PLEDGE OF ALLEGIANCE PRAYER BY COUNCILOR PAPPIN President Pappin presided and the following business was conducted: ROLL CALL Councilors present were Howard "Jack" Elstro, Etta Lundy, Bruce Wissel, Karl Sharp, Bing Welch, Larry Parker, Al Glover, Gil Klose and Diana Pappin. Also present were Richmond High School students Katy Gibson and Derrick Horn; Centerville High School student Brian Koester and Rory Deacon of Vincinnes University. APPROVAL OF MINUTES Councilor Welch moved to approve the minutes of the meeting of July 2, 2007, with a second by Councilor Parker. Upon a vote viva voce, the motion passed. PRESENTATIONS, MEMORIALS OR REMONSTRANCES, PETITIONS AND INTRODUCTIONS, MOTIONS, RESOLUTIONS RESOLUTION NO. 7 -2007 - A RESOLUTION ALLOWING A LATE FILED STATEMENT OF BENEFITS FORM FOR A TAX ABATEMENT FOR SUNCALL AMERICA INCORPORATED - ADI The Clerk read Resolution No. 7 -2007 by title only This Resolution would allow Suncall America Incorporated — ADI to file a late Statement of Benefits form and Council to consider Ordinance No. 41 -2007 which is a request for a ten -year tax abatement for equipment valued at $1,697,600. The Tax Abatement Committee recommended approval. Councilor Wissel moved to adopt Resolution No. 7 -2007 with a second by Councilor Parker. Upon a vote viva voce, the motion passed. RESOLUTION NO. 8 -2007 - A RESOLUTION ALLOWING A LATE FILED STATEMENT OF BENEFITS FORM FOR A TAX ABATEMENT FOR SUNCALL AMERICA INCORPORATED The Clerk read Resolution No. 8 -2007 by title only This Resolution would allow Suncall America Incorporated to file a late Statement of Benefits form and Council to consider Ordinance No. 42 -2007 which is a request for a ten -year tax abatement for real estate valued at $1,482,000. The Tax Abatement Committee recommended approval. Councilor Wissel moved to adopt Resolution No. 7 -2007 with a second by Councilor Parker. Upon a vote viva voce, the motion passed. COMMUNICATION FROM THE MAYOR ■ The Citizens Academy program will be expanded to include the Departments of Municipal Government. ■ The 211 Call Center for a four - county area is waiting for state approval. ■ Many thanks to the Citizens of Richmond for their help in preparing for the site visit from the Presidential Debate Committee. REPORT FROM BOARD OF PUBLIC WORKS AND SAFETY Minutes of the June 28 & July 5, 2007 meetings were accepted as presented. REPORTS FROM DEPARTMENT HEADS - None REPORTS FROM STANDING COMMITTEES - None REPORTS FROM SPECIAL COMMITTEES - None REPORTS FROM ORGANIZATIONS - None MISCELLANEOUS BUSINESS - None ORDINANCES ON FIRST READING Councilor Elstro moved to suspend the rules and read Ordinance Nos. 41, 42, 44, 51, 52 & 53 -2007 on first reading by title only with a second by Councilor Lundy. Upon a vote viva voce, the motion passed. ORDINANCE NO. 41 -2007 — A SPECIAL ORDINANCE AUTHORIZING THE APPROVAL OF A STATEMENT OF BENEFITS FOR A PROPERTY OWNER APPLYING FOR DEDUCTIONS UNDER I.C. 6 -1.1 -12.1 (Suncall America) The Clerk read Ordinance No. 41- 2007 on first reading by title only. This Ordinance is a request by Suncall America Incorporated — ADI for a ten -year tax abatement for equipment valued at $1,697,600. Due to the fact the life of the equipment listed in the tax abatement request was six and eight years, Councilor Wissel moved to amend the Ordinance to a seven -year tax abatement with a second by Councilor Parker. Upon a vote viva voce, the motion passed. The Tax Abatement Committee recommended approval of Ordinance No. 41 -2007 as amended. Councilor Welch moved to advance Ordinance No. 41 -2007 to second reading and to suspend the rules and read by title only with a second by Councilor Parker. Upon a vote viva voce, the motion passed. The Clerk read Ordinance No. 41 -2007 on second reading by title only. Council President Pappin declared Ordinance No. 41 -2007 on second reading and public hearing. There being no comments for or against the Ordinance, Councilor Parker moved for engrossment of Ordinance No. 41 -2007 with a second by Councilor Welch. Upon a vote viva voce, the motion passed. Councilor Lundy moved to advance Ordinance No. 41 -2007 to third and final reading and suspend the rules and read by title only with a second by Councilor Elstro. Upon a vote viva voce, the motion passed. The Clerk read Ordinance No. 41 -2007 on third reading by title only. Ordinance No. 41 -2007 was adopted with a 9 -0 roll call vote. ORDINANCE NO. 44 -2007 — A SPECIAL ORDINANCE AMENDING THE ZONING MAP FOR A