INITIATION: The regular meeting of the City Council of the City of Temple 2. City was called to order by Mayor Dickason at 7:30 P. M., who led the Pledge of Allegiance to the Flag. 3. INVOCATION: City Manager Woollett cave the invocation. 4. ROLL CALL: PRESENT: Councilmen - Buchan, Fitzjohn, Merritt, Dickason ABSENT: Councilman - Tyrell ALSO PRESENT: City Attorney Shatford, City Manager Woollett 5. APPROVAL OF MINUTES: Mayor Dickason stated he wished to correct the minutes for two misspelled words on page 5, Councilman Fitzjohn moved to approve the minutes of March 26, 1962, as mailed with these corrections, Councilman Buchan seconded, roll call vote as follows: AYES: Councilmen- Buchan, Fitzjohn, Merritt,'Dickason NOES: Councilmen -None ABSENT: Councilman - Tyrell 6. PUBLIC HEARING: 7:30 P. M. PROPOSED CURB & GUTTER IMPROVEMENTS SOUTH SIDE OF OLIVE ST., TEMPLE CITY BLVD, TO BARELA, Mayor Dickason declared the Public Hearing opened, City Manager Woollett stated for the record the petition receive was for installation of improvements on the south side of Olive St. in the 9600 block between Temple City Blvd. & Barela St. - The cost is to be borne by owners of the property where improve- ments are to be installed. Property owners of 100% of the prop- erty have signed the petition. John Posen, 9640 Olive St., stated he represented the petition- ers, and the reason For requesting City Council assistance was that none of the petitioners knew just how to handle it as they had contacted three contractors with no replies. City Manager Woollett advised that if the Council approves this tonight that each property owner will be given 60 days to inw stall these improvements, and after that time if not done the City will do it and bill them for the costs. The City Attorney ruled that the 60 days could not be waived even though the sicn -up of property owners was 100% however if all concerned advise they want the City to do it he presumed there would not be any objection. City Manager Woollett stated if the Council - makes a determination that the work be done pursuant to the re- quest he can order the design and engineering work done which would consume a part of the 60 day requirement. Following discussion Councilman Buchan moved the Hearing be clos< ed, Councilman Fitzjohn seconded, roll call vote as follows: AYES: Councilmen- Buchan, Fitzjohn, Merritt, Dickason NOES: Councilmen -None ABSENT: Councilman- Tyrell Councilman Merritt moved to instruct the City Manager to cause the proposed curb and gutter improvement on the south side of Olive St. from Temple City Blvd. to Barela St. to be installed and that he also cause the engineering work to be done for this purpose, Councilman Buchan seconded. City Manager Woollett ad- vised he felt we can work dose with the property owners on this and he thinks we can control this closely enough so it will not involveAcity funds. ORDINANCE NO. 62 -69: 2nd reading. City Attorney Shatford read title to Ordinance No. 62 -69 AN ORDINANCE OF THE CITY OF TEMPLE CITY, CALIFORNIA, REGULATING THE MAINTENANCE OF SWIMMING POOLS AND FENCING THEREOF. Councilman Merritt moved to waive further reading, Councilman Buchan se- conded, roll call vote as follows: AYES: Councilmen - Buchan, Fitzjohn, Merritt, Dickason NOES: Councilmen-None ABSENT: Councilman - Tyrell Councilman Merritt moved to adopt Ordinance No, 62 -69, Council- man Buchan seconded, roll call vote as Follows: AYES: Councilmen- Buchan, Fitzjohn, Merritt, Dickason NOES: Councilmen -None ABSENT: Councilman- Tyrell 8. City Manager Woollett reported to the Council the following changes on the election boards: Precinct 1, Jule Franklin, 6430 Loma Ave., replacing Charlotte Severns Precinct 7, Martha Lambert, 5703 N. Rio Hondo Dr., replacing Pearl Darnell Precinct 8, Dorothy Runham, 5612 Golden West Ave., replacing Jean U. Beckley Precinct 11, Caroline Christenson, 4877 Fratus Dr., replacing Ann Waters Precinct 13, Lola M. Urban, 5143 Barela St., replacing Marian Hatch Councilman Fitzjohn moved to approve, Councilman Buchan second - ed, roll call vote as follows: AYES: Councilmen - Buchan, Fitzjohn, Merritt, Dickason NOES: Councilmen -None ABSENT: Councilman- Tyrell 10. AWARD OF CONTRACT: LIVE OAK IMPROVEMENT CASH CONTRACT #41157 City Manager Woollett read a letter from the Road Dept. Supt. of Streets stating the bids had been reviewed, and the Boddum Con- struction Co. was the low bidder, and requesting the City Coun- cil to instruct the City Attorney to prepare , and the Mayor be instructed to sign, an agreement for Cash Contract #41157 to Boddum Construction Co., 6116 Paramount Blvd., Los Angeles 5, Calif., in the sum of $33,871.35. Mr. \!oollett also advised the Council the total appropriation For this project was set at $68,000.00. With preliminary engineering, project engineer, plans and specifications the total cost is estimated to be from $30,000. to $40,000. There were seven bids, with the Boddum Con_. struction Co. being the low bidder which is a thoroughly compe- tent firm, and the City Manager recommends the recommendation as read be passed by the City Council. Councilman Buchan m,ved that the City Manager be instructed to execute a contract pre- pared by the City Attorney for work to be done under cash con- tract #41157 covering the work on Live Oak Ave. from Encinita Ave. to Temple City Blvd., to the Boddum Construction Co., Inc., 6116 Paramount Blvd., Los Angeles 5, Calif., in the amount of $33,371.35, as recommended by N. H. Templin, County Superinten- dent of Streets. Councilman Fitzjohn seconded. 7:55 P. M. Councilman Tyrell arrived at this time. Roll call vote as follows: AYES: Councilmen- Buchan, Fitzjohn, Merritt, Tyrell, Dickason NOES: Councilmen -None ABSENT: Councilmen -None RESOLUTION NO. 62 -197: Revising 1961 -62 Budget City Manager Woollett advised this would increase activity ac- count #1800 - GENERAL GOVERNMENT BUILDINGS by $1000.00, making the total appropriations for all funds $587,257.00 and not 261 Council Minutes, April 9, 1962, page 3 $536,257.00. This $1000. increase Is to provide for appraisal services on buildings and property concerned with the proposed new library of this City and no money was budgeted last year as this was not considered at that time. This was the low bid- der and he considers this e very reasonable figure considering the report. Councilman Fitzjohn moved to approve Resolution No. 62 -197, Councilman Merritt seconded, roll call vote as follows: AYES: Councilmen - Buchan, Fitzjohn, Merritt, Tyrell, Dickason NOES: Councilmen -None ABSENT: Councilmen -None 12. RESOLUTION NO. 62 -198: Y4arrants & Demands Councilman Merritt moved to adopt Resolution No 62 -198, war- rants & demands Nos. 1260 through 1305, in the sum of $9174.19, Councilman Buchan seconded, roll call vote as follows: AYES: Councilmen - Buchan, Fitzjohn, Merritt, Tyrell, Dickason NOES: Councilmen -None ABSENT: Councilmen -None 9. PUBLIC HEARING: 8:00 P. M. PROPOSED CURB & GUTTER IMPROVEMENTS ON EAST SIDE OF ZADELL ST. OLIVE ST. SOUTH Mayor Dickason declared the Public Hearing opened. City Manager Wooflett explained this was the same as the previ- ous petition considered for the east side of Zadell St. south to the cul de sac in the 5300 block. There are two who have not signed, one of the 60' properties involved already has curb and gutter installed and is in escrow. The other signature of the property owner we do not have which is for the southeast corner of Ladell St. and Olive, owned by Virginia M. Williams. Two owners of 120' already have curb and gutter and as required one of these has signed the petition. If 60% of the property owners have signed the petition it is possible for the Council to indi- cate to the other property owners and go along with the improve- ment. In checking he learned Mrs. Williams has instructed the contractor who is doing this other work to place curb and gutter around her property although this has not officially been report . ed by Mrs. Williams. Also this project has already been engin- eered and 68% of the footage ownership have signed the petition. It is within City Council authority that the work be done within the entire area of this project. Noone in the audience wished to speak for or against the peti- tion. Councilman Tyrell moved the Public Hearing be closed, Councilman Fitzjohn seconded, roll call vote as follows: AYES: Councilmen- Buchan, Fitzjohn, Merritt, Tyrell, Dickason NOES: Councilmen -None ABSENT: Councilmen -None Councilman Fitzjohn moved to instruct the City Manager to cause the proposed curb and cutter improvement on the east side of :adell St. from Olive St. south be installed, Councilman Buchan seconded, roll cal-} vote as follows: AYES: Councilmen- Buchan, Fitzjohn, Merritt, Tyrell, Dickason NOES: Councilmen -None ABSENT: Councilmen -None 13. PLANNING COMMISSION RECOMMENDATIONS: A. Zone variance Case 62-28, 5517 -5523 N. Rosemead Blvd. Mr. Cushman, Planning Advisor, stated the request is to put in a garage at this location and the rear 40' is in zone P and the owners wish to put the building to the end of the property. The Planning Commission recommend it be approved subject to the following conditions: 1, Developed in accordance with Plot Plan in case 2. Completed prior to July 1, 1962 3. Agreement by applicant that there be no fender or body work done on the premises, which owner has agreed to. Owner also agreed to put up a 7' masonry wall at the rear and wouth side where the parking lot area is to be. 262 Council Minutes, April 9, 1S62, page 4 