PRESENT: Mayor Dan Gubler, Council President Rob Geray, Council Member Michael Thompson, Council Member Peter Wadsworth, Council Member Kathy McNamara, City Attorney Andrew Rawlings, Public Works Director Zech Prouse and City Clerk/Treasurer Keri West. ABSENT: None. VISITORS: Miranda Harrison, Jill Reading, Clint Reading, Ruben Estrada, Shannon Oseen, Jolyn Louk, Eric Andrus, Brandee Duncan, Sally G. Louk, J. Cutts, Celia Purcell, Heidi Reeves, Jeanne Baldwin, Afton Ferguson, Sam Ferguson, Jason Anderson, David Rafferty, Laurie Blood, Fred Blood III,Robert Koepplin,Joseph Koepplin, Shad Dunthorn and Marc Arms. Mayor Gubler welcomed everyone and Council Member Thompson led the Pledge of Allegiance. A roll call was taken by Clerk West to open the meeting. CONSENT AGENDA: City Council Work Meeting and Regular Meeting Minutes of May 19, 2021 were reviewed. Council reviewed the finance reports for the period ending May 31, 2021 (67% of the fiscal year elapsed). The City had $1,550,106.34 in the bank and routine bills had been paid, "Exhibit A". Mayor Gubler entertained a motion. Council Member Thompson made a motion to approve the consent agenda as presented. Council President Geray seconded the motion. All in favor. Motion carried. ITEMS OF BUSINESS: Public Hearing, Ordinance to Amend Iona City Code § 10-1; Iona Subdivision Ordinance, regarding plat requirements for properties adjoining new developments (Ord. 264-06-21)— Mayor Gubler stated this code amendment was brought up when he found a discrepancy in the Iona Subdivision Ordinance that required Preliminary Plats be submitted for any adjoining properties next to a development with a dead-end longer than 400 feet. He continued and stated he did not feel it was appropriate to put the burden on the adjoining property owners when their neighbors choose to develop their land. Mayor Gubler opened the Public Hearing portion of this agenda item and asked if anyone from the audience would like to address the Council in support or against this amendment. No response. Mayor Gubler closed the Public Hearing portion of this agenda item. Mayor Gubler stated the Council just discussed this amendment at the Work Meeting and asked if any Council Members desired additional discussion.No response. Mayor Gubler entertained a motion. Council Member McNamara made a motion to approve Ordinance No. 264-06-21, an Ordinance of the City of Iona, Idaho; amending Section 10-1- 17(B) of the Iona City Code; specifying conditions under which dead-end streets may exceed 400 feet in length; preserving prior ordinances in each instance; providing for severability; and IONA CITY COUNCIL REGULAR MEETING—JUNE 15, 2021 establishing an effective date. Council Member McNamara also made a motion to dispense with the rule of reading the proposed ordinance in full and on three separate occasions. Council Member Wadsworth seconded the motion. A roll call vote was taken: Council President Geray: YES Council Member Wadsworth: YES Council Member McNamara:YES Council Member Thompson: YES Public Hearing, Variance Application; Clint & Jill Reading, parking variance for 3372 N. Main Street — Clint & Jill Reading of 3388 N. Main Street approached the podium and stated they recently purchased the home at 3388 N. Main, which is next door to the old Ernie's Café. Mr.Reading stated they are intending to purchase the restaurant location but are trying to address the parking concerns. He continued and stated the lot the restaurant is on does not have any available space for parking. Mr. Reading stated they are requesting a variance to allow customers to park on the street. Council President Geray asked the total square feet of the restaurant. Mr. Reading stated the total square footage of the building is 2500 square feet. The customer square footage is approximately half that amount. Council Member McNamara asked how much seating will be available. Mr. Reading stated they will have seating for approximately 40 people. He continued and stated they will be opening a restaurant called "Jill's Chicken Shack" which will be a fast casual restaurant, serving fried chicken and sides. Mayor Gubler opened the Public Hearing portion of this agenda item and asked if anyone in the audience would like to address the Council for or against this variance. Shad Dunford of 3775 N. 55th East approached the podium and stated his support for the new restaurant. He continued and stated he does not see any problem with allowing customers to park on the street with the space that is already available. Shannon Oseen of 4930 E. Iona Road approached the podium and expressed her support for the restaurant. She stated this is something the community needs and could do well here. She also stated the central location enables a lot of customers to walk, so she does not think parking will be a major issue. Ms. Oseen continued and stated the City already allows parking on the street and doesn't see this as anything different. Ruben Astrada approached the podium and stated he owns Ray's Southern BBQ in Shelley. He stated his restaurant only has street parking and it has not caused any problems for their community. Mr. Astrada added his restaurant style is similar to Jill's Chicken Shack and the typical lunch crowd only lasts approximately 30 minutes with many customers in and out quickly. Mayor Gubler closed the Public Hearing portion of this agenda item to allow deliberation amongst the Council. He continued and stated when the restaurant was open as Ernie's Café it was always busy and most people parked on the street. Mayor Gubler stated when the improvements were done on Main Street, they added parking space in front of the restaurant. He went on to add his support for this variance. 