AN URGENCY ORDINANCE OF THE CITY COUNCIL OF
THE CITY OF BEAUMONT, CALIFORNIA, ADDING
TO THE BEAUMONT MUNICIPAL CODE SECTION 8.32.425,
DEALING WITH THE RIGHT OF ENTRY TO ABATE
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF BEAUMONT,
STATE OF CALIFORNIA, AS FOLLOWS:
SECTION 1: Section 8.32.425, is hereby added to the
Beaumont Municipal Code to read as follows.
8.32.425 Right of Entry to Abate. The Chief, Director,
Health Officer and City Manager shall be entitled to enter vacant
buildings or premises to carry out any order to abate a public
nuisance. If the building or premises are occupied, credentials
shall be presented to the occupant and permission to enter must
be obtained. In the event that the building or premises are
secured against entry, a reasonable effort shall be made to
locate the owner or other persons having charge or control over
the property for permission to enter. If entry is refused or
cannot be obtained, the Chief, Director, Health Officer, or City
Manager shall obtain such authorization as may be necessary under
the circumstances to secure entry. Authorization may be obtained
following the same procedures as set forth in state law for
inspection authorization, including but not limited to obtaining
from the municipal court an administrative abatement warrant.
SECTION 2: This Ordinance is for the immediate preservation
of the public peace, health, and safety.
SECTION 3: This Ordinance shall take effect as provided by
law.
PASSED AND ADOPTED UPON FIRST READING this 14th day of
January, 1991, upon the following roll call vote.
AYES: Council Member Leja, McLaughlin, MacNeilage, Parrott,
and Mayor Connors.
NOES: None.
