AN URGENCY ORDINANCE OF THE CITY COUNCIL OF
THE CITY OF BEAUMONT, CALIFORNIA, ADDING
TO THE BEAUMONT MUNICIPAL CODE SECTION 17.60.015,
SUBSECTION A THE FOLLOWING PARAGRAPH, DEALING
WITH THE TEMPORARY OUTDOOR ADVERTISING DISPLAYS
RESULTING FROM GOVERNMENT CONSTRUCTION WORK.
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF BEAUMONT,
STATE OF CALIFORNIA, AS FOLLOWS:
SECTION 1: Section 17.60.015, Subsection A9 is hereby added
to read as follows.
9. Notwithstanding any other provision of this
Title 17, if, as a result of road, building or other construction
by the City, County, State or Federal government or any agency
thereof, the visibility of or normal vehicular and pedestrian
accessibility to any on-site advertising structures and/or signs
is substantially reduced or impaired, the Community Development
Director may, in his sole discretion, issue a permit upon written
application by the owner of the impaired on-site advertising
structure and/or sign pursuant to Subsection B hereinbelow, for
an Outdoor Advertising Display (off-site) of equivalent size and
location to that impaired. Said permit shall be valid only for
the length of time that visibility or accessibility is impaired
plus thirty (30) days, and in no event shall a permit be issued
for a period of more than one hundred eighty (180) days. If at
the end of that time the impairment still exists, upon submission
of a new application, the Community Development Director in his
sole discretion may issue a second such permit. In lieu of a
permit for outdoor advertising display under this Subparagraph 9,
the Community Development Director may for a similar time period
permit modification or suspension of any of the requirements of
Section 17.60.020 to provide signage equivalent to that impaired.
SECTION 2: This Ordinance is for the immediate preservation
of the public peace, health, and safety.
SECTION 3: This Ordinance shall take effect as provided by
law.
PASSED AND ADOPTED UPON FIRST READING this 24th day of
September, 1990, upon the following roll call vote.
AYES: Council Member Leja, McLaughlin, Parrott and Mayor
Connors.
NOES: None.
ABSTAIN: None.