2 IONA CITY COUNCIL REGULAR MEETING—JUNE 15, 2021 Director Prouse stated he was here when Ernie's Café was open and confirmed there was off- street parking. Director Prouse asked how many parking spaces are currently available in front of the restaurant. Mr. Reading stated they have measured enough space for 7 parking stalls directly in front of the restaurant and parallel parking on the street. Mr. Reading also stated they have talked to the owners of the adjacent corner lot to see if they could purchase or use a portion of it for parking and have not reached an agreement. However, they plan to keep trying and view the on-street parking as a temporary solution. Director Prouse asked if they have considered using the space behind their home next door as a temporary parking area. Mrs. Reading stated they will consider this if the business is too busy for the on-street parking alone. Director Prouse also stated if the restaurant is open during the winter, snow removal would be an issue with on-street parking. Mrs. Reading also stated their employees will be parking on the north side of the house and will not use any of the customer parking spaces in front of the restaurant. Council President Geray stated in the City Code it states for restaurants the requirement is one parking space per 200 square feet of floor area. He continued and stated if you consider the customer area of 1200 square feet the "floor area", this only requires 6 parking spaces. Clerk West stated she discussed this requirement with Attorney Rawlings and they determined together that since "floor area" is not defined, they considered it be the total square footage of 2500. Council President Geray then asked Attorney Rawlings if everything on the variance application was done correctly and that a variance can be considered for this situation. Attorney Rawlings read the requirements to consider a variance and confirmed this situation is eligible for consideration. Council President Geray added there were 4 additional emails received in support of this variance approval. He also stated the Planning & Zoning Commission also recommended approval of the variance to the City Council. Mayor Gubler entertained a motion. Council Member Wadsworth made a motion to approve the Variance Application for the property at 3372 N. Main Street for Clint & Jill Reading. Council Member McNamara seconded the motion. A roll call vote was taken: Council President Geray: YES Council Member Wadsworth: YES Council Member McNamara:YES Council Member Thompson: YES Mobile Food Vendor Application; Idaho Candy Kid, LLC —Celia Purcell of 3020 N. Lucina Avenue introduced herself at the podium and stated they own a business called Idaho Candy Kid and they recently opened a second food truck called `Crepes on the Sideline'. She continued and stated they have been operating the second truck for 6 weeks but would like to begin selling at the Iona City Park because her daughter plays softball there regularly. Council Member Thompson asked if this would only be active during the summer months. Ms. Purcell confirmed they would only be in Iona during the summer months. Council Member McNamara asked the type of food they would be serving. Ms. Purcell stated they sell crepes and Italian sodas. Clerk West asked if they had a specific location in mind. Ms. Purcell stated her trailer is only 11' and can fit in one parking space. However, she is concerned about drawing a crowd near a road or parking lot. She continued and stated she would prefer to set up in the park, if possible. Council President Geray asked Ms. Purcell if she has reviewed and familiarized herself with the City Code requirements for Mobile Food Vendors. Ms. Purcell confirmed. Council Member 3 IONA CITY COUNCIL REGULAR MEETING—JUNE 15, 2021 Thompson asked Director Prouse his thoughts on a trailer going in and out of the park daily. Director Prouse stated there is already a snow cone vendor at the park during the summer months, but they are not pulling a trailer in daily. He expressed concern about sprinklers in the park, but stated he is not opposed if the applicant is flexible on placement within the park. Ms. Purcell confirmed they are flexible on placement and stated the trailer weighs less than 1000 pounds. Clerk West asked Ms. Purcell if she has documentation from the health department and fire inspections. Ms. Purcell confirmed and stated she will send it to Clerk West for her records. Council Member Wadsworth asked if the City will need to provide power. Ms. Purcell stated she is willing to pay for power per day, or she can bring a quiet generator. Mayor Gubler stated he is not worried about the power. Council President Geray stated the City can keep track of the use and if there is a significant increase they can address it in the future. However, he believes it will be insignificant for the benefit it will provide the City. Bob Koepplin of 5284 E. Rockwood Avenue approached the podium and stated he lives next to the City Park and has encountered many garbage and noise problems with vendors and activities during the summer. He continued and stated he has always requested the City consider the privacy of nearby property owners when considering new activities at the City Park. Council President Geray requested Mr. Koepplin to notify the City when he has these situations so the City can hold those vendors accountable and possibly not renew their license for the following year. Mr. Koepplin recommended the City have an employee monitor the park activities and parking issues. Council Member McNamara and Mr. Koepplin discussed parking issues and his request to not have cars park in front of his house. Joseph Koepplin also