CERTAIN PARCEL FROM R -3 ONE TO EIGHT FAMILY RESIDENCE DISTRICT TO R -3 SPECIAL USE DISTRICT (2035 East Main Street) The Clerk read Ordinance No. 44- 2007 on first reading by title only. This Ordinance is a petition to rezone the property at 2035 East Main Street from R -3 One to eight Family Residence District to R -3 Special Use District to allow the owner to develop the property as a weekend retreat lodging center in the manner of a bed & breakfast. Ordinance No. 44 -2007 was referred to the Plan Commission for public hearing on July 26, 2007. ORDINANCE NO. 51 -2007 — A GENERAL ORDINANCE PROVIDING FOR THE REMOVAL, STORAGE AND DISPOSAL OF ABANDONED VEHICLES WITHIN THE CITY OF RICHMOND BY IMPLEMENTING CERTAIN PROVISIONS OF IC 9- 22 -1 -13 The Clerk read Ordinance No. 51- 2007 on first reading by title only This Ordinance would amend Section 94.10 and add Section 94.15 to the Municipal Code. These Sections relate to the removal and disposition of abandoned vehicles in the City. Councilor Parker moved to amend Section 94.15 (b) by adding ... and after the assessment performed by the Richmond Police Department. There was a second by Councilor Welch. Upon a vote viva voce, the motion passed. After much discussion, Ordinance No. 51 -2007 was held on first reading to allow additional time for review by the Department of Law. ORDINANCE NO. 52 -2007 — A GENERAL ORDINANCE AMENDING CURFEWS IN SECTION 130:09 OF THE CITY OF RICHMOND CODE The Clerk read Ordinance No. 52- 2007 on first reading by title only. This Ordinance relates to curfew times. The language was updated for consistency with current Indiana Code and for the addition of a penalty section. Councilor Wissel moved to advance Ordinance No. 52 -2007 to second reading and to suspend the rules and read by title only with a second by Councilor Welch. Upon a vote viva voce, the motion passed. The Clerk read Ordinance No. 52 -2007 on second reading by title only. Council President Pappin declared Ordinance No. 52 -2007 on second reading and public hearing. Speaking in favor was Allen Williams of Wayne PAC. Upon a vote viva voce, the motion passed. Councilor Welch moved to advance Ordinance No. 52 -2007 to third and final reading and suspend the rules and read by title only with a second by Councilor Sharp. Upon a vote viva voce, the motion passed. The Clerk read Ordinance No. 52 -2007 on third reading by title only. Ordinance No. 52 -2007 was adopted with a 9 -0 roll call vote. ORDINANCE NO. 53 -2007 — AN ORDINANCE OF THE CITY OF RICHMOND, AUTHORIZING THE EXECUTION AND DELIVERY OF THE SECOND AMENDATORY AGREEMENT TO THE POWER SALES CONTRACT BETWEEN INDIANA MUNICIPAL POWER AGENCY AND THE CITY OF RICHMOND AND OTHER MATTERS CONNECTED THEREWITH The Clerk read Ordinance No. 53- 2007 on first reading by title only This Ordinance would allow the City of Richmond to enter into an amended agreement with the Indiana Municipal Power Agency to establish a term ending April 1, 2042. This would allow the Agency to issue new debt with a long -term amortization that would extend beyond the current term of the Power Sales Contract. Councilor Welch moved to amend Ordinance No. 53 -2007, page 2, second WHEREAS to indicate the date of July 16 with a second by Councilor Parker. Upon a vote viva voce, the motion passed. Councilor Welch moved to advance Ordinance No. 53 -2007 to second reading and to suspend the rules and read by title only with a second by Councilor Parker. Upon a vote viva voce, the motion passed. This Ordinance is a request by Bev's Threads Etc., LLC /Theo. Tiedermann & Sons Inc. for a ten -year tax abatement on real estate valued at $3,000,000. Councilor Wissel moved to table Ordinance No. 37 -2007 until further notice with a second by Councilor Welch. Upon a vote viva voce, the motion passed. ORDINANCE NO. 38 -2007 — A SPECIAL ORDINANCE AUTHORIZING THE APPROVAL OF A STATEMENT OF BENEFITS FOR A PROPERTY OWNER APPLYING FOR DEDUCTIONS UNDER I.C. 6- 1.1- 12.1(Bev's Threads) Common Council Minutes July 16, 2007 Page 5 of 5 The Clerk read Ordinance No. 38 -2007 on second reading by title only. This Ordinance is a request by Bev's Threads Etc., LLC /Theo. Tiedermann & Sons Inc. for a five -year tax abatement on equipment valued at $35,000.00. ORDINANCE NO. 39 -2007 — A SPECIAL ORDINANCE AUTHORIZING THE APPROVAL OF A STATEMENT OF BENEFITS FOR A PROPERTY OWNER APPLYING FOR DEDUCTIONS UNDER I.C. 6-1.1-12.1 (Bev's Threads) The Clerk read Ordinance No. 39 -2007 on second reading by title only.