Mr. Winged, 5555 N. Rosemead Blvd., contractor for the re- quested building,requested if approved that the completion date be extended as t) demolish and reconstruct and arrange financing constitutes a hardship to complete by July 1, 1962. Noone else wished to speak for or against this request. Councilman Merritt moved the Council approve the recommenda- tions of the Planning? Commission in Zone Case No. 62 -28 and that the variance as requested be granted, subject to the con ditions set forth in Planning Comm. -Res. No. 62 -13PC except for the completion date, which be amended to September 1, 1962, Councilman Buchan seconded, roll call vote as follows: AYES: Councilmen- Buchan, Fitzjohn, Merritt, Tyrell,Dickason NOES: Councilmen -None ABSENT: Councilmen -None 3. Zone variance Case 62 -27, 4803 N. Camellia This request is to c._nstnuct in the sideyard of an existing residential property an office and work area for a pest ex- termination business. It is presently zone A -1, property to is commercially developed. This requires a property line variance for set -back and to permit commercial use. Mr. Cushman stated the Planning Commission recommends approv- al with the following; conditions: 1. It be developed substantially in accordance with the Plot Plan in the case. 2. Approve side -yard set -back prior to signs being installed, and approved by the Planning Commission 3. That only business to be conducted shall be within the structure shown to be constructed on the Plot Plan. 4. That only business to be conducted shall be the extermina- ting business, and before any business can be conducted a zone variance shall be obtained. 5. Owner to file affidavit stating he is aware of and accepts all of the conditions of the variance as granted. Robert Bristol, owner of the property asked for clarification regarding a sign and was advised that Planning Commission would first have to approve any sign installation before being installed. Following considerable discussion regarding chemicals involv- ed Councilman Tyrell moved that the recommendations of the Planning Commission in Zone Case No. 62 -27 be approved and that the variance as requested be granted subject to the conditions set -Forth in Resolution No. 62 -14PC of the Plann- ing Commission, except that in regard to chemical extermina- tion products only pre- packaged labeled goods may be sold or kept on the premises. ORDINANCE NO. 62 -73: Re- sideyard set - backs on corner lots. City Attorney Shatford read title to Ordinance No. 62 -73 AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF TEMPLE CITY, CALIFORNIA, ADDING SECTION 9107 THROUGH 9109 TO THE MUNICIPAL CODE REQUIRING PLOT PLAN APPROVAL PRIOR TO ISSUANCE OF BUILD- ING PERMIT FOR ANY CONSTRUCTION ON CORNER LOTS. Councilman Tyrell moved to waive further reading, Councilman Merritt seconded, roll call vote as follows: AYES: Councilmen - Buchan, Fitzjohn, Merritt, Tyreli,Dickason NOES: Councilmen -None ABSENT: Councilmen -None As this was the 1st reading of Ordinance No. 62 -73 no further action was taken. 14. TRAFFIC COMMISSION RECOMMENDATIONS: A, Proposed new hours of operation new time signals on Las Tunas Dr.: Recommend no change. Mrs. Georgia Maxey, Chairman of the Traffic Commission stat- ed this was considered by the Commission and both the Traf- 263 1 Council Minutes, April 5, 1562, page 5 fic Engineer and Sot. Wallace of the Sheriffs Dept. agreed that the timing and operation should remain as it is present- ly. Following much discussion Councilman Buchan moved to accept the recommendation of the Traffic Commission, Council- man Fitzjohn seconded, roll call vote as follows: AYES: Councilmen- Buchan, FitZ1ohn, Merritt, Tyrell,Dickason NOES: Councilmen -None ABSENT: Councilmen -None 15. COMMUNICATIONS: City Manager Woollett read two communications from the Los Angeles County Boundary Commission retarding two annexations to the City of El Monte, not effecting Temple City. Councilman Tyrell moved to receive and file, Councilman Buchan seconded, and carried. 1 6 . TIME RESERVED FOR THOSE I N THE AUDIENCE WHO WISH TO SPEAK. Mr. Wm. Conover, 5428 Temple City Blvd.,requested the Council to endorse the Lewis Francis petition to aid in getting an amendment on the June ballot against the Communist movement in the State of Calif. This is to keep subversives from holding any position paid for from taxes, and to _allow no tax exemptions to members of a subversive group. Following dis- cussion City Manager \Ioollett suggested that sufficient copies be provided for the Council and staff, and this can be brought up for recommendation at the next meeting. Mr. Conover agreed to supply the requested copies. 