of 5284 E. Rockwood Avenue approached the podium and stated he is the son of Bob Koepplin. He stated they are not opposed to snack vendors and activities in the park, they are just asking for those vendors and visitors to be good stewards of the park. Celia Purcell stated she always brings her own garbage can to use during their open hours. She also stated they paid for a quiet generator and upgraded her trailer to use mostly propane to cut down on electricity usage. She agreed that vendors should be responsible for respecting the park and nearby properties. Mayor Gubler entertained a motion. Council Member Wadsworth made a motion to approve the Mobile Food Vendor Application for Idaho Candy Kid owned by Celia Purcell for 2021, with approval to sell in the City Park with the Public Works Director's recommendation on location. Council Member McNamara seconded the motion.All in favor. Motion carried. Mobile Food Vendor Application; Holy Crepe—Jason Anderson approached the podium and stated he has a catering business to sell crepes and is planning on selling as a vendor at Iona Days. He continued and stated they just purchased a new trailer and would like the option to sell on other days throughout the year. He also stated they are currently renting a house on Dayton Street while they build a new house in Iona. Mr. Anderson stated they sell sweet and savory crepes exclusively and would be interested in selling from their driveway on Dayton. Mayor Gubler stated they would be required to follow the same vendor rules for garbage,etc. 4 IONA CITY COUNCIL REGULAR MEETING—JUNE 15, 2021 Joseph Koepplin of 5284 E. Rockwood Avenue approached the podium again and reiterated their desire for any vendors in or near the park to be respectful and good stewards of the park. Mayor Gubler entertained a motion. Council President Geray made a motion to approve the Mobile Food Vendor Application for Holy Crepe on behalf of Jason Anderson. Council Member Wadsworth seconded the motion. All in favor. Motion carried. Discussion with Iona lateral ditch users—Afton Ferguson of 3817 N. Olsen Street approached the podium and stated when the City asked for volunteers last year to help the lateral ditch users she volunteered to help. She stated she felt like last year went ok and thanked the City staff and other volunteers for their help. Mrs. Ferguson also stated there are some ditch users that have questions and she felt it would be appropriate for them to gather at a City Council Meeting to hear the same information. She encouraged ditch users to attend this meeting and to get answers to their questions regarding the schedule and other ditch related questions. Sally Louk approached the podium and stated last year's ditch season did not go well. She expressed concerns over an inconsistent schedule and miscommunication. Mrs. Louk stated she was told if they do not take the water it will flood. Director Prouse stated the concern is when it gets turned the other way, it will go over Iona Road and flood. Director Prouse stated the biggest problem he is seeing is lack of communication between ditch users. Afton Ferguson stated she spent a lot of time and worked very hard last year to understand the ditch system, set up a schedule and communicate with the other ditch users. Discussion between Mrs. Louk and Mrs. Ferguson continued regarding the schedule. Sam Ferguson approached the podium and stated the ditch users need to learn to work together for all of them to receive water. He discussed the schedule and the variables that have to be considered and adapted to each week. Mayor Gubler stated this was requested to be on a City Council agenda and asked what the purpose is to discuss this here when nothing that has been discussed has anything to do with the City. Mr. Ferguson stated Director Prouse still controls the ditch water coming in. Director Prouse stated last year the City tried turning it over to the ditch users and no one volunteered to take control and the City received significant pushback from the ditch users. Attorney Rawlings stated in Idaho Code Title 42, Chapter 13 it gives direction on Lateral Water Users Associations and their rights and responsibilities. Attorney Rawlings asked if the City is a ditch user. Director Prouse stated the City was a ditch user on this ditch at one time, but is no longer a ditch user. • Director Prouse continued and stated at one time the City used a large portion of this ditch water and took control of the scheduling and bringing the water in. However, the City no longer uses this ditch. Attorney Rawlings stated if the City is no longer using the water, they have no legal right or ability to participate in the Association. He continued and stated the only way the City could legally have anything to do with the ditch is if the Association contracted with the City. Mayor Gubler stated the City does not have the responsibility to manage the lateral ditches, despite what happened in the past. Mayor Gubler stated he would discuss this situation with Progressive Irrigation regarding the water being cut off on the weekends. Director Prouse stated Progressive Irrigation has nothing to do with the lateral ditches. He continued and stated he is the one that controls the head gate and if he allows it to stay open over a weekend without knowing 5 IONA CITY COUNCIL REGULAR MEETING—JUNE 15, 2021 someone is going to take the water, he would be responsible for any flooding and damage that causes. Mayor Gubler understood and confirmed the City cannot continue to control the water. He stated the ditch users have the responsibility to organize a hierarchy within their Association and offered them the ability to use the City Building for