CITY COUNCIL MEETING
IONA COMMUNITY CENTER
MAY 19, 2015 — 7:00 P.M.
PRESENT: Mayor Brad Andersen, Attorney Dale W. Storer, Council President Robyn Walker,
Council Member Rob Geray, Council Member Dan Gubler, Council Member Kathy McNamara,
Public Works Director Zech Prouse, Chief of Police Matt Lurker, and City Clerk Julie
Hammond.
ABSENT: Building Inspector Allen Eldridge, Treasurer Amy Sullivan and Animal Control
Officer Kayla Key.
VISITORS: Rod Gardner, Susan Gardner, LoAnn Be!nap, JoAnn S Hansen, Jerry Hansen,
Sally Price, Phillip Lerum, William Lerum, and Michelle Smoley.
Mayor Andersen welcomed everyone and Clerk Hammond led with the Pledge of Allegiance. A
roll call was taken to open the meeting.
Consent Agenda: Council Minutes of April 21, 2015 had been reviewed along with changes
from Council Member Geray. Council reviewed the finance reports for the period ending April
30, 2015 (58% of the fiscal year (FY) elapsed). The City had $1,085,699 in the bank and routine
bills had been paid. Items noted were a semi-annual payment of $3,540 to Idaho Counties Risk
Management Program and an inquiry regarding basketball background checks which come out of
the Recreation Program.
Council Member Gubler stated that impact fees (water hook-ups) were to go directly to
infrastructure and can't be used for wages according to state law. He asked that Treasurer
Sullivan clarify and show where hook-up fees are allocated.
Mayor Andersen entertained a motion. Council Member Gubler moved to approve the Consent
Agenda with noted changes. Council Member Geray seconded the motion. All were in favor,
motion carried.
Luv Em Lots Childcare — Conditional Use Permit Public Hearing: Mayor Andersen
explained the public hearing process and asked Michelle Smoley to present her application.
Michelle Smoley of 3044 Olsen Street stated that she applied for a Conditional Use Permit
(CUP) to run a small in -home daycare not a facility.
Mayor Andersen opened the public portion of the hearing; those in favor, none; neutral, none;
opposed, none. He closed the public portion of the hearing and opened Council discussion; there
was none.
Mayor Andersen entertained a motion. Council President Walker moved to approve Michelle
Smoley's, Luv Em Lots Childcare CUP Application, Exhibit "A." Council Member McNamara
seconded the motion. Luv Em Lots Childcare CUP Application was approved by roll call vote:

Council Member Gubler indicated that Bonneville County was responsible to perform fire
inspections and would be checking with Steve Serr.
Business License Approval — Michelle Smoley, DBA: Luv Em Lots Childcare: Council
Member Geray asked if Ms. Smoley had any intention of going above six children in her
daycare; she did not. There wouldn't be a Fire Code Inspection required for a daycare under six
children. The business license would ensure that it doesn't grow.
Council Member Geray moved to approve Michelle Smoley, DBA: Luv Em Lots Childcare
Business License. Council Member Gubler seconded the motion. Luv Em Lots Childcare
Business License was approved by roll call vote:

Rod & Susan Gardner — Amended Plat — Located at 5122 Owens Ave: Mr. Gardner
explained that they had the property at 5122 Owens Ave. re -platted; splitting the one lot into two,
with the intent of building a patio home on each lot. Mr. Long, neighbor to the west of the
property, had built his fence and shop on the property but they would sell him the property if the
re -plat was accepted by the City.
Contracted City Engineer, Schiess & Associates had reviewed the plat and stated that it appeared
to be an acceptable plat if the utility services can be worked out and building requirements were
met. Iona's Planning & Zoning Commission agreed and recommended approval to Council.

Council President Walker moved to approve Rod & Susan Gardner's Amended Plat, Exhibit
"B." Council Member McNamara seconded the motion. Rod & Susan Gardner's Amended Plat
was approved by roll call vote:

Rod & Susan Gardner; R&S Properties — Conditional Use Permit Public Hearing: Mayor
Andersen reminded everyone of the public hearing process and asked Mr. Gardner to explain the
application.
Rod Gardner of 2727 N Foothill Rd explained that they were applying for a CUP to allow two
patio homes (one on each lot) in an R-T Zone located at 5122 Owens Ave. He stated building
requirements would be met, each lot had over 10,000 sq ft (patio homes only require 6,500 sq ft),
and each house would have a full basement with a double car garage.

