Councilman Owen requesting a three month leave of
absence was presented to Council. Councilman Owen stated that he has the
opportunity to go to South America as a consultant for approximately three
months and would appreciate the leave of absence. Councilman Alexander
moved that it be granted, Councilman Bettencourt seconded and the motion
passed unanimously.
Mayor Counihan stated that there has been extensive news coverage
concerning the North End parking lot being filled before Noon on weekends,
and that more parking is needed. Councilman Bettencourt asked if the public
parking lot could be extended between 14th Street and 13th Street. The City
Attorney answered that it can not, as the city does not own the property.

Bills for the month of April were approved as follows: for
General Government - $1,391.17, Sewer Department - $3,235.49, Water
Department - $1,664.43, Parking Meter Department - $514.15, Police
Department - $1,643.38, Fire Department - $262.40, Recreation Department -
$145.65, Ceramics - $169.31, Sanitation Department - $781.42, and Public
Works - $4,380.14. Also approved were Capital Outlay expense of $3,923.80
and Other Expenses totalling $49.00.
Mayor Counihan asked that all stand and pray silently for
Councilwoman Karen Losey who is very ill.
There being no further business the meeting was adjourned until
the next regular or special called meeting.

QUITCLAIM DEED
This Quitclaim Deed, made this LJ day of /if
1979, by the Mayor and City Council of the City of Savannah Beach,
County of Chatham, State of Georgia, to DON C. WAHL of the City
of Savannah Beach, County of Chatham, State of Georgia.
W I T N E S S E T H:
That Mayor and City Council of the City of Savannah Beach,
in consideration of the sum of One Dollar ($1.00) to them paid;
the receipt of which is hereby acknowledged, does by these presents
remise, release, and forever quitclaim and abandon unto DON C.
WAIIL all of the interest of the City of Savannah Beach, the Mayor
and City Council in and to that certain real property located in
the County of Chatham, State of Georgia, and more particularly
described as follows:
ALL of that certain lot, tract or parcel of land
lying and being in the Town of Savannah Beach, Georgia,
Ward Two (2), Tybee Island, Chatham County, Georgia, .
and being a portion of Fifth Avenue and being'more
particularly described as follows: Commencing at the
southwestern corner of the intersection of Miller Avenue
with Sixth Street and proceeding along the Southern
boundary line of Sixth Street a distance of 225 feet
to a point being the Northeastern corner of said lot
and also the point of beginning; thence-South along the
Eastern boundary line of the unused portion of Fifth
Avenue a distance of 150 feet, the same being the
dividing line between said unused portion of Fifth

Council of the City of Tybee Island that the Mayor is authorized
to sign, and the City Clerk is authorized to attest a Quit
Claim Deed conveying the interest of the City of Tybee Island
in that certain real property described in Exhibit "A"
attached hereto.
RESOLUTION OF THE CITY COUNCIL
OF THE CITY OF TYBEE ISLAND DECLARING
ITS INTENTION TO QUIT- CLAIM CERTAIN
UNUSED PORTIONS OF FIFTH AVENUE IN THE
CITY OF TYBEE ISLAND, GEORGIA
The City Council of the City of Tybee Island, Georgia,
does resolve as follows:
SECTION ONE
WHEREAS, it appearing to the City Council of the City
of Savannah Beach that the Tybee Beach Company conveyed to
the Tom of Savannah Beach by Warranty Deed on April 29,
1932, title to all of the streets within the corporate
limits of the Town of Savannah Beach as shown on a map by
Percy Sugden dated July 20, 1928, anal it further appearing
that Fifth Avenue was part of this conveyance and it
further appearing that a portion of Fifth Avenue has never
been used by the City of Savannah Beach nor has the unused
portion been dedicated to public use, and;
WHEREAS, Tybee Beach Company quit - claimed its interest
in said undedicated portions of Fifth Avenue to certain
property holders in the City of Savannah Beach and it
further appearing that said lots and in particular the lot
which is described herein on Exhibit "A" were undedicated
and abandoned having never been used by the City of Savannah
Beach and;
WHEREAS, the Commissioners of Chatham County have
designaLed the herein described property with a property
identification number of 4- 0005- 14 -OO1A and that taxes
on said property, which include a portion of Fifth Avenue,
have been paid to the Chatham County Tax Commissioner and
the Town of Tybee Island for the period of many years, and;
WHEREAS, the City of Tybee Island has never used said
portion of Fifth Avenue as a street and;
: WHEREAS, the portion of Fifth Avenue as set out herein
,ihe'l deeded to the City of Tybee Island consisted of marshland
and still consists of marshland except for said portion
described herein and that in accordance with the laws of
the State of Georgia said marshland is property of the State
of Georgia and not available for use by the City of,Tybee
Island as a road, and;
WHEREAS, said land herein described is taxed by the
City of Tybee Island and produces revenue for the City of
Tybee Island and would be non - productive and non - revenue
producing if owned by the City of Tybee Island; and
WHEREAS, it is in the public interest of the City of
Tybee Island that said unused portion of Fifth Avenue not be
used or maintained as a.public street but remain as revenue
producing property;
SECTION TWO
NOW THEREFORE, in consideration of the payment of real
property taxes past, present and future and the sum of One
($1.00) Dollar in hand paid, it is resolved by the City

Eastern boundary of the unused portion of Fifth venue
and parallel to the Southern boundary of Sixth Str r-:•L
a distance of 60 feet to a point where the foregoing
perpendicular line intersects the,Western boundary line
of the unused portion of Fifth Avenue; thence Ncrthwardly
along the Western boundary -line of the unused portion
of Fifth Avenue a distance of 150 feet to the inter-
section of the Western boundary of the unused portion
of Fifth Avenue and the Southern boundary of Sixth
Street; thence Eastwardly a distance of 60 feet long
the Southern boundary line of Sixth Street to the
point of beginning. Said unused portion of Fifth
Avenue has a frontage of 60 feet on the Southern
boundary of Sixth Street and a rectangular depth
of 150 feet. Said portion of Fifth Avenue being
a portion of that certain lot identified on the
tax maps of Chatham County by property identifi-
cation number 4- 0005- 14 -OO1A.
TO HAVE AND TO HOLD, all and singularly the premises,
together with the tenements, hereditaments, and appurtenances
thereunto belonging, or in any way ascertaining, unto DON C.
WAHL, his heirs and assigns forever.
IN WITNESS WHEREOF, the Mayor and City Council of
Tybee Island have hereunto set their hands and seals on the
day first above written.