their meetings to get this accomplished. Brandy Duncan of 5148 E. Hansen Avenue approached the podium and thanked Director Prouse for his continued help. She also stated as the Association develops their own governance, they will need someone like Director Prouse to help them understand everything they need to know going forward. Mayor Gubler stated he has no problem with Director Prouse being used as counsel as they move forward with the Association. Mrs. Duncan asked questions regarding the waste ditches. Director Prouse stated he will meet with them separately and discuss specific information. Director Prouse offered to continue helping this summer but will no longer be involved as of next irrigation season. Bob Koepplin approached the podium and stated he has questions regarding people using water that have no water rights. Attorney Rawlings directed him back to the Idaho Code for specific information on those types of situations. John Burnham of 3786 N. Olsen Street approached the podium and stated he is on a different ditch and when someone does not take their water, it throws the schedule off for everyone on the ditch. He stated communication is essential in these situations. He did express concern over the reduced flow of water that seems to be happening more often. Director Prouse stated due to the water shortage, some agricultural land has been given higher priority, which can cause a reduced flow in these lateral ditches. Jolyn Louk of 5428 E. Rockwood Avenue approached the podium and stated the City tried to remove itself from the situation a few years ago and it turned into a nightmare for the ditch users. She continued and stated she believes this was brought up at a City Council Meeting to ensure everyone is on the same page and can get all the information in one place from Director Prouse and from the City Attorney. Approval of Standard Specifications and Drawings — Director Prouse stated these are the drawings that illustrate what is already spelled out in the City Code for swales, etc. He continued and confirmed this will supplement the Idaho Standards for Public Works Construction (ISPWC). Council President Geray expressed concern over properties that do not currently meet these standards. Attorney Rawlings stated the current residents are considered non-conforming, but new developers will be required to abide by these standards. Mayor Gubler entertained a motion. Council President Geray made a motion to approve the Standard Specifications and Drawings as outlined by the Public Works Department. Council Member Wadsworth seconded the motion. All in favor. Motion carried. STAFF REPORTS: Director Prouse stated he has nothing to report in addition to the Mayor's update on the new water tank given at the Work Meeting. Mayor Gubler informed the public the deadline goal for the new water tank to be completed is August 1, 2021. He continued and stated the well house is built and the project is right on schedule. Mayor Gubler also stated he would like to hold a small party at the water tank to celebrate its completion. 6 IONA CITY COUNCIL REGULAR MEETING—JUNE 15, 2021 Clerk West reported the City has been allocated funds from the American Rescue Plan Act in the amount of $253,168 to be received in June 2021 and another $253,168 in June 2022. She continued and stated there are specific rules on how it can be used, so the Mayor and Council have begun discussing the potential uses for the City. Clerk West also reported she will be attending the Association of Idaho Cities annual conference this week and will bring back important information for the July Council Meeting. Council Member Wadsworth and Council President Geray stated nothing to report. Council Member Thompson reported he and James West will be organizing the Iona Days 5k and 10k run this year. He continued and stated they have chosen to change the route to incorporate more of the neighborhoods. He is hopeful people at home will be able to get involved by cheering on the runners. He stated there will also be a kids' run in the park after the parade where kids will get an item to wear to signal how many laps they have completed. He requested feedback from the public with any additional ideas. Clerk West added that the City will use $5 from each run registration towards the tennis court rehab project at Iona City Park. Deputy Chris Williams stated the number of calls for service has been consistent with the same months last year. He continued and stated a problem he has seen a lot lately is minors driving ATVs without helmets. He stated he has been giving warnings thus far but will begin issuing citations. Mayor Gubler stated he has talked to Bonneville County Sheriff's Office about doing saturation patrols in the City to help crack down on speeding. Council Member McNamara stated the museum is burying a time capsule that needs to be engraved. She asked if the City would be willing to pay. Mayor Gubler approved if the engraving is less than $100. SUGGESTED AGENDA ITEMS: Council Member Wadsworth stated he has received a lot of requests for a stop sign on Olsen Street, near Steele Ave. David Louk, who works for Bonneville County Road & Bridge, stated the state law specifies you cannot use a stop sign for speed control. He also stated there are requirements for traffic studies and engineering to demand a stop sign. However, if a City independently wants to put up a stop sign and a person gets pulled over, they can fight it if no traffic studies or engineering exist. He continued and stated it creates a greater problem and affects the flow of traffic. Mayor Gubler recommended waiting to see the results of the saturation patrols before another stop sign is discussed.
