HomeMy Public PortalAboutOrdinance 679ORDINANCE NO. 679 AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF BEAUMONT, CALIFORNIA, ADDING TO TITLE 17, SECTIONS 17.20.120, 17.20.121 and 17.20.122 TO THE BEAUMONT MUNICIPAL CODE, ENTITLED "R -LM ZONE (RESIDENTIAL - LOW MEDIUM)" THE CITY COUNCIL OF THE CITY OF BEAUMONT, CALIFORNIA DOES ORDAIN AS FOLLOWS: SECTION 1: Sections 17.20.120, 17.20.121 and 17.20.122 are added to Title 17 of the Beaumont Municipal Code to read as follows: 17.20.120 R -LM ZONE (RESIDENTIAL - LOW MEDIUM - INTENT. The R -LM Zone is intended to protect established low medium density neighborhoods of multiple -family dwellings and to provide space suitable in appropriate locations for additional housing developments of this kind, such as duplexes, patio homes, garden apartments, townhouses, and similar dwellings along with appropriate community facilities. 17.20.121 PERMITTED USES. In the R -LM Zone, no building shall be erected, reconstructed or structurally altered, nor shall any building or land be used for any purposes except as hereinafter specifically provided and allowed by this Chapter. - 1.) PRINCIPAL PERMITTED USES. The following uses are permitted without requiring specific planning approval: 1. Any principal permitted use in the R -SF Zone subject to the same conditions prescribed therein. - 2.) PLOT PLAN USES. The following uses are permitted subject to the approval of a plot plan pursuant to Chapter 17.70 of this Ordinance. The plot plan approval may include conditions requiring fencing and landscaping of the parcel to assure that the use is compatible with the surrounding area. 1. Any plot plan use permitted in the R -SF Zone subject to the same conditions prescribed therein. 2. Two (2) family dwellings, multiple family dwellings, bungalow courts and apartment houses. 3. Boarding, rooming, and lodging houses. - 3.) CONDITIONAL PERMIT USES. The following uses are permitted subject to the approval of a Conditional Use Permit pursuant to Chapter 17.70 of this Ordinance. 1. Any Conditional Use permitted in the R -SF Zone subject to the same conditions prescribed therein. - 4.) PUBLIC USES. The following uses are permitted subject to the approval of a Public Use Permit pursuant to Chapter 17.70 of this Ordinance. 1. Educational institutions; 2. Churches, temples and other places of religious worship; 3. Governmental uses; 4. Any hospital or other facility that is licensed by the California Department of Public Health, or by the California Department of Mental Hygiene not including a family care, foster home or group home that serves six or fewer persons; Page 1 Ordinance 679 5. Any home or other facility for the aged or for children that is licensed by the California Department of Social Welfare or by the Riverside County Department of Public Welfare, not including a home or facility that serves six or fewer children or aged person; 6. Half way house; 7. Public utilities. 17.20.122 SITE DEVELOPMENT STANDARDS. - 1.) LOT AREA AND DIMENSIONS. Lot size shall not be less than six thousand (6,000) square feet, with a minimum average lot width of sixty (60) feet and a minimum average lot depth of one hundred (100) feet unless otherwise approved by a Conditional Use Permit. - 2.) SETBACKS AND YARD. Minimum yard requirements shall be as follows: 1. Front yard setback: twenty-five (25) feet. 2. Rear yard setback: fifteen (15) feet except that interior lots which border upon an alley may have an accessory structure used for parking provided it sets a minimum of five (5) feet off the alley line. 3. Side yard setbacks: a. Interior side yard setbacks shall be not less than five (5) feet on each side, except that on interior lots of seventy (70) feet or more in width side yard setback shall be at least ten (10) feet in width on one side. Two story residences shall have a 10 foot side yard setback regardless of parcel width. b. Corner lots shall have a street side yard of at least ten (10) feet in width. c. On blocks with no access to alley there shall be side yard setbacks of ten feet on one side. Two-story residences shall have 10 foot side yard setbacks on both sides. d. Single story residence abutting an alley shall have five (5) foot side yard setbacks. Two-story residences shall have 10 foot side yard setbacks on both side yards. e. On single dwellings without an alley access and any building over one (1) story in height shall have side yard setback of ten (10) feet on one side. Two story