Council Member Geray moved to approve Rod & Susan Gardner's CUP Application, Exhibit
"C." Council Member Gubler seconded the motion. Rod & Susan Gardner's CUP was approved
by roll call vote:

Mr. Gardner asked if the CUP could be extended. Council Member Geray referenced City Code
11-8-7 Expiration: If the conditional use is not implemented within ninety (90) days of final
approval, such approval shall, unless prior to such expiration an extension is granted by the City
Council. Any conditional use that is not substantially used for a period of six (6) consecutive
months shall be deemed to be waived.
LoAnn Belnap — Recreation Program: Mrs. Belnap came to Council regarding the City
Basketball League. The City has a Joint Use Facility Agreement with Bonneville Joint School
District #93. Her concerns were how much Sports Director Dabell was getting paid and not
having to pay rent to the school district.
Council wasn't sure what Mrs. Belnap was looking for. She stated that there needed to be
accountability and wanted an itemized statement. Mrs. Belnap had ideas to make the program
more cost effective. She would meet with Mayor Andersen, Treasurer Sullivan, and Director
Dabell next week.
Jerry Hansen — Properties located at 49th N & 55th East and 5330 Hansen Ave: Mr. Hansen
came to Council because he was ready to build on his lots. He handed Council a new plot plan
for the property located at 49th N & 55th East.
Council stated that the plat didn't represent what Mr. Hansen was trying to accomplish and when
he had everything worked out he would need to submit it to the City Office and City Engineer.
Mr. Hansen stated he needed to build a home soon. Council could hold a special meeting if
necessary. He also asked if he needed to connect to City water; yes.
Mr. Hansen asked if he could build on his property at 5330 Hansen Ave. He would need to go
back to his engineer to make the requested change from the City Engineer, Schiess & Associates,
and have the plat signed off and recorded.
5th Grade Playground Equipment Models: Council President Walker recognized Mamie Hall
from her 5th Grade Class. Ms. Hall explained her Playground Equipment Model to Council
which had an estimated cost of $20,000.
Itinerant Merchant Application — American Promotional Events (TNT Fireworks):
Council reviewed Wade White's, DBA: American Promotional Events Itinerant Merchant
Application and felt it was unnecessary for him to have a license to hold an orientation for the
TNT Fireworks Stands in the shelters.

Council asked that Mr. White be refunded $50 for the application but to tie specific usage to the
shelter rental such as: cleaning up all garbage and placing it in the dumpsters and not to place
stakes in the ground because they would damage the sprinkler system.
Council would revisit the shelter rental agreement.
Itinerant Merchant Applications — Brady Belliston: Council reviewed Mr. Belliston's
Itinerant Merchant Application to sell snow cones in the Iona Square during baseball games.
Council Member Geray moved to approve Brady Belliston's Itinerant Merchant Application with
the following stipulations: clean up garbage and sticky residue related to the business and empty
the trash can they are using. Council Member Gubler seconded the motion. All were in favor,
motion carried.
Dog Leash Ordinance Discussion: Council discussed changing the ordinance to require dogs
on leashes in public parks during the work meeting. Attorney Storer cited Ordinance 5-4-10 B
Control of Dogs. He stated the current ordinance doesn't allow a dog to run at large; which
means they need to be on a leash. This was already covered so no action was required.
Council Member Geray indicated there were some inconsistencies in the language in sections 5-
4-10 (infraction) and 5-3-11 (misdemeanor). Attorney Storer would review and clarify the
ordinance.
Bid Opening — City of Iona 2015 Chip Sealing: Mayor Andersen opened bids received from
r4111111 contractors on the 2015 Chip Sealing which included Wilde Ave (alley), Longhurst Ave (alley)
and Olsen Street from Free all the way to 41st North. They were as follows: HK Contractors -
$39,984.00, TMC Contractors - $40,220.00.
Council Member Geray moved to accept the bid presented by HK Contractor's for $39,984.00.
Council Member Gubler seconded the motion. The 2015 Chip Sealing Bid was accepted by roll
call vote:

Approval of Personnel Policy, Vehicle Use Policy, Information Systems Policy, and
Confidentiality Policy: Council tabled the approval and would submit changes on the policies
to approve by resolution.
Solid Waste Ordinance Direction: Clerk Hammond was asked to send Solid Waste Haulers a
letter asking them to review the proposed ordinance and invite them to a Special Waste Hauler's
Meeting on Thursday, June 18, 2015 at 6:00 p.m. to discuss.
Reports
Council: Council Member McNamara asked if contracted Electrical Inspector, Brent Purcell
was licensed or if he was covered under Jane Shaw's license. Director Prouse would check with
Inspector Eldridge.