17. MATTERS FROM CITY OFFICIALS: Mayor Dickason stated he would like to have the City Treasurer attend Council meetings once per month and make a report to the Council regarding finance meetings etc. City Manager '.!ooll- ett suggested the 4th Monday of every month as it follows the Finance meeting. Also Mayor Dickason requested Mr. Whitnall attend a Council meeting and give a personal report and give the Council a chance to ask him questions. Mr. Woollett stated Mr. Whitnall will be present at the next Planning Commission meeting for formulation of classes for interested persons in the community. Mayor Dickason felt it important to get this program moving so we can get a good Feaster Plan for the City of Temple City and get a better understanding of what has been done. The City Manager read a letter from H. C. McClellan of the Dod- ger Stadium Committee requesting Apr. 1 -21 as Baseball Fiesta for dedication of Dodder Stadium, Councilman Buchan moved that .pr. 1 -21 be proclaimed as Baseball Fiesta time, Councilman Fitzjohn seconded, and as there was no objection Mayor Dickason so proclaimed, City Manager Woollett read a letter from the Pan American Union requesting Apr. 14 be proclaimed as Pan American Day and Week as a time for celebration in this City. Councilman Merritt mov- ed to receive and file, Councilman Buchan seconded, roll call vote as follows: AYES: .Councilmen- Buchan, Fitzjohn, Merritt, Tyrell NOES: Councilman - Dickason ABSENT: Councilmen -None The City Manager read a letter from Albert S. Anspach of the Rotary Club of Temple City regarding a Sea Scout 180 project of displaying flags and having them available to the public at a cost of $5.00 Nnd also requesting permission from the Coun- cil to solicit the citizens of Temple City. Councilman Fitz- john moved the permit request of the Sea Scouts be granted, Councilman Buchan seconded, and carried. City Manager Woollett requested the Council to authorize the appointment of William Peters as a recreation leader to replace 264 1 1 1 Council Minutes, April 9, 1962, page 6 Kurt Myers who has left the area. Councilman Tyrell so moved, Councilman Fitzjohn seconded, roll call vote as follows: AYES: Councilmen - Buchan, Fitzjohn, Merritt, Tyrell, Dickason NOES: Councilmen -None ABSENT: Councilmen -None The City Manager read a letter from Lorraine Vogt, 5737 Golden lest Ave., requesting permission for the Senior High members of the Methodist Youth Fellowship to hold a Spring Festival on the grounds of the Community Methodist Church, Saturday, April 23, and a bake sale in front of Leiberg's Dept. Store Saturday, May 12. Councilman Tyrell moved to approve, Councilman Merritt se- conded, roll call vote as follows: AYES: Councilmen Buchan, Fitzjohn, Merritt, Tyrell, Dickason NOES: Councilmen -hone ABSENT: Councilmen -None The City Manager presented other curb and gutter projects and read the list and recommended the Council appoint the City Mana- ger as Superintendent of Streets for this purpose and authorize a public hearing; on May 14, for the following: Olive St. - south side between Fratus and Alessandro Alessandro Ave. - west side between Olive & Blackley Blackley St. - north side between Encinita & Fratus Blackley St. - south side between Encinita & Alessandro Blackley St. - north side between Fratus & Alessandro Fratus Dr. - east side between Olive & Blackley Councilman Tyrell moved to appoint the City Manager as Superin- tendent of Streets for these projects and set a Public Hearing for them on May 14, at 8 P, M. at the City Hall. Councilman Buchan seconaed, roll call vote as follows: AYES: Councilmen- Buchan, Fitzjohn, Merritt, Tyrell, Dickason NOES: Councilmen -None ABSENT: Councilmen -None City Manager Woollett advised the Council that one of the resi- dents has pigeon trouble and none of the prescribed treatments has been of any help, and he requests permission to use a B -B gun on his own property to solve the problem. City Attorney Shatford advised that according to our Municipal Code we could not grant this permission. The City Manager read a letter from the Boundary Commission re- garding an annexation to Monrovia. Councilman Fitzjohn moved to receive and file, Councilman Buchan seconded and carried. City Manager Woollett read a letter from Sherwin Williams Paint Co. requesting a permit to distribute home decorators guides in Temple City, distribution to be done by a local Boy Scout troop and only to be handed out at the door, the troop being paid for their work and the money going into their treasury. Councilman Tyrell stated as a member of the Board of Directors of the Scout Council he Felt this sort of thing should be approved by the Scout Council first. Following discussion Councilman Tyrell so moved, and it was agreed that this should be done, 18. ADJOURNMENT: Councilman Tyrell moved to adjourn to April 17, at 7:30 P.