residences shall have 10 foot side yard setbacks on both sides. - 3.) BUILDING HEIGHT. No building in the R -LM Zone shall exceed two (2) stories or thirty-five (35) feet whichever is lesser in height. -4.) OFF STREET PARKING. Automobile storage space shall be provided as required by Chapter 17.55 of this Ordinance. - 5.) LANDSCAPING. The provisions of Chapter 17.65 of this Ordinance shall apply. - 6.) SIGNS. The provisions of Chapter 17.60 of this Ordinance shall apply. - 7.) OFF SITE IMPROVEMENTS. The provisions of Chapter 17.65 shall apply. - 8.) BUILDING AREA. When multiple units are to be built on a lot under this classification, the following rules shall apply: Page 2 Ordinance 679 1. Each unit of a group of two or more on one lot shall have a floor area of not less than the following: a. If the unit has two bedrooms, the area shall be not less than 800 square feet; b. If the unit has only one bedroom, the area shall be not less than six hundred and fifty (650) square feet; c. If the unit has only a living room -bedroom combination, the area shall be not less than five hundred (500) square feet. 2. When only a single family dwelling unit or three bedroom unit is constructed on a lot in an R - LM Zone, it shall have a floor area of not less than eleven hundred (1,100) square feet excluding garage and/or carport. -9.) DISTANCE REQUIRED BETWEEN MAIN BUILDINGS. No two- story main building shall be closer than twenty (20) feet to any other main building on the same lot and no one-story building shall be closer than ten (10) feet to any other one-story main building on the same lot. -10.) NET LOT AREA PER DWELLING UNIT. The minimum building site area shall be 5,445 square feet in area or a maximum of 8 dwelling units per acre, whichever is less providing that the lot is a minimum of 60 feet in width and the area occupied by all buildings shall not exceed seventy (70) percent of the area of such building site. Areas of the building area with slopes in excess of twelve (12%) percent shall reduce their dwelling unit density by one third (1/3) or greater. -11.) USABLE OPEN SPACE. A. DEFINITION: "Usable Open Space" means that space upon the lot or parcel to which it is appurtenant, which can be used by inhabitants of the property for outdoor living, activity and/or recreation and may include landscaping. Each linear dimension of such space shall be a minimum of six (6) feet. Balconies may be credited as "usable open space" provided they each have linear dimension of a minimum of five feet. Enclosed recreation or multi-purpose activity rooms may be credited as "usable open space". All such areas shall be readily accessible to the inhabitants of the property. "Usable open space does not include driveways, open or covered parking areas, utility space such as trash or garbage areas, or space occupied by the required front yard setback. B. FOR THE MULTIPLE UNIT ZONES the following minimum usable open space is required for: 1. Each studio apartment, two hundred sq. ft. 2. Each one -bedroom apartment, two hundred sq. ft. 3. Each two-bedroom apartment, two hundred sq. ft. plus 100 sq. ft. making a total of 300 sq. ft. 4. Each additional bedroom an additional 100 sq. ft. C. THE METHOD OF COMPUTATION of usable open space provided shall be as follows: Page 3 Ordinance 679 1. The following areas shall be computed at 1.25 times the area actually devoted to such use: a. Private patios, when directly accessible to the dwelling unit to which it is appurtenant; such patios shall be completely enclosed on all sides by a fence which is a minimum of five (5) feet in height; b. Balconies and lanais, when directly accessible to the unit to which they are appurtenant; such balconies and lanais must have a minimum dimension of five (5) feet; c. Swimming pool areas, including the hard surface deck, which normally surrounds such pools. Deck area more than 25 feet from the edge of the pool will not be counted as open space under this method; d. Indoor recration activity rooms, provided these rooms are permanently maintained for the use of tenants for various recreation activities. Such activity rooms shall not include lobbies, but may include common steam rooms, sauna baths, or the like. 2. ALL other areas meeting usable open space requirements shall be credited with the actual area (square feet) provided. 3. NO area will be considered as usable open space if it has any dimension less than six (6) feet except balconies. (Ord. 638 Sec. 5, 1987).
