HomeMy Public PortalAboutOrdinance 680ORDINANCE NO. 680 AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF BEAUMONT, CALIFORNIA, REPEALING CHAPTER 6.16 AND SECTION 6.20.110 OF THE BEAUMONT MUNICIPAL CODE AND ADDING TO THE BEAUMONT MUNICIPAL CODE CHAPTER 6.16, DEALING WITH DOGS -- LICENSES, TAGS AND FEES, AND ADDING SECTIONS 6.20.110 AND 6.24.050 BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF BEAUMONT, STATE OF CALIFORNIA, AS FOLLOWS: SECTION 1: hereby repealed. Chapter 6.16 of the Beaumont Municipal Code is SECTION 2: Chapter 6.16 is hereby added to read as follows: Sections: 6.16.010 6.16.020 6.16.030 6.16.040 6.16.050 6.16.060 6.16.070 6.16.080 6.16.090 6.16.100 6.16.110 6.16.120 Chapter 6.16 DOGS --LICENSES AND TAGS Required for certain dgos. Licenses --Fees. Exemption for Seeing Eye dogs. Expiration date. Penalty fee for deilnquent renewal. Tags furnished by collector --Contents. Transfer of license and license tag. County license --Temporary nonresidents valid. Duplicate tags. Use of tags other than those provided in this Chapter. Unathorized removal of tags --Collars. License fee --Senior citizens. 6.16.010 Required for certain dogs. All dogs over the age of four (4) months shall be licensed in accordance with the requirements of Sections 6.08.060 through 6.08.090 and Chapters 6.12 through 6.20. 6.16.020 Licenses --Fees. Every person owning or harboring a dog over the age of four (4) months shall pay to the license collector or other proper official a license fee in the amount set by resolution of the City Council for the annual dog license fee for a one-year license. If application for a first-time license is made after December 31st, the fee shall be two-thirds (2/3) of the regular fee for the particular year license. The annual license fee for spayed or neutered dogs shall be fifty percent (50%) of the license fee imposed in this Chapter. Certificate of alteration must accompany license application. 6.16.030 Exemption for Seeing Eye dogs. No license fee shall be charged for Seeing Eye dogs whose owner (s) are legally blind. 6.16.040 Expiration date. All dog licenses required by this Chapter shall expire on the thirtieth (30th) day of June of the succeeding year in which the same were issued. 6.16.050 Penalty fee for delinquent renewal. If the license fee required by this Chapter is not renewed by the first day of August there shall be added to such license fee a penalty of one-third (1/3) of the regular fee. The penalty shall be collected at the time of the renewal of the license. -1- 11/15/89 6.16.060 Tags furnished by collector --Contents. The license collector or other proper official shall deliver to the applicant for a dog license, as required under this Chapter, a metal tag bearing the number of the license issued stamped or engraved thereupon, the current fiscal year, and the words "Beaumont, California." 6.16.070 Transfer of license and license tag. No license or license tag issued to one dog under this title shall be transferred to another dog. 6.16.080 County license --Temporary nonresidents valid. Notwithstanding the other provisions in this Chapter, a dog license tag issued by the County shall be considered valid until its expiration. This Section shall apply to nonresidents temporarily within the City. 6.16.090 Duplicate tags. Duplicate tags, in case of loss, may be issued by the license collector or other proper official. Such tags shall be issued at the expense of the applicant. The cost of a duplicate tag shall be one dollar and fifty cents ($1.50) . 6.16.100 Use of tags other than those provided in this Chapter. No license tag shall be used on the collar of any dog other than those tags provided for in this Chapter. 6.16.110 Unauthorized removal of tags --Collars. No person shall remove the collar or tag from any dog without the consent of the owner or the party to whom the license required under this Chapter is issued. 6.16.120 License fee --Senior citizens. Notwithstanding the provisions of Section 6.16.020 and upon proof of age, any person sixty-five (65) years of age or older owning or having custody or control over a dog over the age of four (4) months in the City shall pay for such dog a fee of one dollar ($1.00) for a license for one (1) year. Such fee shall be due and payable in the manner prescribed by Section 6.16.020 of this Chapter; provided, however, that the fee for obtaining a one-year license after December 31st shall be the regular fee charged pursuant to Section 6.16.020. The license fee provided for in this Section shall be limited to one dog per person; the provisions of Section 6.16.020 shall govern the fees required to be paid by any person sixty-five (65) years of age or older for any additional dogs owned or over which control is exercised. SECTION 3: Section 6.20.110 of the Municipal Code of the City of Beaumont is hereby repealed. SECTION 4: Section 6.20.110 is added to read as follows: 6.20.110 Sale of impounded dogs. A. In the event any dog impounded in accordance with the provisions contained in this Chapter is not claimed by its owner within the time limit specified in this Chapter, the officer or person mentioned in Section 6.20.010 may, in lieu of destroying such animal, offer such animal for sale to general public for a sum equal to the sum which an owner would have to pay in order to have such dog released. B. Upon the sale of any dog that has not been spayed or neutered, a deposit for spaying or neutering the dog shall be tendered to the license collector or other proper City official. The deposit shall be in an amount to be fixed by resolution of the City Council of the City of Beaumont, based upon the lowest reasonable fee charged by veterinarians in the Beaumont area for spaying or neutering a dog, but in no case to exceed forty dollars ($40.00). In addition to the deposit, a processing fee of five dollars ($5.00) shall be paid. C. For any dog over the age of six (6) months at the time it is sold pursuant to Subsection A, the dog shall be spayed or -2- neutered within sixty (60) days and a written statement or receipt from a licensed veterinarian or clinic that has spayed or neutered the dog shall be submitted to the licensed control officer or other appropriate official. Upon receiving the written statement or receipt, the City official shall return the deposit described in Subsection B to the purchaser of the dog. If the written statement is not returned timely, the deposit shall be deemed unclaimed and forfeited. For dogs six (6) months of age or younger at the time sold, the owner shall have a period of six (6) months in which to submit the written statement or receipt before the deposit shall be deemed unclaimed and forfeited. D. Any deposit not claimed under Subsection B shall be used only for the following purposes: 1. A public education program to prevent overpopulation of dogs and cats. 2. A program to spay or neuter dogs and cats. 3. A follow-up program to assure that animals sold or given away by the pound or shelter are spayed or neutered. 4. Any additional costs incurred under this Section. SECTION 5: Section 16.24.050 is added to read as follows: 6.24.050 Sale of impounded cats. A. In the event any cat impounded in accordance with the provisions contained in this Chapter is not claimed by its owner within the time limit specified in this Chapter, the officer or person mentioned in Section 6.24.020 may, in lieu of destroying such animal, offer such animal for sale to general public for a sum equal to the sum which an owner would have to pay in order to have such cat released.