Police: Chief Lurker had 38 to 40 calls between Animal Control Officer Key, Bonneville
County, and himself. His lap top crashed and was at PC Plus. Half of his code violations have
come into compliance. His bike training with Bonneville County was rescheduled to July.
Mayor: Mayor Andersen explained to Attorney Storer that an individual at the convenience
store had indicated a City Employee and Council were on the take. Chief Lurker explained to
the individual that some would consider this as slander. The individual filed a harassment
complaint with Bonneville County against Mayor Andersen, Inspector Eldridge, and Chief
Lurker. Attorney Storer indicated there was a criminal statute for filing a false report and not to
do anything at this time.
Mayor Andersen would leave the Bonneville Metropolitan Planning Organization (BMPO) Map
in the office.
The budget process would begin next month and if anyone had anything to please speak up.
Council President Walker would like to see work done on the easements at Iona Rd and the
corner of 33`d and 55`h
Property Tax Disparity: Mayor Andersen presented a letter from Senator Brent Hill
referencing the City's letter regarding disparity in property tax burdens inside and outside of
incorporated cities. Senator Hill asked if Council would still like to meet regarding this issue.
Council asked to set up a Special Property Tax Disparity Meeting on Wednesday, June 17, 2015
at 7:00 p.m. at the Iona City Building.
Movie in the Park: Mayor Andersen and Council President Walker will take care of Movie in
the Park on Friday, May 29, 2015. The speakers would be checked on and the banner hung.
Council: Council Member Gubler was concerned about Mr. Hansen threatening the City
because he has sold his home and is ready to build but has not met his requirements.
He would contact Steve Serr with Bonneville County about them doing their job and providing
Fire Inspections to the City.

PUBLIC HEARING NOTICE
The City of Iona's Planning & Zoning Commission has scheduled a public hearing on the
evening of May 13, 2015 at 6:30 p.m. at the Iona Community Center, which is located at 3548
North Main Street, Iona, Idaho. The purpose of the hearing is to consider a Conditional Use
Permit to allow an in -home daycare located at 3044 Olsen St; owned and operated by Michelle
Smoley. A second public hearing is scheduled for the evening of May 19, 2015 at 7:15 p.m. at
the Community Center with the City Council for final review.
Written comments will be accepted up to three days prior to the hearing. The public is invited to
attend and public comment is encouraged.
Any person needing special accommodations to participate in the above noticed meeting should
contact the City Office the day before the meeting at 523-5600.

The City of Iona's Planning & Zoning Commission has scheduled a public hearing on the
evening of May 13, 2015 at the Iona Community Center, which is located at 3548 North Main
Street, Iona, Idaho. The purpose of the hearing is to consider a Conditional Use Permit allowing
for two patio homes in an R-T Zone located at 5122 Owens Ave. A second public hearing is
scheduled for the evening of May 19, 2015 at the Community Center with the City Council for
final review.
Written comments will be accepted up to three days prior to the hearing. The public is invited to
attend and public comment is encouraged.
Any person needing special accommodations to participate in the above noticed meeting should
contact the City Office the day before the meeting at 523-5600.

Conditional uses permit application for 2 Patio Homes and propose this to be a permanent permit that
will not expire and that is transferable.
1. LEGAL DESCRIPTION ENCLOSED ON A-1
2. The Current use of this property is an old home facing Owens, field facing Walker. The
properties that surround this property now are residential, to the west is a resident with several
RV trailers and a shop, to the East is a residents with empty field on the south end, to the South
a residence, and to the North residences.
3. The current zoning is RT.
4. We have a proposed plat for this property; it is split into 2 properties. We proposed that we
build a Patio Home on each of the said properties. One accessing the property from Owens
Avenue and one accessing from Walker Avenue. One lot will be approximately 10,498 square
feet and other lot is approximately 10,585 square feet; this exceeds the minimum requirements
of 6500 square feet. Each patio home will also be at least 1200 square feet excluding, garage,
basement and patio. It will also meet the requirements of 30 feet the front, 25 feet in the back
and 8 feet on each side. As stated in the code for Patio homes.
5. The effects of this conditional use would only be the increase of use by one of the Patio Homes
access the property from Walker Avenue.
6. Building 2 Patio Homes would be different from getting a business permit that can be revoked.
Once we get the permit it should not be able to be revoked or changed, and must be
transferable with the same requirements in which we are applying for at this time. Nowhere in
code does it say that a conditional use permit expires but in the application it does.
